This proposal is not considered a substantial change under the Tukwila Municipal Code 18.58.200.7, and falls within the guidelines for an eligible facilities modification. DECISION SEPA Determination: The City SEPA Responsible Official has determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The Community Development Director has determined that the application for a Wireless Telecommunication Facility does comply with applicable City and state code requirements and has approved this application with the following condition: 1. Applicant must apply for a business license to operate the wireless communication facility at this location. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING To appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision. The requirements for such appeals are set forth in Tukwila Municipal Code Ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition, all hearing examiner costs will be passed through to the appellant. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW Ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. The chapter provides location and design requirements for the placement of WCF within the City of Tukwila. In 2016 the city adopted amendments to this ordinance in compliance with the Federal Spectrum Act. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co - locations and utilizing existing structures are favored over the development of new standalone WCF within the City. The table below indicates if the applicant's proposal complies with required standards. As demonstrated in Table 1, the project meets all applicable development standards for a Type 1 WCF. 3. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. 5. The project also qualifies as an Eligible Facilities Modification under § 6409 of the FCC's Spectrum Act, which requires the City to approve any eligible facilities request for a modification of an existing tower or base station that does not substantially change the physical dimensions of such tower or base station. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type 1 Wireless Telecommunications Facility permit with the following conditions: 1. The following shall apply to all wireless communication facilities regardless of the type of facility: 1. Noise — Any facility that requires a generator or other device which will create noise must demonstrate compliance with TMC Chapter 8.22, "Noise". A noise report, prepared by an acoustical engineer, shall be submitted with any application to construct and operate a wireless communication facility that will have a generator or similar device. The City may require that the report be reviewed by a third party expert at the expense of the applicant. Please see the noise report contained within this application package. 2. Signage — Only safety signs or those mandated by other government entities may be located on wireless communication facilities. No other types of signs are permitted on wireless communication facilities. Only WCF specific signs shall be located within the facility. 3. Parking — Any application must demonstrate that there is sufficient space for temporary parking for regular maintenance of the proposed facility. An existing parking lot is located around the building the WCF is located on. 4. Finish — A tower shall either maintain a galvanized steel finish or, subject to any applicable standards of the FAA or FCC, be painted a neutral color so as to reduce its visual obtrusiveness. The equipment shall be painted to match existing standards. 5. Design — The design of all buildings and ancillary structures shall use materials, colors, textures, screening and landscaping that will blend the tower facilities with the natural setting and built environment. The site's design shall not change. Please see previously approved permit from 2017 contained within this package. 6. Color — All antennas and ancillary facilities located on buildings or structures other than towers shall be of a neutral color that is identical to or closely compatible with the color of the supporting structure so as to make the antenna and ancillary facilities as visually unobtrusive as possible. All new T-Mobile Antenna Equipment shall be painted to match the existing building. 7. Lighting — Towers shall not be artificially lighted unless required by the FAA, FCC or other applicable authority. If lighting is required, the reviewing authority shall review the lighting alternatives and approve the design that would cause the least disturbance to the surrounding areas. No strobe lighting of any type is permitted on any tower. N/A 8. Equipment Enclosure — Each applicant shall be limited to an equipment enclosure of 360 square feet at each site. However, this restriction shall not apply to enclosures located within an existing commercial, industrial, residential or institutional building or eligible facilities modifications. T-Mobile's existing equipment area shall not change. 18.58.110 Non -concealed Building Mounted Development Requirements. The following requirements shall apply: 1. Height — The proposed facility must meet the height requirements of the applicable zoning category. If the building where the facility is located is at or above the maximum height requirements, the antennas are permitted to extend a maximum of 3 feet above the existing roof line. Non - concealed building mounted facilities shall not qualify as "Rooftop Appurtenances" under TMC 18.50.080. The height of the equipment shall not change. 2. Antenna aesthetics — The first preference for any proposed facility is to utilize flush -mounted antennas. Non flush -mounted antennas may be used when their visual impact will be negated by the scale of the antennas to the building. "Shrouds" are not required unless they provide a better visual appearance than exposed antennas. Antennas shall be painted to match the color scheme of the building(s). Antennas shall be painted to match the color scheme of the buildings. 3. Feed lines and coaxial cables — Feed lines and cables should be located below the parapet of the rooftop. If the feed lines and cables must be visible, they must be painted to match the color scheme of the building(s). Existing cable location shall not be changed. Please see previously approved permit from 2017 contained within this package. 4. Cabinet equipment — If cabinet equipment cannot be located within the building where the wireless communication facilities will be located, then it must be located on the rooftop of the building. If the equipment can be screened by placing the equipment below the parapet walls, no additional screening is required. If screening is required, then the proposed screening must be consistent with the existing building in terms of color, style, architectural style and material. If the cabinet equipment is to be located on the ground, the equipment must be fenced with a 6-foot-tall fence and materials shall be used to screen the equipment from view. Barbed wire may be used in the TVS, Ll, HI, MIC/L, and MIC/H zones. Per the definitions set forth under section 18.58.200 (and section "6409"), the proposed modifications shall not be considered as "substantial change". Please see the determination below: Per Section "6409" § 1.40001 Wireless Facility Modifications: (4)Eligible support structure. Any tower or base station as defined in this section, provided that it is existing at the time the relevant application is filed with the State or local government under this section. (7)Substantial change. A modification substantially changes the physical dimensions of an eligible support structure if it meets any of the following criteria: (i) For towers other than towers in the public rights -of -way, it increases the height of the tower by more than 10% or by the height of one additional antenna array with separation from the nearest existing antenna not to exceed twenty feet, whichever is greater; for other eligible support structures, it increases the height of the structure by more than 10% or more than ten feet, whichever is greater; The height of the proposed antenna equipment shall not exceed the allotted 10% height limit. (ii) For towers other than towers in the public rights -of -way, it involves adding an appurtenance to the body of the tower that would protrude from the edge of the tower more than twenty feet, or more than the width of the tower structure at the level of the appurtenance, whichever is greater; for other eligible support structures, it involves adding an appurtenance to the body of the structure that would protrude from the edge of the structure by more than six feet; Appurtenance protrusion shall not extend greater than 20 feet from the existing structure. This noise survey extends from the proposed equipment to the nearest properties. The purpose of this report is to document the existing conditions and the impacts of the acoustical changes due to the proposed equipment. This report contains data on the existing and predicted noise environments, impact criteria and an evaluation of the predicted sound levels as they relate to the criteria. Ambient Conditions Existing ambient noise levels were measured on site with a Svantek 971 sound level meter on October 11, 2018. Measurements were conducted as close to the proposed location as possible and the property lines in accordance with the State of Washington code for Maximum Environmental Noise Levels WAC 173-60-020. The average ambient noise level was 62.4 dBA, due primarily to local traffic. Code Requirements The site is located within the City of Tukwila zoning jurisdiction on property with an 0 zoning designation. The nearest receiving properties, to the south, are zoned RCM. Tukwila Municipal Code 8.22.020 defines both 0 and RCM as within Commercial districts. The proposed new equipment consists of equipment support cabinets, which are expected to run 24 hours a day. Under Tukwila Municipal Code 8.22.040 noise from equipment on a within a Commercial district is limited as follows: Commercial District Receiver: Noise is limited to 60 dBA 24 hours a day.
