APPLICANT: Maria Laura Musso Escude for WSDOT REQUEST: WSDOT has requested a 20 non-consecutive night temporary Noise Variance for nighttime work to repair and repair a portion of SR 518 in Tukwila. The proposed work involves paving and installing permanent lane markers to preserve the SR 518 roadway. LOCATION: SR 518 in Tukwila, MP 2.64 SEPA Determination This variance decision is categorically exempt from SEPA, WAC 197-11-800 (6) (b). Noise Variance Decision Sounds created by equipment used for public highway maintenance and construction are exempt from the noise code if the properties within five hundred feet of the project are located in commercial or industrial zones. Properties within five hundred feet of this project are located in residential zones as well as commercial and industrial zones so a noise variance is necessary. A Type 1 Noise Variance request is an administrative decision allowed when the maximum permissible sound levels are exceeded for 30 days or less. Notice is the responsibility of the contractor and shall be provided to all residents, including multifamily tenants, within 500' of the source of the south. Notice shall occur between ten and thirty days before the onset of construction activity and shall enumerate the anticipated construction schedule for the length of the project. The applicant has proposed two mitigation measures to limit the impacts from noise. These include: 1. Prohibiting truck tailgate banging. All trucks shall be secured to prevent excessive noise from banging. 2. All trucks performing haul service will have well maintained bed liners as inspected and approved by an engineer. Additionally, public notice was provided by WSDOT and no comments were received. Applicant shall provide notice to all residents within 10 to 30 days of the onset of the work. The Community Development Director has determined that the application complies with applicable City and state code requirements and has approved the request based on the material submitted in the application. The primary reason for conducting nighttime work is to avoid daytime traffic congestion on SR 518 within the jurisdiction of city of Tukwila. Day time full and partial closures along this well -traveled route are expccted to cause disruption in the urban circulation as well as increase travel times for the citizens of Tukwila. Partial closures may impact traffic freight movement, commercial and business traffic during business hours as well as cause delays to school routes and normal road users. Furthermore, data shows that day time closures could increase traffic accidents and compromise the safety of the highway users 7) Mitigating conditions the applicant will implement to minimize the sound level violations. • Truck tailgate banging is prohibited. There are exceptional or extraordinary circumstances or conditions applying to the appellant's property or as to the intended use thereof that do not apply generally to other properties in the same noise control district; The applicant has not other means of the sited on the application to minimize or reduce by mean that resident still are able to continue on with their daily life's without temporary relocation. Such variance is necessary for the preservation and enjoyment of a substantial personal or property right of the appellant, such right being possessed by the owners of other properties in the same noise control district; Temporary nighttime construction is one of the few tools that WSDOT has to lessen traffic congestion and maintain disruption to highway users while improving the roadway. The relocation of this VMS sign will help to provide travelers information of peak hours, travel time and accident information to decide the best options. The residents within 500' will notice s might perceive some noise peaks over the existing SR 518 traffic background noise. The noise levels coming from construction equipment will diminish with distance. A 6-dBA noise level decrease will occur with the doubling of distance from a stationary noise source. 3. The authorization of such variance does not endanger public health or safety of named persons in the same or adjacent noise control districts; State Route SR 518 roadway pavement is needed of repaving to ensure safety for the travel public and maintain the integrety of the state Route. Construction noise mitigation measures are able to address or minimize any inconvenience to the nearby residents so granting this variance would not cause WSDOT to adversely affect the general policy and purpose of the ordinance. 4. The granting of such variance will not adversely affect the general policy and purpose of this act as set forth in TMC Section 8.22.010.
