II. DECISION
SEPA Determination: Exempt from SEPA, per TMC 18.21.04.110.A.3 exempting office and commercial
buildings up to 12,000 square feet in size.
Decision on Substantive Permit: The Community Development Director has determined that the special
permission application does comply with applicable City and state code requirements and has approved a
minimum of 9 vehicle parking stalls and 2 bicycle stalls for Fire Station 51.
III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code
§ 18.104.010. Other land use applications related to this project may still be pending.

No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Hearing
Examiner of the Decision on the Permit itself is permitted.
A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King
County Superior Court from the Hearing Examiner decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director's decision on the Permit Application, a written
notice of appeal must be filed with the Department of Community Development within 14-days of the
issuance of this Decision, that is by December 20, 2018.
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials
shall be submitted to the Department of Community Development. Appeal materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation,
association or other group, the address and phone number of a contact person authorized to receive
notices on the appealing parry's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including
any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief
sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing
examiner costs will be passed through to the appellant.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the
Hearing Examiner based on the testimony and documentary evidence presented at the open record
hearing. The Hearing Examiner decision on the appeal is the City's final decision.
Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS,
an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner decision is
properly filed in Superior Court within such time limit, the Decision on this permit will be final.
The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending
permit applications for the development of the subject property.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are
available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd.,
Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The

FINDINGS
Project Description
The City is relocating Fire Station #51 from Andover Park East to 17951 Southcenter Parkway, King
County Parcels # 3523049008 and 3523049040. The new station will be located on a 5.67-acre site
that is currently vacant. The proposed Fire Station is a structure of approximately 11,240 square feet in
6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • Phone 206-431-3670 • Fax: 206-431-3665
size that includes living quarters and support spaces, gear storage, training room, station offices, an
apparatus bay, and other associated spaces for the Fire Department. The building will be used for 3-7
on -duty personnel, as well occasional use by the public, meetings by other City employees, or other
irregular business activities. The building is not proposed to be used for large meetings or events.
Currently, Fire Station #51 is used as the headquarters for the City's Fire Department, however, the
headquarter functions will move to the relocated Fire Station #52 located at City Hall. The proposed
design for the fire station shows 12 secure parking spaces in the rear of the building (staff parking),
and 4 parking spaces in the front of the building (public parking), for a total of 16 parking spaces.
Request
The applicant is requesting a special determination for required off-street parking for the proposed
relocated Fire Station #51.
The Off-street Parking Regulations Chapter of the City's Zoning Code (TMC 18.56) specifies that a
required number of parking and bicycle spaces must be provided for all uses (Required Number of
Parking Spaces - TMC 18.56.050). The Purpose section of the Chapter states that the regulations are
to "provide for adequate, convenient, and safe off-street parking and loading areas for the different
land uses". When those uses are not specified, the Director of Community Development must specify
the requirements of the off-street parking facilities. Further, the determination shall be based upon the
requirement for the most comparable use specified in the Off -Street Parking Chapter of the Zoning
Code (Uses Not Specified — TMC 18.56.100.)
ANALYSIS
Vehicle Parking Spaces
As stated above, the requirements for off-street parking must be determined based upon the most
comparable use specified in the Off -Street Parking Chapter of the Zoning Code (Uses Not Specified —
TMC 18.56.100.). This section provides an analysis of parking requirements for comparable uses, as
well as an analysis of the ITE parking manual, comparable fire stations, and other nearby jurisdictions.
The proposed station will be subject to the City's Commute Trip Reduction (CTR) program. The City
provides incentives to encourage its employees to walk, bike, carpool and take transit, which is
intended to reduce the vehicle trip generation and therefore the parking demand. However, this was not
included in this parking analysis.
Comparable Uses:
Much of the building space is used for sleeping bunks and bathrooms for fire personnel. The building
is not a typical office setting but includes some office space for use by on -shift fire fighters. The
building is not intended for public assembly or frequent public use. The space may occasionally be
used by the public for blood pressure tests, or meetings with other government employees. Other
spaces in the building include physical training space, gear storage, kitchen, and a shop. The overall
building is 11,240 sq. ft. (7,745 if excluding the apparatus bay). The floor plan (attachment D) and area
summary (Attachment E) depict a breakdown of the building by individual rooms.

Based on Figure 18-7 Required Number of Parking Spaces for Automobiles and Bicycles of the
Tukwila Municipal Code, no listed uses are directly interchangeable to the Fire Station use. The most
comparable uses that are listed in the parking table are hospitals and office use.
Hospital was chosen as a comparable use because the parking demand for this fire station is dependent
on the available beds on site, similar to a hospital. While the fire station includes ancillary spaces, such
as a gym, vehicle bays, and storage, the primary driver for parking demand will be the living quarters,
as the number of available beds is consistent with the maximum number of on -duty personnel at a
given time. The applicant stated that all shift personnel are on 48-hour shifts, and there will no
additional staff working shifts during the day. The applicant expects up to 6 staff members at a time in
the future, and as such the building will provide 6 beds. Table 18-7 requires hospitals to provide 1
parking space for each bed; the fire station provides 6 beds and would require 6 parking stalls using
this standard.
Aside from on -site fire personnel using beds, there may be additional parking demand at the fire
station that should be accounted for. While the applicant stated that the office space is intended to be
used for on -site personnel, it is possible that it will be used for the occasional meeting with the public
or other City employees. For office uses, Table 18-7 requires 3 parking spaces per 1,000 square feet of
usable floor area. The floor plan of the station shows 845 sq. ft. of total office space, which would
amount to 3 required spaces.
The applicant stated that some public visitors may be anticipated for reasons such as blood pressure
checks, or meetings with other city employees. However, a letter provided by the applicant
(Attachment B) stated that on -duty firefighters observed an average of only approximately four public
visits per week, requiring very little additional parking.
Using Hospital and Office as comparable uses, the parking demand can be summarized as follows:

ITE Manual:
Staff consulted the ITE Parking Generation Manual, 4th Edition, for a usable parking standard.
However, the ITE Manual does not include Fire Station as a land use. Again, staff used the most
comparable land use for analysis, which was Government Office Building. During peak periods, the
parking demand for this use is 0.88 vehicles per employee. The proposed Fire Station #51 will have a
maximum number of 7 employees at a given time, which would result in a demand for 7 parking
spaces.
Comparable Fire Stations and Nearby Jurisdictions:
While the comparable uses provide a metric for anticipated parking demand, it may not perfectly apply

for the specific parking demands required by a Fire Station. To draw comparison, the applicant
provided an analysis of parking at existing fire stations compared to the proposed Fire Station #51.

The chart above shows that the proposed station #51 provides more total stalls than three other stations
in the City. In addition, the ratio of stalls to maximum number of personnel for the proposed Station
#51 is 2.3, which is greater than the other examples, which are 0.7, 1.6, and 0.4, respectively.
Staff also researched other local jurisdictions' parking requirements for a comparable fire station
parking standard. Most cities do not specify a standard for fire stations and defer to a similar process as
the City of Tukwila. For example, the cities of Kent, Burien, Newcastle, Renton, Des Moines, Fife,
Maple Valley, Sammamish, and Auburn, do not specify a standard and determine parking standards on
a case -by -case basis. Other cities include comparable parking standards as follows:

The comparison to parking standards from SeaTac and Issaquah show that the parking demand for
proposed Fire Station 51 would be 16-26 spaces. The proposed station would have few employees and
provide limited functions, so can be assumed that the parking demand may be less than other fire
stations (such as a headquarters).
Bicycle Parking
The City of Tukwila requires bicycle parking stalls based on the use and number of parking stalls. For
both the Hospital and Office land uses, 1 bicycle space per 50 parking stalls is required, with a
minimum of 2 spaces. Because the fire station has less than 50 parking stalls, 2 bicycles spaces are
required.

CONCLUSIONS
1. The site plan (Attachment C) for Fire Station 51 shows that 16 parking stalls will be provided
on the site; 12 secured stalls in the west and north portion of the site (staff parking), and 4 stalls
in the front of the building (public parking). In addition, an unofficial parking location on the
back apron can be used during a major event or emergency.
2. Staff reviewed four methods of determining the parking demand at the proposed station:
comparable uses, the ITE Parking Generation manual, a comparison of other jurisdictions
parking requirements, and a comparison of parking provided at other fire stations in the city.
3. The analysis of comparable uses shows that a minimum of 9 spaces should be required at Fire
Station 51. Using the ITE Parking Generation Manual, 7 spaces would be required. Using
standards from other jurisdictions would require a range of 16-26 required spaces. Lastly, a
comparison to other Tukwila fire stations shows 5 to 13 spaces; less than the proposed facility.
4. Based on this evaluation, the parking standard for comparable uses (9 spaces) should be used to
determine the minimum number of parking spaces for Fire Station 51. Hospital is an
appropriate comparable use because the parking demand for this fire station is dependent on the
available beds on site, similar to a hospital. Additional parking demand at the fire station may
be generated by the on -site office space. While it is intended to be used for on -site personnel, it
is possible that it will be used for the occasional meeting with the public or other City
employees. By providing 16 vehicle spaces, the proposal would meet a required minimum of 9
vehicle spaces. Given that the building will be staffed by 3-7 on -duty personnel and there will
be minimal use by the general public, 16-26 spaces (using the standards of other jurisdictions)
would be more than required for this station.
RECOMMENDATION
Staff recommends that the Director require a minimum of 9 vehicle parking stalls and 2 bicycle stalls
for Fire Station 51.

Dear Jack:
Pursuant to Tukwila Municipal Code (TMC) 18.56.100 the City of Tukwila (City) is requesting a
determination for the required number of parking stalls for the City's relocated Fire Station #51
to Tukwila South, to be located at S. 180th Street and Southcenter Parkway. The facility has
unique operational functions that are not outlined in Figure 18-7 of the TMC.
In 2016, Tukwila voters approved Proposition #1, a bond measure, which will make significant
investment in public safety infrastructure within the City. As part of the public safety
improvements, the City is relocating Fire Station #51 from Andover Park East to the new
location in Tukwila South. The new location will provide superior emergency access within the
Southcenter and Tukwila Valley South areas, as well as prepare the City for the expected
growth in the emerging Tukwila South neighborhood.
Fire Station #51 currently is the headquarters for the City's Fire Department. The headquarters
functions will move to the relocated Fire Station #52 on the City Hall campus. For the required
parking for new Fire Station #51 Mayor's Office staff and the Fire Chief reviewed the parking
demand at stations the existing fire stations #52, #53, and #54.

used on a daily
basis).
Attached is a draft site map showing proposed Fire Station #51. On duty fire personnel will be able to
park their private vehicles in the rear of the building in the secure area. These stalls allow for
sufficient parking for overlap during shift change. Four public parking stalls will be provided in the
front of the building. These parking stalls would be used for the public for visits for blood pressure
checks, meetings by other City employees, or other irregular business activities at the fire house. It is
important to note that this fire station will not have large meetings or public gatherings. No publicly -
accessible meeting rooms are included in the design.
Public visitors are expected for blood pressure checks, though the location of this facility will not
attract as many visitors as stations located in neighborhoods. From the observations of on -duty
firefighters, these average approximately four per week, and the proposed number of public parking
stalls are more than sufficient to meet this demand.
It is important that the City not add parking that would not be unnecessary and only used for an
occasional event that would trigger a higher parking demand. Unofficial parking on the back apron
during a major event is available in the rear of the building. This would only be contemplated for a
major emergency mobilization.
In conclusion, the Mayor's Office and Fire Department recommend that new Fire Station #51 should
have at least eight parking stalls to accommodate shift changes and a visiting command vehicle, as
well as other parking demand throughout the day. As you can see, the site is proposed to have 16
total parking stalls, which allows for public parking but above what is needed for the fire station.

SEPA Exemption
Dear Ms. Bianchi:
The purpose of this letter is to confirm exemption under the State Environmental Policy Act (SEPA) for
the need to submit a SEPA checklist to the City.
The City of Tukwila (City) is proposing to construct an 11,240 square foot fire station at 17951
Southcenter Parkway (King County Parcel #352304-9008). Cut and fill for the project is proposed to be
less than 500 cubic yards. Pursuant to Tukwila Municipal Code 21.04.110, the project is exempt from
SEPA because the square footage of the building is less than 12,000 square feet and the estimate cut
fill is less than 500 cubic yards.
It should also be noted that in July of 2005 the City issued a FINAL Environmental Impact Statement
(EIS) for the Tukwila South Project. As part of the EIS the City did consider the future construction of 14
million square feet of retail, residential, industrial, and office in the Tukwila South area (where the
proposed Fire Station 51 is located). Even if the Fire Station was above the categorical exemptions
outlined above, the project would have already complied with SEPA.

II. DECISION
SEPA Determination: The SEPA Responsible Official has previously determined thatthe project, as proposed, does not
create a probable significant environmental impact and issued a Determination of Non -Significance on May 9, 2017.

III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code
§18.104.010. Other land use applications related to this project may still be pending.
No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Hearing
Examiner of the Decision on the Permit itself is permitted.
A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King
County Superior Court from the Hearing Examiner decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director's decision on the Permit Application, a written
notice of appeal must be filed with the Department of Community Development within 14-days of the
issuance of this Decision; that is, by September 28, 2017.
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials
shall be submitted to the Department of Community Development. Appeal materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a
corporation, association or other group, the address and phone number of a contact person
authorized to receive notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision,
including any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the
relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of
Appeal.
5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition, all
hearing examiner costs will be passed through to the appellant.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the
Hearing Examiner based on the testimony and documentary evidence presented at the open record
hearing. The Hearing Examiner decision on the appeal is the City's final decision.
Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an
MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner decision is

decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit
applications for the development of the subject property.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits
are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter

FINDINGS
PROJECT DESCRIPTION
The applicant is requesting Special Permission Director Review approval to reduce the width of the buffers
surrounding two Class IV wetlands on a 5.6 acre site by 50 percent, from 50 feet to 25 feet, in order to construct
a new fire station approximately 11,240 square feet in size for the City of Tukwila. Earth removal, grading, and
construction of the parking lot will occur within the 50-foot buffer surrounding the wetlands, and temporary
impacts from minor grading will occur within the outer portion of the proposed 25-foot wetland buffer during
construction. A buffer enhancement plan, including restoration and replanting, is proposed in compliance with
the City's Environmentally Sensitive Areas regulations (TMC 18.45). Mitigation monitoring will be required for a
five-year period.

The City is relocating Fire Station #51 from Andover Park East to 17951 Southcenter Parkway.
A new fire station is proposed to be constructed on two parcels situated west of Southcenter Parkway and east
of S. 184th Place. The parcels are undeveloped and approximately 5.7 acres in combined area. A stormwater
detention pond (approximately 100,000 square feet in size) is adjacent to the southern boundary of the site,
residential development is located to the west of the site at the top of a large, steep hill, and commercial
development is located to the north.
The proposed project includes parking areasforvisitors and employees, an access driveway, an outdoor
generator and solid waste collection area, and stormwater infrastructure (see Attachment B). The facility will be
surrounded by fencing and perimeter landscaping.

The wetland delineation memo prepared by ESA (Attachment A) confirms the presence of two Category IV
wetlands in the western part of the parcel (see Figure 2). TMC 18.45.080 describes Category IV wetlands as
having the lowest levels of functions and are often heavily disturbed, but still requiring protection. TMC
18.45.080.D requires 50-foot wide buffers for Category IV wetlands. Combined together, the total wetland area
is 7,173 square feet in size. Portions ofthe proposed driveway and parking area will intrude into the 50-foot
buffer of the Category IV wetlands. Consequently, the applicant has applied fora Type 2 Special Permission from the
Director to reduce the required buffer widths for the wetlands in some areas by 50 percent, from 50 feet to 25 feet,
in accordance with TMC 18.45.080.F (see Attachment C, Sheet W002).

The applicant proposes wetland buffer enhancement actions consistent with TMC 18.45.080.F including planting
of native species as mitigation for the buffer reductions. A portion of the wetland buffer is proposed to be
reduced to less than 25 feet. To maintain the 25-foot buffer, the applicant has designated portions of the
wetland area as wetland buffer (approximately 422 square feet identified as "paper fill" area on Attachment C,
Sheet W002). To mitigate this impact, the applicant proposes additional enhancements to approximately 1,825
square feet of the adjacent wetland (Attachment C, Sheet W002 & W003). The buffer mitigation and restoration
plan has been prepared for the project and submitted with the application materials in accordance with TMC
18.45.

DECISION CRITERIA
The following section of the report provides an overview of project consistency with applicable criteria in TMC
18.45.
TMC 18.45.080.F for variation of standard buffer widths:
1. The Director may reduce the standard wetland buffer only where buffer conditions are currently degraded
(due to existing development within the prescribed buffer width, the presence of significant amount of
invasive vegetation that impairs buffer function, and/or lack of native vegetation) on a case -by -case basis,
provided the remaining buffer is enhanced and the buffer does not contain slopes 15% or greater.
2. Buffer reduction with enhancement may be allowed by the Director as a Type 2 permit with an approved
buffer enhancement plan prepared by a qualified wetland biologist, if:
a. Additional protection to wetlands will be provided through the implementation of a buffer
enhancement plan;
b. The existing condition of the buffer is degraded; and
c. Buffer enhancement includes, but is not limited to:
1) Planting vegetation that would increase value for fish and wildlife or improve water quality or
hydrology;
2) Enhancement of wildlife habitat by incorporating structures that are likely to be used by wildlife
3) Removing non-native plant species and noxious weeds from the buffer area and replanting the
area subject to 2.c.1 above.
The buffer is currently in a degraded condition. Signs of prior grading and disturbance were observed in the
study area. Vegetation is composed primarily of herbaceous species with small patches of scrub -shrub
vegetation. In addition, some scrub -shrub vegetation exhibit stunted growth. The project adequately complies
with the criteria for varying the standard buffer width. The applicant has provided an adequate buffer
enhancement plan. Proposed enhancements include planting vegetation that would improve buffer functions
and wildlife habitat and removing non-native invasive species. Plantings include an adequate mix of native trees,
shrubs and groundcover. Irrigation will be provided during the first three years while the plantings become
established.
TMC 18.45.090 Wetland Uses, Alterations, and Mitigation:
TMC 18.45.090.A Use or Development. Any use or development allowed is subject to review and approval by the
Director.
No use or development will occur within the wetland. A fire station and supporting infrastructure are permitted
uses in the ISO zoning district.
TMC 18.45.090.8.4. Alterations. Alterations to Category IV wetlands are allowed, only where unavoidable and
adequate mitigation is carried out in accordance with the standards of TMC Section 18.45.090.
The proposed project adequately meets these criteria. The proposed work within the wetland will not have an
adverse effect on water quality , fish and wildlife, drainage and/or storm water detention capabilities, or other
sensitive areas. The proposal will also not lead to unstable earth conditions, create an erosion hazard, or
contribute to scouring actions.
TMC 18.45.090.C. Mitigation Sequencing —Applicants shall demonstrate that reasonable efforts have been
examined with the intent to avoid and minimize impacts to wetlands and wetland buffers. When an alteration of
a wetland or its required buffer is proposed, such alteration shall be avoided, minimized or compensated for in
the following order of preference:

1. Avoiding the impact altogether by not taking a certain action or parts of an action;
2. Minimizing wetland and wetland buffer impacts by limiting the degree or magnitude of the action and its
implementation, by using appropriate technology, or
3. Rectifying the impact by repairing, rehabilitating, or restoring the affected environment.
4. Reducing or eliminating the impact over time by preservation and maintenance operations during the life of
the action;
5. Compensating for the impact by replacing, enhancing, or providing substitute resources or environments;
and/or,
6. Monitoring the impact and taking appropriate corrective measures.
The applicant has demonstrated that reasonable efforts were made to follow mitigation sequencing
requirements of TMC 18.45.090.C.
TMC 18.45.090.D Wetland Mitigation Plan Content
TMC 18.45.090.E states that a mitigation or enhancement plan must be developed and must comply with the
standards of mitigation required in TMC Chapter 18.45. Detailed site plans for existing conditions, buffer
modifications, buffer enhancement, and planting details for this project have been prepared by The Watershed
Company and included in the building permit plan set for Fire Station 51 (Permit #D18-0321, See Attachment C
for plan set). The mitigation plan within the 25-foot buffer area includes removal of invasive weeds and adding
topsoil, compost, and woodchip mulch to improve the soil prior to planting. Within the wetland enhancement
area, invasive plants will be removed and woodchip mulch added to the soil prior to planting. The City's Urban
Environmentalist agrees with the proposed plant species and quantity of the proposed mitigation plantings
which include a mix of native trees, shrubs and groundcover. The applicant proposed detailed construction
sequence and installation details for shrubs, seedlings and bare root plants.
The plan set also includes performance standards, a maintenance plan, and a 5-year monitoring program and
contingency plan identifying potential courses of action and any corrective measures to be taken to provide for
survival and replacement of any plantings during a 5-year establishment period as required by TMC
18.45.090.D.e & f (see Attachment C, Sheet W006).
TMC 18.45.090.E Mitigation Standards. Mitigation for alteration to a Category IV wetland will be 1:5:1 for
creation or re-establishment, 3:1 for rehabilitation or 6:1 for enhancement.
The proposed work proposes to rehabilitate 1,825 square feet of wetland for appropriating 422 square feet of
adjacent area as wetland buffer - more than required by the 3:1 ratio.
CONCLUSIONS
1. The proposed use of the site as a fire station and wetland buffer enhancement site are permitted uses in the
ISO zoning district.
2. The wetlands are classified as Category IV wetlands requiring a 50-foot wide buffer.
3. The proposal meets the criteria for approval of a variation to the standard wetland buffer width and buffer
enhancement is proposed to mitigate for the request for a 50% reduction in buffer width. Buffer
enhancement will include removal of invasive weeds, soil improvements and the addition of native
vegetation.
4. The existing condition of the wetland buffer is degraded, and the proposed work will improve wildlife
habitat through the removal of invasive species within the 25-foot wetland buffer and wetland
enhancement areas.

5. The proposed work within the wetland will not have an adverse effect on water quality , fish and wildlife,
drainage and/or storm water detention capabilities, or other sensitive areas. The proposal will also not lead
to unstable earth conditions, create an erosion hazard, or contribute to scouring actions. Adequate
mitigation is provided in accordance with TMC 18.45.090.
6. The applicant has demonstrated that reasonable efforts were made to follow mitigation sequencing
requirements.
7. The project includes performance standards and a 5-year mitigation monitoring and maintenance plan
consistent with TMC 18.45.090.D.
RECOMMENDATION
Staff recommends approval of the Special Permission permit to reduce wetland buffer widths.
INFORMATION
The City prefers mechanical weed control methods in the wetland and wetland buffer, and herbicide will only be
used if deemed absolutely necessary. Herbicide use is permitted only with prior approval by the City's Urban
Environmentalist. Dates, products, rates, and certified applicant information will be required prior to use.

This memorandum summarizes the results of a wetland delineation conducted, at the City of Tukwila's request,
for the proposed Tukwila Fire Station 51 Project (project). An earlier wetland reconnaissance was conducted on
the site by The Watershed Company (TWC). The project is proposed on two parcels (3523049008 and
3523049040) located in the City of Tukwila (City) and situated west of Southcenter Parkway and east of S 184`'
Place (Figure 1). The parcels (study area) are undeveloped and approximately 5.7 acres in combined area.
The findings of the wetland delineation are based on an analysis of existing background information, a field
investigation conducted by Environmental Science Associates (ESA) biologists Teresa Vanderburg, PWS, and
Christina Hersum on February 215t, 2019, and a review of the current City of Tukwila Municipal Code (TMC)
Chapter 18.45 Environmentally Sensitive Areas.
ESA identified and delineated two wetlands in the study area. Wetland boundaries were recorded using a Global
Positioning System (GPS device). The wetland boundaries depicted on the attached map are approximate.
Methods
Methods defined in Regional Supplements to the U.S. Army Corps of Engineers 1987 Wetlands Delineation
Manual (Corps, 2010) were used to determine the presence and extent of wetlands in the study area. The
methodology is based upon three essential characteristics of wetlands: (1) hydrophytic vegetation; (2) hydric
soils; and (3) wetland hydrology. Field indicators of these three characteristics must all be present in order to
determine that an area is a wetland (unless problem areas or atypical situations are encountered).
The "routine on -site determination method" was used to determine the wetland boundaries. The routine method is
used for areas equal to or less than 5 acres in size, or for larger areas with relatively homogeneous vegetative, soil,
and hydrologic properties.
Formal data plots were established where information regarding each of the three wetland parameters (vegetation,
soils, and hydrology) was recorded. This information was used to distinguish wetlands from non -wetlands.

Background Review
Prior to our field investigation, ESA reviewed the following background materials for information pertaining to
the subject parcels:
• City of Tukwila iMap (City of Tukwila, 2019);
• City of Tukwila Sensitive Areas Map (City of Tukwila, 2016);
• King County iMap (King County, 2019);
• National Wetlands Inventory (NWI) Mapper (U.S. Fish and Wildlife Service [USFWS], 2019);
• U.S. Department of Agriculture (USDA) Natural Resources Conservation Service (NRCS) Web Soil
Survey of project area (NRCS, 2019);
• Washington Department of Fish and Wildlife (WDFW) Priority Habitat and Species (PHS) database
(WDFW, 2019);
• Google Earth aerial imagery dated 2010 through 2018; and
• Tukwila Fire Station 51, Wetland Reconnaissance Report (prepared by TWC and dated October 12, 2018)
The study area is located within the City of Tukwila, King County, Washington and lies within Section 35,
Township 23 North, and Range 4 East; and Water Resources Inventory Area (WRIA) 9 the Duwamish-Green
River basin. A stormwater detention pond (approximately 100,000 square feet size) borders the southern study
area. Southcenter Parkway borders the eastern study area, residential and commercial development border the
remaining portions of the study area with the exception of a small patch of deciduous forest that borders a portion
of the northwest study area.
No wetlands are identified in the study area by the City's iMap or Sensitive Areas Map, or by King County iMap,
NWI mapper, or WDFW PHS database. According to historical aerial imagery available on King County iMap, a
majority of the study area was previously forested and contained a road (an extension of S 180'h Street) that
bisected the southern parcel of the study area (2019). Based on the historical aerial imagery, the road as well as
the vegetation in the study area were removed as part of an excavation project from 2013 to 2014 (King County,
2019).
Field Investigation
Signs of prior grading and disturbance were observed in the study area. According to historical images on Google
Earth, this site was extensively graded in 2014 and 2015 during road construction and interchange work to
relocate South 180'h Street. Within the western portion of the study area, steep slopes are present that drop to the
east before abruptly flattening out. This steep slope appears to be a cut into the valley wall during earthwork. The
majority of the study area is generally flat with a few shallow depressions. Soils are loamy sand in some areas but
are underlain by primarily clay hardpan.
Vegetation in the study area is composed primarily of herbaceous species with small patches of scrub -shrub
vegetation. Several bare areas of vegetation are also present. Upland herbaceous areas consist of bentgrass
(Agrostis sp.) and hairy cat's ear (Hypochaeris radicata); wetland herbaceous areas consist of common cattail
(Typha latifolia), small -fruited bulrush (Scirpus microcarpus), toad rush (Juncus bufonsis), and tapered rush
(Juncus acuminatus). Patches of scrub -shrub vegetation in the study area are primarily located within wetland

areas and include black cottonwood (Populus balsamiifera), and willow (Salix sp.). In addition, some scrub -shrub
vegetation within the wetland exhibit stunted growth. See attached photographs (Photos 1 through 7).
ESA biologists confirmed the presence of two marginal wetlands in the study area (2018). The general
characteristics, wetland rating category, and required standard wetland buffer widths are summarized in the
following table:

Effective, January 1, 2015, Ecology requires the use of the 2014 Wetland Rating System for Western Washington (Ecology Publication #14-06-029)
for any projects needing Corps or Ecology authorization. ESA rated wetlands in the study area using the 2006 and 2014 wetland rating systems and
determined that both resulted in the same wetland categories (see attached 2014 wetland rating forms).

Regulatory Considerations
Wetlands are regulated at the federal, state, and local levels. Agencies with jurisdiction include the U.S. Army
Corps of Engineers (Corps), Washington State Department of Ecology (Ecology), and City of Tukwila. In this
case, the degraded wetlands identified on site have formed on fill soils after major earthwork, excavation and
construction activity in the area. In our professional opinion, although these areas meet the three parameters for
wetland, they are likely exempt from the definition of "waters of the U.S." in the Clean Water Act.
According to 40 CFR 122.2 (Definitions) the following features are not considered "waters of the U.S."
(E) Water -filled depressions created in dry land incidental to mining or construction activity, including pits
excavated for obtaining fill, sand, or gravel that fill with water.
Since these degraded wetland areas are definitely "water filled depressions created in dry land incidental to
mining or construction activity," we do not believe the Corps of Engineers or Ecology would consider these areas
jurisdictional wetlands under Section 404/401 of the Clean Water Act.
Some smaller, degraded wetlands may be exempt from regulations at the state or city level. These areas are either
considered low value or, in some cases, may not meet the state definition of wetlands according to the Growth
Management Act (GMA). According to the definitions in the GMA (RCW 36.70A.030):
"Wetland" or "wetlands" means areas that are inundated or saturated by surface water or groundwater at
a frequency and duration sufficient to support, and that under normal circumstances do support, a
prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally
include swamps, marshes, bogs, and similar areas. Wetlands do not include those artificial wetlands
intentionally created from non -wetland sites, including, but not limited to, irrigation and drainage

ditches, grass -lined swales, canals, detention facilities, wastewater treatment facilities, farm ponds, and
landscape amenities, or those wetlands created after July 1, 1990, that were unintentionally created as a
result of the construction of a road, street, or highway. Wetlands may include those artificial wetlands
intentionally created from non -wetland areas created to mitigate conversion of wetlands.
The wetlands identified on the proposed Fire Station 51 site do not meet the exemptions in the definition that
pertain to artificial wetlands, detention facilities, or wetlands created unintentionally as a result of the construction
of a road, street or highway. In this case, the wetlands do appear unintentionally created, but as a result of
earthwork, fill and excavation related to road removal and not construction. In our experience, the exemption for
wetlands created after July 1, 1990 for road construction is associated with impoundment of water by road prisms
or wetland ditches alongside recently constructed roads.
The City of Tukwila regulates wetlands through its environmentally sensitive areas ordinance, TMC 18.45.080
and 18.45.090. According to TMC 18.45.090.B, certain wetlands are exempted from the development
requirements in the ordinance; however, they must meet the following criteria as defined in the code: wetlands
must be less than 1,000 square feet in area, have no association with a riparian corridor, are not part of a wetland
mosaic, do not contain habitat identified as essential for local populations of priority species identified by
WDFW, and do not score 20 points or greater for habitat using the wetland rating system. The wetlands identified
on the proposed Fire Station 51 site do not meet any of the City's wetland exemption criteria listed above.
In our professional opinion, the City of Tukwila regulates these wetland features as critical areas. For
development approval, the City requires applicants demonstrate that mitigation sequencing has been applied to
avoid and minimize impacts to critical areas, per their code standards (TMC 18.45.090). Requirements for
compensatory mitigation are also applied by the City through the critical areas code standards (TMC 18.45.090).
According to TMC 18.45.090(B)(4) alterations to Category IV wetlands are allowed only where unavoidable and
adequate mitigation is carried out in accordance with the standards of TMC 18.45.090.
Conceptual Mitigation Alternatives
ESA investigated conceptual mitigation alternatives to satisfy potential impacts for the proposed Fire Station 51
project. These conceptual mitigation alternatives are limited to: 1) use of the King County In -Lieu Fee (ILF)
program or 2) permittee-responsible mitigation in the form of wetland enhancement at Tukwila Pond.
King County ILF Program
King County's ILF Program operates under the Mitigation Reserves Program (KC MRP) and allows applicants to
purchase credits to offset debits associated with project impacts. ESA conducted a preliminary estimate of the
debits associated with potential impacts to wetlands due to the proposed project. Using the wetland rating
assessment completed for Wetlands A and B with Ecology's debit worksheet, ESA calculated the project's debits
by wetland function as summarized in the following table:

ESA consulted directly with KC MRP Manager, Megan Webb, to identify the amount of needed credits based on
the project's calculated debits as well as the pricing for needed credits. According to KCMRP, the proposed
project would require 2.85 credits with a cost of $50,000 per credit (Webb, personal communication, March 6
2019). In addition, a land fee of $0.61 per square foot of project impact must also be applied. Therefore, the total
cost for using the KC MRP to mitigate for potential impacts from the proposed project would be as follows:
$50,000 x 2.85 credits ($129,000)
+ $0.61 x 7,173 square feet of wetland impact [Areas of Wetland A + Wetland Bl ($4,375.53)
= $133,375
Permittee-responsible Mitigation at Tukwila Pond
ESA visited Tukwila Pond Park on the same day as the delineation. We identified the southern wetland boundary
of Tukwila Pond as a possible area for wetland enhancement as permittee-responsible mitigation for potential
impacts from the Fire Station 51 project. This area of Tukwila Pond is currently dominated by Himalayan
blackberry and English ivy with some native deciduous shrubs and trees (willow, red -osier dogwood and red
alder). Based on the existing, degraded conditions of the wetland, potential wetland enhancement in this area
could include the following techniques:
• Removing invasive vegetation and refuse from the area;
• Enhancement of the area through planting of appropriate native shrubs in the fall or early spring,
primarily in areas where invasive vegetation has been removed; and
• If suitable, the installation of habitat features (e.g. logs, bird and bat boxes, etc.) that will provide refuge
for wildlife and increase species diversity.
Native vegetation would improve the functional attributes of the wetland. Potential wetland shrub species
appropriate for the southern boundary of Tukwila Pond could include salmonberry (Rubus spectabilis) and red -
osier dogwood (Cornus sericea), and willow (Salix sp.) livestakes.
According to TMC 18.45.090(E)(1), a ratio of 6:1 is typically applied for wetland enhancement as mitigation for
alterations to Category IV wetlands. Therefore, if both Wetland A and B (7,173 square feet in combined total

area) were impacted by the project, the required area of enhancement would be 43,038 square feet. Based on this
enhancement area, we estimate the total cost of permittee-responsible mitigation for enhancing the southwestern
boundary of Tukwila Pond to range from approximately $28,000 to $75,000. The higher range of this cost
estimate assumes costs for shrub plantings and willow livestakes, mulch, hydroseeding, as well as 10 years of
maintenance and monitoring for the enhancement site. The low range of this cost estimate only assumes costs for
willow livestakes and 10 years of maintenance and monitoring for the enhancement site.
Tukwila South SAMP Sites
A third, potential option for mitigation could include exploring the use of the Tukwila South Sensitive Areas
Master Plan (SAMP) sites. Additional mitigation credit may remain at these sites that could be applied to this
project since the Fire Station property was originally part of the City's agreement with the Tukwila South
developer. The application of remaining wetland mitigation credit would need to provide for the required area
outlined in the City's code for the appropriate mitigation type.
Limitations
Within the limitations of schedule, budget, and scope -of -work, we warrant that this delineation was conducted in
accordance with generally accepted environmental science practices, including the technical guidelines and
criteria in effect at the time this delineation was performed. The results and conclusions of this memorandum
represent the author's best professional judgment, based upon information provided by the project proponent in
addition to that obtained during the course of this delineation. No other warranty, expressed or implied, is made.
The final determination of jurisdictional status for wetlands would need to be determined by the Corps of
Engineers and/or Washington Department of Ecology.

The above -mentioned project encompasses the construction of a new, 2-bay fire station for the City of Tukwila and
associated site improvements. The project site was previously disturbed as part of nearby roadway improvements,
which allowed for the establishment of an emergent wetland towards the west edge of the property at the base of a
manmade hillside. In order to construct the site improvements necessary for the function of the fire station, the
Applicant requests a modification to the required wetland buffer defined in the Tukwila Municipal code.
The requested modification consists of a 50% reduction in buffer depth, along with two, small areas of "wetland as
buffer," where additional mitigation efforts will offset a further reduction in buffer depth. Impacts to the buffer will be
mitigated through buffer enhancement at a greater than 1:1 ratio, while the wetland impacts will be mitigated through
wetland enhancement at a greater than 3:1 ratio. The existing wetland and buffer areas do not contain slopes more
than 15%and the existing buffer is of low quality.
Please refer to the Sensitive Areas Study produced by The Watershed Company for additional detail on both the
existing conditions and proposed mitigation efforts.
