They will be replacing three trees removed by replacing them with three (3) Japanese Cedars Parcel 2384200010-3825 South 128th Street, Tukwila WA 98168 PL 18-0032 Neighborhood Commercial Center II. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Planning Supervisor has determined that the application for a Tree removal Permit does comply with applicable City and State Code requirements and has approved the application with the following conditions: 1. Trees are to be planted with guidance from the newly revised landscaping code, adopted March 6, 2017. Standards that should be considered for this project include: A. The Plant Material Requirements and Tree Standards 18.52.060 - Plants shall meet the American Standard for Nursery Plant Stock, which are described as healthy, vigorous, and well formed, with well developed, fibrous root systems, free from dead branches or roots. - Evergreen trees will be a minimum of 6-feet in height at the time of planting. - Trees shall be provided adequate spacing from new and existing trees. The Soil Preparation, Planting, and Irrigation Standards 18.52.070 -For all plantings, soils must be prepared for planting in accordance with BMP T5.13, "Post Construction Soil Quality and Depth, " from Washington Department of Ecology Stormwater Management Manual for Western Washington. - The applicant will be required to schedule an inspection by the City of the planting areas prior to planting to ensure soils are properly prepared. Soils must be amended, tilled and prepped to a depth of at least 12 inches. - Installation of plants must comply with the BMP standards which include planting holes that are the same depth as the size of the root ball and two to three times wider than the root ball; root balls must be loosened and pruned as necessary to ensure no encircling roots; top root flare must be placed at grade. - The applicant is responsible for providing proper hydration to the plant to ensure its long-term viability. C. The Maintenance and Pruning Standards 18.52.080 -Any landscaping required by this chapter shall be retained and maintained by the property owner for the life of the development in conformance with the intent of the approved landscape plan and this chapter. Maintenance shall also include keeping all planting areas free of weeds and trash and replacing any unhealthy or dead plant materials. - Pruning of trees and shrubs is only allowed for the health of the plant material, to maintain sight distances or sight lines, or if interfering with overhead utilities. All pruning must be done in accordance with American National Standards institute (ANSI) A- 300 specifications, as it now reads and as hereafter amended. 2. The applicant is responsible for ensuring the survival of the three (3) Japanese Cedar Trees within the planting area. This means the applicant will ensure proper hydration, root placement and will monitor the growth of the plants to ensure sustained growth after the monitoring period has elapsed. III. FINDINGS This landscape revision application is a request to remove two (2) dead pine trees and one (1) Cottonwood tree that is overgrown and is damaging the adjacent property. The applicant proposes to plant three (3) Japanese Cedar. These trees will be planted within the landscaped perimeter of the site. Trees should be planted in October 2018, in order to take advantage of the fall and winter rainy seasons. Proper planting techniques will be followed, and a mulch application will be placed on top of the root ball while leaving the area of the root crown clear. Weeds will be monitored throughout the spring and summer and follow up weeding conducted if necessary. Tukwila's Landscaping Requirements (TMC 18.52) regulate the clearing of trees and understory vegetation. For this proposal, an irrigation system already exists. The Tukwila School District will ensure proper hydration of Japanese Cedars that will be planted in the landscaped perimeter area. IV. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. V. PROCEDURES AND TIME FOR APPEALING In order to appeal the Planning Supervisor's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision. The requirements for such appeals are set forth in Tukwila Municipal Code Ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Planning Supervisor who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Planning Supervisor before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW Ch. 36.70C. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VII. Both trees are dead and should be removed and replaced with 2 similar species. You had suggested Japanese Cedar (Cryptomeria Japonica). These would be appropriate trees to plant in the area that you are concerned about. I have also inspected the Cottonwood tree located in the Northeast corner of the Transportation Lot. I have determined that this tree is younger and healthy, however, it was not planted on purpose and has the potential to be problematic as it grows. Cottonwood trees can become dangerous to employees or other people on School Property if they grow too large and unmanageable. This can lead to liability issues if the tree were to fail during severe weather. This tree will also cause damage to the surrounding sidewalk and pavement as the root system will eventually become too large for its location. This Cottonwood tree will search for an easy water source as it grows, such as underground utilities, causing more damage. I recommend a controlled removal of the Cottonwood and replacing it with an ornamental tree that is limited in size but nice in appearance.
