The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary approval is granted subject to the conditions stated below. There are three basic steps in the boundary line adjustment approval process; (1) Preliminary Approval; (2) Final Approval, and (3) Recording. Instructions for each step are provided below. 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the boundary line adjustment is consistent with the Criteria for Preliminary Approval listed at TMC 17.08.030 (C) in the Tukwila Subdivision Code. Preliminary Approval Conditions Submit a set of recording documents in either legal or record of survey format that meet the King County Recorder's requirements and contain the following items: 11. Revise the email address for the Tukwila Planning Division at the upper left-hand corner on all three sheets of the survey. The correct email address is planning@tukwilawa.gov. V 2. Add file number L18-0092 in space provided at the upper left-hand corner on all three sheets of the survey. .13. Add tax parcel numbers for existing parcels A and B on page 2 of 3 of the survey. 4. Old legal descriptions and Matters of Record refer to Rainier Title LLC & Stewart Title Guarantee Co. Subdiv. Guarantee No. G-6329-000000636, which was not submitted with your BLA application. The 25-foot ingress, egress and utilities easement recorded under file number 7306290088 is within the buffer of a Category III wetland. Any future development or proposed activities within the wetland and its buffer require review and approval of a Type 2 Special Permission permit from the City of Tukwila. APPEALS This boundary line adjustment approval decision may be appealed to the Hearing Examiner. One administrative appeal of the decision on the boundary line adjustment, excluding challenges to the DNS, is permitted. If no valid appeals are filed within the time limit, the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of the Notice of Decision. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition, all hearing examiner costs will be passed through to the appellant. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW Ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. 2. Final Approval The next step is to comply with the conditions of approval and submit the necessary boundary line adjustment documents (survey, legal descriptions, and other required paper work). All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. Expiration The final approved boundary line adjustment must be filed with the King County Department of Records one year from the date of this preliminary approval letter or the application will expire. The City may grant a single one-year extension if requested in writing prior to the expiration date. 3. Recording The signature of the Chairman of the Short Subdivision Committee certifies that your boundary line adjustment application is ready for recording. It is your responsibility to record the City -approved boundary line adjustment documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original boundary line adjustment to King County. The boundary line adjustment is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. In many circumstances, building permits on the properties subject to the boundary line adjustment may not be issued until a copy of the recorded boundary line adjustment (or original) is returned to the Department of Community Development. F. WHEREAS, the Parties attended a mediation on or about November 27, 2017 before the Honorable Charles Burdell (the "Mediation"). G. WHEREAS, Plaintiff and Defendant desire to avoid the expense and risk associated with pursuing their conflicting claims to certain property rights and boundaries between and among the Burns Property and Chaufty Property and have decided to conditionally settle their dispute according to the following terms and conditions. NOW, THEREFORE, in consideration of the mutual covenants contained in this Agreement and for other valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Parties agree as follows: AGREEMENT 1. Recitals. The Parties expressly incorporate the Recitals into this Agreement. As soon as it has been completed and is ready for filing with the City of Tukwila and/or King County as are necessary to effectuate this Agreement, Plaintiff and Defendant agree to execute a Boundary Line Adjustment Application ("BLA Application") which shall adjust the boundaries between the Burns Property and Chaufty Property and further adjust and extend the Easement so as to extend the Easement to the new boundary between the Burns Property and Chaufty Property, as discussed more fully in section 6, below. The form of the BLA Application is attached hereto as Exhibit "1." The form attached hereto is a representation of the agreement between the parties made at the Mediation. Defendant shall be responsible for submitting all necessary documents to the City of Tukwila and/or King County for the BLA Application. Plaintiff agrees to join in and cooperate with Defendant, in good faith, in a request that the City or County approve the BLA Application. Defendant shall be responsible for paying any BLA Application fees and any other fees, deposits and costs associated with the BLA Application. The parties expressly recognize that portions of the Burns Property and Chaufty Property may be subject to the rights of persons not party to this Agreement, including but not limited to, utility easements, ingress and egress rights, etc. Nothing in this Agreement purports to extinguish those rights. 6. The Easement. As provided above, the Parties agree that there exists an Easement of ingress, egress and utilities, of twenty-five feet in width, which runs along the southern and eastern boundary of the Burns Property and benefitting the Chaufty Property. The Parties hereby agree that the Easement shall be modified as follows: 4 —SETTLEMENT AGREEMENT (a) The Easement shall continue from its northern terminus, remaining twenty-five (25) feet in width and continuing to allow a twenty-five foot intersection with the boundary between the Burns Property and Chaufty Property. The estimated location of the continuation of the easement is identified in the draft survey/BLA Application attached hereto as Exhibit "1." (b) Use of the Easement shall be limited to ingress, egress, and utilities. (c) Use of the easement will only be allowed if: (1) the City of Tukwila (or other appropriate governing body) permits the subdivision of the Chaufty Property; (2) the City of Tukwila (or other appropriate governing body) permits construction of a single family residence or other structure allowed by the City of Tukwila (or other appropriate governing body) upon the newly created parcel; and (3) The City of Tukwila (or other appropriate governing body) permits the development of the Easement itself. Should the City of Tukwilla, or other appropriate governing body, not require a permit, inspection, wetland survey, or other applicable process applicable to the development of the Easement, none will be necessary. (d) The shed which is currently located in the Easement area will remain in place until the conditions in paragraph 6(c) are met. If the conditions in paragraph 6(c) are met, Plaintiff shall remove the shed on sixty (60) days' notice from Defendant, or his successors in interest. (e) Prior to any notice of the City of Tukwila (or other appropriate governing body) permitting the subdivision of the Chaufty Property for construction of a single family residence or other structure allowed by the City of Tukwila (or other appropriate governing body), Plaintiff may make reasonable use of the Easement area, such as the placement of a removable swimming pool and/or placement of yard waste. (f) In the event a permit is sought as described in paragraph 6(c), Defendant will notify Plaintiff in writing as required by the applicable code provision or, otherwise, within 30 days of the filing of the permit(s). 7. The Fence Upon the execution of this Agreement and the confirmation of recordation of the BLA Application referenced in section 2, above, Plaintiff may place a fence on the Burns Property marking the boundary between the Burns Property and Chaufty Property. That twenty-five foot portion of the fence that is placed in the Easement area which allows access to the Chaufty Property shall remain in place until the conditions in paragraph 6(c) above are met. If the conditions in paragraph 6(c) are met, Plaintiff, or her successors and assigns, shall remove the 25 feet of fencing that obstructs the easement, and no more, on sixty (60) days' notice from Defendant, or his successors in interest. 5 —SETTLEMENT AGREEMENT 8. Cooperation With Future Applications and/or Permits. Plaintiff, on behalf of herself and her successors in interest, agrees that she will not oppose in bad faith any applications submitted by the Defendant, or his successors in interest, for building permits for the subdivision of the Chaufty Property for construction of a single family residence or other structure allowed by the City of Tukwila (or other appropriate governing body) or for development of the Easement, following approval of the BLA Application. 9. Resolution of the Litigation The Parties agree that final resolution of the claims made in the Litigation are contingent upon the City of Tukwila and/or King County approving the BLA Application. Pursuant to KCLCR 41, the Parties hereby authorize their counsel of record to, concurrently herewith, execute and file, on behalf of the Parties, a Notice of Conditional Settlement and Certificate of Settlement Without Dismissal with the Court in the form attached hereto as Exhibit "2" to this Agreement. The Notice of Conditional Settlement shall inform the Court of the conditions precedent to the effectiveness of this Agreement and the conditions subsequent and necessary to be performed in furtherance of this Agreement. The Parties, in the Notice of Conditional Settlement, shall agree to take the matter off the current trial calendar in furtherance of a focus on the resolution of the Litigation through the performance of the terms of the Agreement as set forth herein. Upon the satisfaction of the conditions listed above, the Parties shall execute and file with the Court a Stipulation and Order of Dismissal of All Claims, substantially in the form attached hereto as Exhibit "3." 10. Mutual Release. Upon the recordation of the BLA Application and the dismissal of the Litigation, Plaintiff hereby, for herself and her successors, heirs, executors, administrators and assigns, releases, acquits and forever discharges Defendant, his directors, officers, employees, attorneys, agents, affiliates, heirs, successors, administrators and assigns, and Defendant hereby releases, acquits and forever discharges Plaintiff, of and from any and all claims, actions, causes of action, demands, rights, damages, costs, loss of service, expenses, and compensation whatsoever which any Party might have because of anything done, omitted to be done, or allowed to be done by the other Party and in any way connected with the Litigation, any prior litigation between Plaintiff and Defendant, the Burns Property, the Chaufty Property or this Agreement (together, the " Subject Matter") as of the date of execution of this Agreement, WHETHER KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN, including, without limitation, any settlement negotiations, any damages and the consequences thereof resulting or to result from the events described, referred to or inferred hereinabove ("Released Matters"). The Parties each agree that this waiver and release is an essential and material term of this Agreement and that the agreements in this paragraph are intended to be in full satisfaction of any alleged injuries or damages in connection with the Released Matters. The Parties each represent and warrant that they have not purported to convey, transfer or assign any right, title or interest in any Released Matter to any other person or entity, and that the foregoing constitutes a full and complete 6 —SETTLEMENT AGREEMENT release of the Released Matters. The Parties each also understand that this release shall apply to all unknown or unanticipated results of the transactions and occurrences described above, as well as those known and anticipated. The Parties each have consulted with legal counsel prior to signing this release, or have had an opportunity to obtain such counsel and knowingly chose not to do so, and execute such release voluntarily, with the intention of fully and finally extinguishing all Released Matters. Notwithstanding the foregoing, the Parties expressly do not release one another from the obligations created by this Agreement. 11. Miscellaneous Provisions. (a) This Agreement shall be construed, interpreted, and enforced in accordance with the substantive laws of the State of Washington without regard to its choice of law principles. (b) Any claims arising out of or related to this Agreement shall be brought in a court of competent jurisdiction sitting in King County, Washington. The state and federal courts sitting in King County, Washington shall have exclusive venue and jurisdiction to resolve disputes regarding this Agreement. (c) The Parties agree that they shall each bear their own attorneys' fees and expenses regarding the Litigation, and they shall not seek an award of attorneys' fees and expenses or costs of litigation against the other Party. (d) If any provision of this Agreement or the application thereof is held invalid or illegal by any court or administrative body, all other provisions of this Agreement shall remain in full force and effect. (e) This Agreement may be signed separately by the Parties in counterparts, each of which shall be deemed an original, and which together will constitute the original Agreement. Facsimile or electronic versions of signatures will have the same force and effect as original signatures, except as required for recordation purposes. (1) This Agreement shall be void against all Parties unless signed by every Party to this Agreement. (g) The Parties agree that this Agreement cannot be modified, amended, or altered in any way except by the written agreement of each Party to this Agreement. (h) Each of the undersigned signatories represents and warrants that they lawfully possess the authority to bind the Party for which they are executing this Agreement. This Agreement is the entire and complete agreement of the Parties regarding the resolution of all claims in the Litigation. This Agreement replaces and supersedes all prior negotiations and agreements between the Parties that are not contained in this Agreement. There are no other agreements or promises between the Parties that have been stated outside this Agreement. The Parties have negotiated this Agreement with the assistance of counsel, and each Party represents that it has had sufficient opportunity to review this agreement.
