I. PROJECT INFORMATION Project File Number: PL18-0050 Applicant: Chris Burdett for Hampton Inn Type of Permit: Tree Removal and Landscape Modification Permit Project Description: Remove 20 landscape trees and replace with 17 trees as well as shrubs and groundcover in the interior parking lot area of the hotel. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Planning Supervisor has determined that the application for a Tree Removal and Landscape Modification Permit does comply with applicable City and State Code requirements and has approved the application with the following conditions: 1. Trees are to be planted with guidance from the landscaping code. Standards that should be considered for this project include: a. Significant Tree Retention Standard 18.52.050 i. All significant trees located within any required landscape area that are not dead, dying, diseased, or a nuisance species, as identified in the Tukwila Approved Tree List, and that do not pose a safety hazard or conflict with overhead utility lines as determined by the City or an ISA certified arborist, shall be retained and protected during construction with temporary fencing or other enclosure, as appropriate to the site and following Best Management Practices for tree protection. ii. A minimum 4 feet high construction barrier shall be installed around significant trees and stand of native trees or vegetation to be retained. b. Soil Preparation, Planting and Irrigation Standard 18.52.070 i. For landscaping in sidewalks and parking Tots, or in limited areas of soil volume, structural soils (Cornell University product or similar) must be used to a preferred depth of 36 inches to promote tree root growth and provide structural support to the paved area. Trees and other landscape materials shall be planted according to specifications in "CU Structural Soils — A Comprehensive Guide", as it now reads and as hereafter amended. ii. All required plantings must be served by a permanent automatic irrigation system, unless approved by the Director iii. Irrigation shall be designed to conserve water b using the best practical management techniques available, including BMPs, for daily timing of irrigation to optimize water infiltration and conservation. These techniques may include, but not be limited to: drip irrigation (where appropriate) to minimize evaporation loss, moisture sensors to prevent irrigation during rainy periods, automatic controllers to ensure proper duration of watering, sprinkler head selection and spacing designed to minimize overspray, and separate zones for turf and other landscaping and for full sun exposure and shady areas to meet watering needs of different sections of the landscape. • • • V. PROCEDURES AND TIME FOR APPEALING In order to appeal the Planning Supervisor's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision. The requirements for such appeals are set forth in Tukwila Municipal Code Ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. VI. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Planning Supervisor who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Planning Supervisor before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW Ch. 36.70C. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. • • iv. The applicant will be required to schedule an inspection by the City of the planting areas prior to planting to ensure soils are properly prepared. Soils must be amended, tilled and prepped to a depth of at least 12 inches. 2. All building and construction work at the site must occur before trees, shrubs, or groundcover is planted. All Planning inspections including irrigation and Planning Final are required prior to the final building inspection. 3. A total of 122 trees are required to be replaced for the removal of 20 trees. Applicant has proposed to plant 17 trees on site. The applicant shall pay fee -in -lieu into the City's Tree Fund for the remaining 105 trees at a cost of $124 per tree. This fee shall be paid prior to final building inspection. Please note there are additional fines for removal or damage of trees or specimen shrubs without first applying for and obtaining required City approval. A separate letter from Code Enforcement under file number CE18-0055 will follow this Notice of Decision. III. FINDINGS This tree removal and landscape modification application is a post -facto request to remove 16 Sweetgum Trees with a DBH between 10 and 18 inches, 2 Pine Trees with a DBH of 15 inches, one Atlas Cedar Tree with a DBH of 24 inches, and one Magnolia Tree with a DBH of 12 inches. This will require the replacement of 122 trees, 17 of which are proposed on the site, leaving 105 trees to replace with fee -in -lieu into the City of Tukwila's Tree Fund at a cost $124 per tree. The applicant proposes to plant 16 Red Rage Tupelo trees and 1 Eddies White Wonder Dogwood tree along with shrubs and groundcover in the parking lot of the Hampton Inn at 7200 S 156th St. One planter island will be installed on the site, removing one parking stall. Proper planting techniques will be followed, and a 3" mulch application will be placed on top of the root ball while leaving the area of the crown clear. IV. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. • • VI1. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Meredith Sampson, who may be contacted at 206- 431-3661 for further information. Response: Only one perimeter tree is to be removed (12" Magnolia at SW portion of site). Existing stands of trees along north and south sides of property are to be left undisturbed. There are no shoreline environments, sensitive areas, or sensitive area buffers on the site. b. . "All understory vegetation within the essential root zone of protected trees shall be (1) retained; OR (2) removed by methods which are non -damaging to the tree, and replaced with vegetation with horticultural requirements which are compatible with protected trees." Response: No understory vegetation is to be removed from essential root zones of trees to be retained. c. "Vegetation removal shall be undertaken in such a manner as to preserve, to the degree possible, the aesthetic and ecological benefits provided by such vegetation." Response: Trees proposed for removal are to be replaced with new trees in the same locations,. except where parking lot islands are deemed too small or where trees would obstruct existing parking lot lighting. 18.54.130.2. Tree Protection Measures a. "The proposal shall include tree protection measures which meet or exceed best management practices and current standards of professional arboriculture, and which are sufficient to ensure the viability of protected trees and other vegetation identified for protection pursuant to requirements of this chapter..." Response: No tree or vegetation removal activities are proposed to take place near trees to be retained. Removal and disturbance of other existing vegetation will be minimal (some lawn area and parking lot islands). Removed vegetation will be replaced with equal or similar vegetation. Some lawn areas will be replaced with shrubs and groundcover. Impact to existing trees from building renovation work is 1 • anticipated to be minimal. Tree protection best practices will be employed for any trees whose root zones fall within proposed work areas. b. "During clearing and/or construction activities, all protected vegetation shall be surrounded by protective fencing which prevents adverse impacts associated with clearing from intruding into areas of protected vegetation. Response: No tree or vegetation removal or clearing activities are proposed to take place near trees or other vegetation to be retained. Clearing and tree removal is limited to parking lot islands. If circumstances change and such activities are expected to occur near existing vegetation to remain protective fencing will be provided. 18.54.130.3. Tree Replacement Tree replacement ratios in this section appear to apply to Sensitive Areas, which does not apply to this project site. We are following permit approval criteria for "Tree Replacement in Landscape Areas" as described on the City -provided information sheet as follows: 1) Each tree removed will be replaced on a one-to-one basis with a species that will attain a similar size and canopy coverage at maturity as the removed tree would have attained." Response: Trees to be removed include (15) American Sweetgum, (1) Southern Magnolia (unknown variety), and (1) Atlas Cedar. Sweetgums are to be replaced with Red Rage Tupelo (Nyssa sylvatica 'Haymanred'), which reaches a similar canopy spread with a shorter mature height. The Magnolia is to be replaced with Eddie's White Wonder Dogwood, which has a smaller stature (25' high x 20' diameter) than the Magnolia and deciduous foliage to allow better visibility of the hotel from the adjacent street R.O.W. 2) "Exception will be considered if there are utility, overhead electrical lines, or other limitations." Response: Three of the trees to be removed will not be replaced due to various limitations: • Two would obstruct adjacent parking lot pole lights near south parking lot entries. • One is in a location too close to the building (Atlas Cedar at south tip of building near main building entry) Two trees to be removed from two undersized parking lot islands on the west side of the building will be replaced in a different location, in the large parking lot island south of the building. 3) "Replacement Tree Quality and Size." Response: Plant sizes will meet required minimums of 2.5" caliper for deciduous trees, 6-8 feet height for evergreen trees, 24" ht. for shrubs, and 1 gallon for groundcover, and meet American Standard for Nursery Stock. Tree species shall be suited and adapted to local climate. Planting and maintenance will be in accordance with best management practices (see detail and notes on sheet L3). 2 tlo • 18.54.130.4. Surrounding Environment a. "The timing of, and methods to be used in any proposed vegetation removal shall be such that impacts to protected vegetation, wildlife, fisheries and the surrounding environment are minimized."
