MINUTES REGULAR !MEETING CALL TO ORDER/ PLEDGE OF ALLEGIANCE Mayor McLeod called the Regular Meeting of the Tukwila City Council to order at TOO p,m, and led the audience in the Pledge of Allegiance, ROLL CALL Jennifer Marshall, Acting City Clerk, called the roll of the Council, Present at the meeting were Council President Armen Papyan (on -site) and Councilmembers Verna Seal (virtual), Kate Kruller (on -site), Dennis Martinez (on - site), Hannah Hednck (on -site), Joe Torres Carnacho (on -site), and Jane Ho (on -site). Croone, Chief People Officer, Jean Carlson, Senior Human Resources Analyst; Colleen Minion, Solid Waste Analyst, Laurel Humphrey, Legslative Analyst; and Jennifer Marshall, Acting City Clerk, LAND ACKNOWLEDGEMENT Councitmember Seal stated "The City of Tukwila Is located on the ancestral lands of the Coast Salish people, We acknowledge their cont nuing connections to land, waters and culture, We pay our respects to their elders past, present and emerging PUBLIC COMMENTS 1. Dave Puki noted the rewritten Flock Safety master agreement is an improvement but would hke to see additional changes to make it more "bullet-proof' . 2, Dennis Robertson acknowledged the challenge of balancing public safety and potential harm to vulnerable communities suggesting several changes to the proposed Flock Safety contract 3. Barbara Clements Connor (virtual) from Kent expressed appreciation for the process the Tukwila City Council has completed and provided feedback on the contract PRESENTATIONS a. Recology: 2025 Review Colleen Minion, Solid Waste Analyst introduced Alissa Campbeill„ Government and Community Relations Manager with Recology, who provided an overview of Recology's operational changes. She outlined improvements including increased customer service staffing for the Tukwila area, Waste Zero education/engagement efforts throughout the community, and ongoing landfill diversion efforts. Council asked clarifying questions regarding the customer service metrics; if City participates in garbage, recycling, and composting and how to incentivize restaurants to use compostabte to -go containers, 7.42 p,m, Council President Papyan left the Council Chambers, Tukwila City Council Regular Minutes Page 2 of 5 May 18, 2026 CONSENT AGENDA a. Approval of Minutes 05/04 Regular Meeting and 05/11 Special Meeting b. Approval of Vouchers: 00412362 thru 00412538 in the amount of $2,547,093,58 c. Parks and Recreation Ordinances' (1) Ordinance relating to Public Safety; repealing Ordinance No, 2476 as codified at Tukwila Municipal Code (TMC) Chapter 12.08; thereby eliminating TMC Chapter 12.08 in its entirety; reenacting TMC Chapter 12.08 to update park rules and regulations. ORDINANCE NO. 2784 (2) Ordinance repealing Ordinance No. 2567 and 2623 as codified at Tukwila Municipal Code (TMC) Chapter 12.12; "Foster Golf Links Fees"' thereby eliminating this chapter in its entirety. ORDINANCE NO. 2785 [Reviewed and forwarded to consent by the Community Services and Safety Committee on 05/11/26) d. Resolution Supporting the Nomination of Certain Eligible Census Tracts for Designation Under the New Opportunity Zones Program (OZ 2.0). RESOLUTION NO. 2145 [Reviewed and forwarded to consent by the Planning and Community Development Committee on 05/11/26] MOVED BY KRULLER, SECONDED BY MARTINEZ TO APPROVE THE CONSENT AGENDA AS SUBMITTED. MOTION CARRIED 6-0 (PAPYAN OUT OF THE ROOM AT THE TIME OF THE VOTE). PUBLIC HEARING a. A resolution to approve the Public Benefit Rating System Open Space Classification for the Property at 4447 South 148th Street 7:43 p.m. Mayor McLeod opened the public hearing. 745 p,m, Council President Papyan returned to the CouncilChambers Nora Gierloff, Director of Community Development, overviewed the proposal from private property owners to preserve their property under the King County Public Benefit Rating System (PRBS) If approved the property would be beholden to an approved Forest Stewardship Plan and granted a reduction in property taxes 7:49 p.m. Mayor McLeod called for public comments, 1 Peter Schilling spoke in support of his application The Councilmembers clarified the financial component of adhering to the Forest Stewardship Plan would fall to the homeowners and that, if not compliant, King County could revoke their approval 7:58 p.m. Mayor McLeod dosed the public hearing. AN RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, APPROVING THE PUBLIC BENEFIT RATING SYSTEM OPEN SPACE CLASSIFICATION OF THE SCHILLING PROPERTY LOCATED AT 4447 S 148TH STREET. MOVED BY KRULLER, SECONDED BY PAPYAN TO ADOPT THE RESOLUTION AS READ. MOTION CARRIED 7-0 TO ADOPT RESOLUTION NO. 2146. b. Municipal Court Ordinances Councilmember Hedrick noted the two ordinances were reviewed at the Finance and Governance Committee Meefing, Marty Wine, City Administrator, provided an overview of the intent of both proposed ordinances, (1) Ordinance amending the Tukwila Municipal Code (TMC) Chapter 2.68, "Municipal Court," in alignment with Chapter 3.50 RCW; Converting the Municipal Court Judge Position to an elective position. MOVED BY HEDRICK, SECONDED BY PAPYAN TO READ THE ORDINANCE BY TITLE ONLY. MOTION CARRIED 7-0, Jennifer Marshall, Acting City Clerk, read the proposed ordinance by title only AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING TUKWILA MUNICIPAL CODE (TMC) CHAPTER 2 68, "MUNICIPAL COURT' IN ALIGNMENT WITH CHAPTER 3 50 RCW, CONVERTING THE MUNICIPAL COURT JUDGE POSITION TO AN ELECTIVE POSITION; PROVIDING FOR SEVERABILITY, AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY KRULLER, SECONDED BY MARTINEZ TO ADOPT THE ORDINANCE AS READ, MOTION CARRIED 7-0 TO ADOPT ORDINANCE NO. 2786. (2) Ordinance to repeal Ordinance No. 2659, as codified at 'Tukwila Municipal Code (TMC) section 2.68.026 Regarding the Setting of salary for the Municipal Court Judge MOVED BY KRULLER, SECONDED BY HO TO READ THE ORDINANCE BY TITLE ONLY. MOTION CARRIED 7-0. Jennifer Marshall, Acting City Clerk, read the proposed ordinance, by tifie only, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, REPEALING ORDINANCE NO 2659 AS CODIFIED AT TUKWILA MUNICIPAL CODE (TMC) SECTION 2 58 025 REGARDING THE SETTING OF SALARY FOR THE MUNICIPAL COURT JUDGE, PROVIDING FOR SEVERABILITY, AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY KRULLER, SECONDED BY HEDRICK TO ADOPT THE ORDINANCE AS READ. MOTION CARRIED 7-0 TO ADOPT ORDINANCE NO. 2786„ c. Authorize the Mayor to execute the Master Service Agreement with Flock Safety to replace Contract #24-012 and align with Engrossed Substitute State Bill (ESSB) 6002 and established Tukwila Police Department practices with no change to the term length or fees. Tukwila City Council Regular Minutes Page 4 of 5 May 18, 2026 Mayor McLeod noted thus item was most recently discussed at the May 11, 2D26 Committee of the Whole Meeting The Counciimembers asked clarifying questions to address the privacy and ownership of the data as well as the potential to limit which agencies are provided access to the Flock system. MOVED BY PAPYAN, SECONDED BY MARTINEZ TO AUTHORIZE THE MAYOR TO EXECUTE A MASTER SERVICE AGREEMENT WITH FLOCK SAFETY TO REPLACE CONTRACT #24-012, AND ALIGN WITH ENGROSSED SUBSTITUTE STATE BILL (ESSIB)i 6002 AND ESTABLISHED TUKWILA POLICE Ili EPARTMENT PRACTICES WITH NO CHANGE TO THE TERM LENGTH OR FEES. MOTION CARRIED 5-2, WITH SEAL AND CAMACHO DISSENTING. MAJORITY CONSENSUS EXISTED TO FORWARD AN ITEM TO THE COMMUNITY SERVICES AND SAFETY COMMITTEE TO DISCUSS ESTABLISHING A POLICY REGARDING WHICH AGENCIES TO SHARE FLOCK DATA. REPORTS au Mayor Mayor McLeod attended a ribbon cutting for the new E-Ramp Facility at Boeing on May 14th He explained the project was permitted by Tukwila including a iarge wall along East Marginal Way South near South 81st Place which allows for finishing work to be completed on Boeing 737s without interfering with drivers on Interstate 5. b. City Council Councillmember Seal thanked Council for letting her attend remotely, she had anticipated being on site but was unable due to travel issues„ Councilmember KruIller invited volunteers to participate with Friends of the Tukwila Library, She represented Sound Cities Association (SCA) on the King County Emergency Management Advisory Committee and the Pubic Issues Committee (PIC) Meetings where two letters were issued representing 38 cities. The letters addressed Sound Transit an their Latest proposal and the forecast sewer rate increases by King Couty Wastewater Treatment, Council President Papyan noted he attended meetings daily related to Sound Transit in an attempt to support the Boeing Access Light Rail infill Station. He also attended a meeting supported by SCA which provides a forum for council presidents and deputy mayors to meet. Councilmember Martinez attended the Peace Officer Memorial at City Hall and the Sound Transit Public Hearing at Highline Community College. He thanked staff, council, and the public who continue to take time to attend these meetings, Councilmember Camacho will be hosting the City of Tukwila Chocolate Talk at the Maeve Chocolate Factory, thanked the Tukwila Police Department and Puget Sound Regional Fire for their work on the Gift of Life event at Foster High School c. Staff Marty Wine, City Administrator, invited additional participation un the City of TulKwilia People's Project Ballot noting the deadline for voting is May 31st. She reported the Adopt a Road Program launched at tine end of AprlL MISCELLANEOUS Councilmember Krufler requested consensus to direct Laurel Humphrey, Legislative Analyst, review options for parliamentary training for Councilu MAJORITY CONSENSUS EXISTED TO REVIEW OPTIONS FOR PARLIAMENTARY TRAINING. Tukwila City Council Regular Minutes Page 5 May 18, 2026 of 5 Councilmember Martinez requested a presentation from staff on the events for the FIFA World Cup, Staff advised a briefing was been scheduled for June 1 and the specific questions would be routed to staff to include in the briefing. Council President Papyan linvited applications for the 2026 Workforce Discovery Lab presented through The Success Foundation, EXECUTIVE SESSION Mayor McLeod announced the Council would go into an Executive Session to discuss: Potential Litigation- Pursuant to RCW 42.30.110(1)(i). (20 minutes) The total amount of time was to be no more than 20 minutes, and no decisions would be made during the Executive Session. Potential Settlement Agreement with T-Force eetmg MOVED BY PAPYAN, SECONDED BY MARTINEZ TO AUTHORIZE THE MAYOR TO EXECUTE A SETTLEMENT AGREEMENT WITH T-FORCE TO RESOLVE THE CITY'S CLAIM FOR DAMAGES IN THE AMOUNT OF $685,000.00 WITH THE FINAL AGREEMENT OT BE APPROVED BY THE MAYOR AND CITY ATTORNEY.
