HomeMy WebLinkAbout26-149 - Contract - Seattle Police Department - FIFA World Cup Mutual Aid26-149 Council Approval N/A MEMORANDUM OF UNDERSTANDING City of Tukwila Police Department 15005 Tukwila International Blvd. Tukwila, WA 98188 THIS AGREEMENT is made and entered into by and between the City of Seattle Police Department, hereinafter referred to as "SPD" and City of Tukwila Police Department. WHEREAS, the SPD has established MOUs to provide specialized on -duty police services and officer presence during the 2026 FIFA World Cup; WHEREAS, Lumen Field (800 Occidental Ave S, Seattle, WA 98134), will be hosting the official 2026 FIFA World Cup matches on 6/15/26, 6/19/26, 6/24/26, 6/26/26, 7/1/26, and 7/6/26; WHEREAS, 2026 FIFA World Cup "Fanfests" will be hosted at the Seattle Armory (305 Harriston St., Seattle, WA 98109), the Seattle Waterfront (1401 Alaskan Way, Seattle, WA 98101), Victory Hall (1201 1 st Ave S., Seattle, WA 98134), and Pacific Place (600 Pine St., Seattle, WA 98101). These four locations will be activated only on official match days; WHEREAS, the Seattle Armory (305 Harriston St., Seattle, WA 98109) will be hosting the only officially staffed watch party and will be activated on non -match days; WHEREAS, current staffing levels and competing security/traffic events throughout the city have impacted SPD's ability to adequately staff all requested events during this event window, NOW, THEREFORE, in consideration of the terms, conditions, covenants, and performance of the scope of work contained herein, or as attached and made a part hereof, the parties hereto agree as follows: IT IS THEREFORE MUTUALLY AGREED THAT: City of Tukwila Police Department has agreed to partner with SPD to provide this one-time support for the specific event(s) on this specific date(s), detailed as follows: Match Days Staffing (FTE/Rank) Tentative Assignment & Locations 06/15/2026 2 Detectives and 1 Officer 06/19/2026 2 Detectives, 1 Sergeant and 2 Officers 06/24/2026 1 Sergeant and 2 Officers 06/26/2026 1 Detective, 1 Sergeant and 1 Officer 07/01/2026 1 Corporal and 3 Officers 07/06/2026 2 Detectives, 1 Sergeant and 2 Officers Unless otherwise noted, rollcall will be 5 hours prior to kickoff and will conclude 3 hours after end of assigned match. Total shift length is estimated at 10 hours. Posts will be assigned through collaboration with the assigned SPD and City of Tukwila Police Department commanders. In the event the MOU requires a change in scope or an increase in cost beyond the amount agreed to, the SPD and the City of Tukwila Police Department shall agree to any such changes in writing prior to the commencement of Services requiring the change in the scope or cost increase 26-01215 Page 1 of 4 TERM OF AGREEMENT This Agreement shall begin June 10, 2026, and terminates July 10, 2026. This agreement may be modified and continued by amendment, for work beyond this date, by mutual agreement of the parties. PAYMENT SPD will pay for the City of Tukwila Police Department for work covered in the Scope of Work for actual costs incurred by City of Tukwila Police Department. The funding limit shall not exceed $22,700 and shall reflect the Parties' best estimate of the cost of work to be accomplished under this Agreement. SPD shall not be obligated for any expenditure in excess of the funding limit unless prior written authorization is received. Actual amounts reimbursed under this Agreement shall be based on actual costs incurred by City of Tukwila Police Department. In no event, shall any Party be paid for costs that are not documented pursuant to the requirements of this Agreement. SPD will pay City of Tukwila Police Department pursuant to the following provisions, unless otherwise agreed in writing: City of Tukwila Police Department shall submit to SPD an invoice for Services performed no later than thirty (30) calendar days following the last date on which the Services were performed. Invoice shall include a summary of total costs billed to date and contain accurate and adequate back-up documentation. Any request for payment for work billed later than forty-five (45) calendar days after its completion shall not be eligible for payment. Unless otherwise directed, City of Tukwila Police Department shall submit invoices and appropriate supporting materials to: Seattle Police Department To: spdapa-seattle.gov (Fiscal Unit) cc: stephanie.providoa-seattle.gov (Administrative Manager) cc: sonya.robertsa-seattle.gov (Grant Manager) City of Tukwila Police Department agrees to submit a final bill to SPD within thirty (30) calendar days after the end date of this Contract and will label the invoice "FINAL BILL." Smith(a�seattle.aov AWARD PROJECT DESCRIPTION: The objective of the Federal Fiscal Year (IFFY) 2026 FIFA World Cup (FY 2026 FWCGP) grant program is to provide targeted funding to enhance security and preparedness for the 2026 FIFA World Cup events hosted in the United States. It will provide Federal resources to help Host Cities in implementing the necessary security measures and strengthen capabilities required for this series of high-risk events. FWC grant funds will enhance the ability of local law enforcement, emergency responders, and public safety officials to prepare for, protect against, and respond to threats and emergencies during the World Cup matches. The Organization is a sub -recipient and Pass-through Entity of the FY 2026 FWCGPC Award Letter for Grant No. EMW-2026-W-05005 ("the Grant"). Which is incorporated in and attached hereto as Attachment C and has made a subaward of Federal award funds to the Subrecipient pursuant to this Agreement. The Subrecipient is accountable to the Organization for use of Federal award funds provided under this Agreement. MUTUAL INDEMNIFICATION AND HOLD HARMLESS To the maximum extent allowed by law, City of Tukwila Police Department shall protect, defend, indemnify, and save harmless the City, its officers, officials, and employees while acting within the scope of their employment, from any and all costs, claims, judgments, penalties, and/or awards of damages, arising out of or in any way resulting from City of Tukwila Police Department intentional conduct, negligent acts or omissions in connection with activities conducted under this Agreement. To the maximum extent allowed by law, the City shall protect, defend, indemnify, and save harmless City of Tukwila Police Department, its officers, officials, and employees while acting within the scope of their employment, from any and all costs, claims, judgments, penalties, and/or awards of damages, arising out of or in any way resulting from the City's intentional conduct, negligent acts or omissions in connection with activities conducted under this Agreement. Each Party agrees that its obligations under this Section extend to any claim, demand, and/or cause of action brought by, or on behalf of, any of its employees or agents. For this purpose, each Party, by mutual negotiation, hereby waives, with respect to the other Party only, any immunity that would otherwise be available against such claims under the Industrial Insurance provisions of Title 51 RCW. In the event that a Party incurs anyjudgment, award, and/or cost arising there from, including attorneys' fees, to enforce the provisions of this Section, all such fees, expenses, and costs shall be recoverable from the responsible Party to the extent of that Party's culpability. This indemnification shall survive the termination of this Agreement. INSURANCE The City of Tukwila Police Department is self-insured and a member of a liability pool which includes coverage for professional liability, among other categories of coverage, in adequate quantity to protect against legal liability arising out of contract activities. City of Tukwila Police Department shall provide evidence of its status as a self-insured entity meeting these requirements within fifteen (15) calendar days of the execution of this Agreement. Upon request by City, Recipient must describe its financial condition and the self-insured/liability pool funding mechanism. City, or any other third party, need not be named as additional insureds under the self-insurance/liability pool coverage policies as said policies prohibit City of Tukwila Police Department from naming third parties as additional insureds. City of Tukwila Police Department shall give City thirty (30) calendar days' advance notice of any self-insurance or liability pool cancellation or non -renewal. TERMINATION Either party may terminate this Agreement without recourse by the other party upon written notice to terminate.
