This notice is to confirm the decision reached by Tukwila's SEPA Official to issue a Determination of
Non -significance (DNS) for the above project based on the environmental checklist and the underlying
permit application.
The City has determined that the proposal does not have a probable significant adverse impact on the
environment. An environmental impact statement (EIS) is not required under RCW 43.21c.030(2) (c).
This decision was made after review of a completed environmental checklist and other information on
file with the lead agency.
This information is available to the public on request. Project materials including the application, any
staff reports, and other studies related to the permits are available Monday through Friday 8:30 a.m. -
5:00 p.m. for inspection at Tukwila Department of Community Development 6300 Southcenter Blvd.,
Suite 100, Tukwila, WA 98188.

This DNS is issued under WAC 197-11-340(2). Comments must be submitted by September 18, 2019.

Revised Code of Washington (RCW 36.70C). Any appeal shall be linked to a specific governmental

III. BACKGROUND/PROPOSAL
The proposed project is to maintain stream channel and ditch locations in the city of Tukwila to
prevent localized flooding and damage to residential properties, commercial properties and
roadways. The proposed maintenance consists of using a backhoe and Vactor Truck to remove
accumulated sand and silt from the identified streams, ditches, and channels. Maintenance will
include the cutting and removal of grass and other weeds using handheld equipment. Running water
within the streams, ditches, and channels will be diverted around the project sites by the most
appropriate method to prevent downstream turbidity.
No fill is proposed; approximately 110 total cubic yards will be removed as part of the project.
The project will receive a SEPA (State Environmental Policy Act) determination.
All project sites are located within stream environments/buffers, with some sites located within
wetland buffers. No sites are located within the shoreline jurisdiction.

V. PUBLIC COMMENTS
A Notice of Application was sent to agencies with jurisdiction and posted in the Seattle Times on
October 3, 2018.
On October 4, 2018 Karen Walter of the Muckleshoot Indian Tribe provided the following comments
on the project (see Attachment C):
• Details for the work to be done at each location (i.e sediment removal only, sediment/wood
etc). For those projects removing wood, work should be further quantified by providing the
number and sizes of wood to be removed.
• Additional information to be provided for any stream where work is proposed that may have a
nearby culvert which could be affected by wood and sediment transport; provide the nearby
culverts and their dimensions relative to the stream width and contributing area.
• Status updates of any previous mitigation work associated with past maintenance actions at
the affected streams.
The applicant Jeff Heglund provided information on October 9, 2018 regarding work locations, nearby
culvert dimensions, and additional detail of project work scope.
Karen Walter replied on October 9, 2018 with the following response: "The City provided just the
culvert sizes. If the streams are larger than the culverts (i.e. wider), then the culverts are likely
creating hydraulic forces that are change natural sediment transport and deposition rates which is
leading to dredging. We were fine with this a couple of times that this has been done in the past but if
the culverts are part of the problem, they need to be replaced with larger culverts that don't cause the
same hydraulic forces on the stream. Please provide the additional information needed to address the
concerns we raised.
At location 3, this site is noted to having a highflow bypass facility. As such, this begs the question as
to why the stream needs to be dredged if there is an existing highflow by-pass facility which are
usually built to capture flows and sediment with the sediment being dredged regularly.
We hope the City recognizes that every time gravel is removed from a stream, it affects the quality
and quantity of downstream salmon habitat. Dredging should only be done at a minimum and
dredging that degrades salmon habitat should be mitigated. What will the City do for mitigation?"
Jeff Heglund responded on November 29, 2018 with additional information on stream size in relation
to nearby culverts. Max Baker, Assistant Planner, responded that additional information will be
needed to address the tribe's concern that the culverts may ultimately need to be replaced to avoid
the need for maintenance.

On July 18, 2019, Ryan Larson, Senior Program Manager for Surface Water Administration at the City
of Tukwila, provided information regarding the proposed future work that is planned to address
issues related to culvert design that have led to the need for ongoing maintenance of the subject
sites: "The City has budgeted $100K for design (2020) and $690K for construction (2021) of
improvements along S. 131st Place to try and deal with this issue. The project includes replacing the
culvert under S. 131st Place and will study and propose improvements to S. 131st Place to reduce the
maintenance needed for this stream section. It is important to note that the stream failure at this
location is both a historic problem and one that was significantly exacerbated with construction of the
second Normed Building that further altered the stream path. This area has always had a historic
issue since the stream flows from a steep gradient to this area where the gradient is not sufficient to
allow suspended materials to flow into the Duwamish River."
Following responses from the applicant no additional comments regarding the project were received.
VI. CONCLUSION
The proposal can be found to not have a probable significant adverse impact on the environment and
pursuant to WAC 197-11-340, a Determination of Nonsignificance (DNS) is issued for this project.
This DNS is based on impacts identified within the environmental checklist, attachments, and the
above "Final Staff Evaluation for Application No. E18-0009", and is supported by plans, policies, and
regulations formally adopted by city of Tukwila for the exercise of substantive authority under SEPA
to approve, condition, or deny proposed actions.

The City -Wide Stream Channel & Ditch Maintenance Program is intended to provide for a City-
wide program where the City of Tukwila may maintain identified stream channel & ditch
locations to prevent the localized flooding and damage to residential properties, commercial
properties and roadways. The proposed maintenance consists of using a backhoe and a Vactor
Truck to remove accumulated sand and silt from the identified streams ditches and channels.
The work also includes the cleaning of culverts using a high-pressure hose and vacuum system
to clear the accumulated sediment that is responsible for causing localized flooding. This
maintenance will include the cutting and removal of grass and other weeds along the stream,
ditch & channel using weed whackers and other hand type of equipment. Running water with in
the stream, ditch & channels will be diverted around the project sites by the most appropriate
method (screened pump or gravity flow) to prevent downstream turbidity. If any fish are
present we will capture and safely move them from the job site. They will immediately and
safely be transferred to free -flowing water downstream of the project site. The stream, channel
& ditch maintenance will need to be done annually between June 16th and September 30tn
There are four locations that have been identified as needing maintenance under this permit.

you to describe certain aspects of your proposal. You do not need to repeat those

The project at all four locations is to remove sand and sediment that is
impeding the flow and causing localized flooding. A bypass pump will be
used to divert water around the work site and back into the stream,
channel or ditch. The sand and sediment will be removed with a backhoe
and/or Vactor truck, transported to a covered storage area where it can
dry out, and then disposed of at an appropriate facility.

the City of Tukwila. We will be removing sand and silt with a backhoe and/or
Vactor truck and placing it into a 10 yard dump truck. The material will be hauled
to our storage yard and placed into a covered bin where it can dry out. We plan to
remove 20 yards from location #1; 40 yards from location #2; 30 yards from
location #3; 20 yards from Iocation#4.We will be bypass pumping around the work
site to prevent turbid water from flowing down stream to other water -bodies.
3. Estimate the amount of fill and dredge material that would be placed in or
removed from surface water or wetlands and indicate the area of the site that
would be affected. Indicate the source of fill material.
We will be removing sand and silt with a backhoe and/or Vactor. We

The City has budgeted $100K for design (2020) and $690K for construction (2021) of improvements along S. 131st
Place to try and deal with this issue. The project includes replacing the culvert under S. 131st Place and will study
and propose improvements to S. 131st Place to reduce the maintenance needed for this stream section. It is
important to note that the stream failure at this location is both a historic problem and one that was significantly
exacerbated with construction of the second Normed Building that further altered the stream path. This area has
always had a historic issue since the stream flows from a steep gradient to this area where the gradient is not
sufficient to allow suspended materials to flow into the Duwamish River. With the development of the Normed
Building, they were required by the City to mitigate for wetland impacts by daylighting, widening, and moving the
stream towards the north. This widening and lengthening of the stream further reduced the stream gradient and
velocity increasing the amount of deposition within the Normed site. Following construction, cattails and other
wetland plants grew within the deposited sediment further slowing the water leading to additional deposition.
The net effect of this project caused the stream channel within the Normed site to rise approximately 2'. With the
downstream gradient raised, significant deposition was observed in the stream along S. 131st Place resulting in
the need for much more frequent cleaning and downstream property flooding.
Most of this issue at this location could have been avoided by not lengthening and widening the stream as part of
the required mitigation for Normed. A confined channel would have increased the stream velocity allowing
sediment to be carried downstream to the Duwamish River avoiding most of the needed City ditching activities. I
mentioned this now so that we can all be cognizant that sometimes our best intentions to make a stream better
for fish has the opposite effect. The partial good news in this situation is that the stream appears to be cutting a
new confined channel within the Normed site and is beginning to down cut. We saw less need for ditching
activities the last several years then we did 5-10 years ago.
I have attached a copy of a report titled "Southgate Creek Sedimentation Assessment" to provide additional
information on this issue.

There are four locations that we have routinely removed sediment from over the last 10+ years and require a
HPA. The past permits have been good for five years at a time and the last one expired in 2017. Location #2, on S
131st PL at 44th PI S., needs to be maintained every summer to prevent the channel from over topping in the fall
and winter and flooding the businesses along 44th PI S. The permit stalled when Karen Walter with
the Muckelshoot Indian Tribe Fisheries Division asked about the downstream culvert size compared to the width
of the streams being maintained (I have copied her email below). The stream at this location is approximately 56"
wide and the culvert is 36" but there may be more to this issue than just an undersized culvert.
Downstream from our maintenance area there is a wetland that is very flat and heavily vegetated. I believe this
may be restricting the flow enough that it is causing excess sand and gravel to settle out in the channel on S. 131st
PL. Also, there may be problems upstream of our maintenance area. The previous Surfacewater Superintendent
told me that the stream is flowing down very steep terrain, causing erosion and depositing that material in the
channel along S 131st PL.
In 2018 I was able to get an expedited HPA good for 1 month so that we could maintain the channel and prevent
any flooding that year. Going forward I believe we need a plan to eliminate the sediment build up in this channel
instead of removing it annually.

concerns we raised.
At location 3, this site is noted to having a highflow bypass facility. As such, this begs the question as to why the stream
needs to be dredged if there is an existing highflow by-pass facility which are usually built to capture flows and sediment with
the sediment being dredged regularly.
We hope the City recognizes that every time gravel is removed from a stream, it affects the quality and quantity of
downstream salmon habitat. Dredging should only be done at a minimum and dredging that degrades salmon habitat should
be mitigated. What will the City do for mitigation?

Hi all,
I wanted to get the conversation going regarding Public Works' ditch maintenance program, which was originally
filed under PL18-0058 as a SEPA review. The maintenance project stalled when it went out for comment as the
tribe has concerns around the impacts to silt (helpful for benthic invertebrates and salmon) and hydrodynamics in
general.
Jeff is looking to get this project going again, but we will need to find a long-term solution to this impasse. These
projects used to occur as maintenance and did not come under a SEPA review, but with recent court rulings and
greater attention brought to these smaller streams they now require SEPA approval beforehand.
Jeff, perhaps you could update everyone on the conversations you've had with each of us?

If location #2's ditch is wider than the downstream pipe, the Tribe may take issue with the idea that the pipe is
too small and may be creating the backup (especially if that means sediment isn't making it to the river as it
should. Is there any mid to long term solution you know of that may help mitigate this issue and satisfy the Tribe's
concerns?

Ryan Larson is looking into this for me.
For the last 3 years location #2 is the only one that has required regular maintenance. The other locations are still
in good condition and I believe the previous Superintendent included them in the 5 year HPA so we could work on
them just in case there was a problem. If I removed locations 1, 3 & 4 from this application, what would it take to
get approval to work on those locations if a problem did arise?

As for mitigation, it has not yet been proven that this work degrades salmon habitat, so no mitigation is currently

Here are my responses to Karen Walter's questions regarding the SEPA permit.
3. We would also like more information for any stream where work is proposed that may have a nearby culvert which could
be affected wood and sediment transport. In other words, please provide the nearby (up and downstream ) culverts and
their dimensions relative to the stream width and contributing area.
At location #1 the upstream culvert has a 36" diameter and is approximately 35' long. The downstream pipe has a
30" diameter and is approximately 60'. The portion of the ditch that we need to maintain between these two
pipes is about 48' long.
At location #2 the upstream culvert is 24" and is approximately 100' long. The downstream pipe has a 36"
diameter and is approximately 100' long. The portion of the ditch that we need to maintain is about 160' long.
At location #3 the upstream culvert has a 36" diameter and is approximately 60' long. The downstream culvert
has a 30" diameter and is about 80' long. There is also a 36" high -flow bypass at the downstream end that that
runs to a catch basin 30' to the north.
At location #4 the upstream culvert has a 48" diameter and comes from the west side of 1-5, about 750'. At this
location we remove debris from a concrete spill way that is only used if the trash rack on the States pipe becomes
blocked. At the east end of this spill way there is about 60' of ditch that we maintain. The only time this area
sees any water is if the States trash rack gets blocked.
4. We would also like to know the status of any previous mitigation work associated with past maintenance actions at the
affected streams.
The only work that has been done at these site is the removal of sediment and gravel as needed to prevent the ditches from
over flowing.

The work we are doing is to maintain the Streams, Ditches and Channels with in
the City of Tukwila. We will be removing sand and silt with a backhoe and/or
Vactor truck and placing it into a 10 yard dump truck. The material will be hauled
to our storage yard and placed into a covered bin where it can dry out. We plan to
remove 20 yards from location #1; 40 yards from location #2; 30 yards from
location #3; 20 yards from location#4.We will be bypass pumping around the work
site to prevent turbid water from flowing down stream to other water -bodies.
3. Estimate the amount of fill and dredge material that would be placed in or
removed from surface water or wetlands and indicate the area of the site that
would be affected. Indicate the source of fill material.
We will be removing sand and silt with a backhoe and/or Vactor. We
plan to remove 20 yards from location #1; 40 yards from location #2;

The City -Wide Stream Channel & Ditch Maintenance Program is intended to provide for a City-
wide program where the City of Tukwila may maintain identified stream channel & ditch
locations to prevent the localized flooding and damage to residential properties, commercial
properties and roadways. The proposed maintenance consists of using a backhoe and a Vactor
Truck to remove accumulated sand and silt from the identified streams ditches and channels.
The work also includes the cleaning of culverts using a high-pressure hose and vacuum system
to clear the accumulated sediment that is responsible for causing localized flooding. This
maintenance will include the cutting and removal of grass and other weeds along the stream,
ditch & channel using weed whackers and other hand type of equipment. Running water with in
the stream, ditch & channels will be diverted around the project sites by the most appropriate
method (screened pump or gravity flow) to prevent downstream turbidity. If any fish are
present we will capture and safely move them from the job site. They will immediately and
safely be transferred to free -flowing water downstream of the project site. The stream, channel
& ditch maintenance will need to be done annually between June 16th and September 30th
