Decision on Substantive Permit: The Community Development Director has determined that the application for a Wireless Telecommunication Facility does comply with applicable City and state code requirements and has approved this application. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING To appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing parry's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition, all hearing examiner costs will be passed through to the appellant. V. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. Surrounding parcels are zoned within the High Density Residential (HDR) and Neighborhood Commercial Center (NCC) zones. This parcel sits adjacent to South 146th Street. Background In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides location and design requirements for the placement of WCF within the City of Tukwila. In 2016 the city adopted amendments to this ordinance in compliance with the Federal Spectrum Act. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co - locations and utilizing existing structures are favored over the development of new standalone WCF within the City. Design Standards The City provides design standards for the placement of WCF within the City of Tukwila. The table below indicates if the applicant's proposal complies with required standards. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. 6. The project also qualifies as an Eligible Facilities Modification under § 6409 of the FCC's Spectrum Act, which requires the City to approve any eligible facilities request for a modification of an existing tower or base station that does not substantially change the physical dimensions of such tower or base station. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type 1 Wireless Telecommunications Facility. Applicable Law In 2012, Congress passed the Middle -Class Tax Relief and Job Creation Act of 2012, 47 U.S.C. § 1455(a). Section 6409(a) of the Act reads in pertinent part: ...a State or local government may not deny, and shall approve, any eligible facilities request for a modification of an existing wireless tower or base station that does not substantially change the physical dimensions of such tower or base station. (emphasis added). On October 17, 2014, the Federal Communications Commission adopted FCC Order 14-153 to help define the "substantially change" language of Section 6409(a). This Order was released to the public on October 21, 2014. It contained the following pertinent section (Section 188) dealing with modifications to approved cell towers: ...a modification substantially changes the physical dimensions of a tower or base station if it meets any of the following criteria: (1) for towers outside of public rights -of -way, it increases the height of the tower by more than 10% or by the height of one additional antenna array with separation from the nearest existing antenna not to exceed twenty feet whichever is greater; for those towers in the rights -of -way and for all base stations, it increases the height of the tower or base station by more than 10% or 10 feet whichever is greater; (2) for towers outside of public rights -of -way, it protrudes from the edge of the tower more than twenty feet, or more than the width of the tower structure at the level of the appurtenance, whichever is greater; for those towers in the rights -of -way and for all base stations, it protrudes from the edge of MD7, LLC 10590 W Or.14,1n A,r Drive' Suitt' 300. Sprint's Proposed Modification Does Not Substantially Change the WCF Sprint proposes to modify the existing WCF by removing the existing 1900 MHz antennas, installing (2) new 800/1900 MHz antennas, (2) new 800 MHz RRUs and (2) new 800 MHz filters, as further detailed and set forth within the previously submitted construction drawings prepared, signed, and sealed on July 24, 2018 by State of Washington professional engineer Christopher J. Warren ("CDs"). As the CDs demonstrate, none of the aforementioned criteria apply to the proposed modification. Specifically, the proposal: (1) Does not increase the height of the WCF; (2) Does not protrude more from the edge of the WCF by more than twenty (20) feet (3) Does not involve installing new equipment cabinets at the site; (4) Does not involve any excavation or deployment outside the site; (5) Is consistent with the currently existing concealment elements of the WCF; and (6) Complies with all associated conditions of prior approval Conclusion Federal law prohibits City of Tukwila from exercising municipal discretionary review of Sprint's Building Permit application because it is an "eligible facilities request" that "does not substantially change" the physical dimensions of the existing WCF. ELIGIBLE FACILITIES MODIFICATIONS If the proposal qualifies for review under Section 6409 of the Spectrum Act please provide information sufficient to determine whether the proposed change constitutes a substantial change or not. If it is not a substantial change then it could be processed expeditiously as required by the Spectrum Act. A substantial change as established by FCC rules is: Substantial Change. A proposed facilities modification will substantially change the physical dimensions of an eligible support structure if it meets any of the following criteria: a. For towers other than towers in the public rights -of -way, it increases the height of the tower by more than 10% or by the height of one additional antenna array with separation from the nearest existing antenna not to exceed 20 feet, whichever is greater; for other eligible support structures, it increases the height of the structure by more than 10% or more than 10 feet, whichever is greater. Changes in height should be measured from the original support structure in cases where deployments are or will be separated horizontally, such as on buildings' rooftops; in other circumstances, changes in height should be measured from the dimensions of the tower or base station, inclusive of originally approved appurtenances and any modifications that were approved prior to the passage of the Spectrum Act. b. For towers other than towers in the public rights -of -way, it involves adding an appurtenance to the body of the tower that would protrude from the edge of the tower more than 20 feet, or more than the width of the tower structure at the level of the appurtenance, whichever is greater; for other eligible support structures, it involves adding an appurtenance to the body of the structure that would protrude from the edge of the structure by more than 6 feet. c. For any eligible support structure, it involves installation of more than the standard number of new equipment cabinets for the technology involved, but not to exceed 4 cabinets; or, for towers in the public rights -of -way and base stations, it involves installation of any new equipment cabinets on the ground if there are no pre-existing ground cabinets associated with the structure, or else involves installation of ground cabinets that are more than 10% larger in height or overall volume than any other ground cabinets associated with the structure. d. For any eligible support structure: (1) it entails any excavation or deployment outside the current site; (2) it would defeat the concealment elements of the eligible support structure; or (3) it does not comply with conditions associated with the siting approval of the construction or modification of the eligible support structure or base station equipment, provided however that this limitation does not apply to any modification that is noncompliant only in a manner that would not exceed the thresholds identified in this section.
