AN ORDINANCE OF THE TOWN OF TUKWILA, WASHIrGTON, LICENSING AND
REGULATING THE SALE; OR OTHER DISPOSITION, OF BEERS, ALES, PORTER,
WINES, OR SIMILAR FERMENTED MALT OR VINOUS LIQUOR AND FRUIT JUICE
CONTAINING MORE THAN ONE -HALF OF 1 PER CENT, BY VOLUME, OF ALCOHOL,
AND NOT MORE THAN 3.2 PER CENT OF ALCOFOL BY WEIGHT.
THE, TOWN COUNCIL OF THE TOWN OF TUKWILA, WASHINGTON, DOES ORDAIN AS
FOLLOWS:
SECTION 1. It shall bs unlawful to sell, give or otherwise dis-
pose of or deliver to any person under the age of twenty -one years.
any. beer, ale-, porter, wine or similar fermented malt or vinous liquor
and or fruit juice containing more than one -half of one per cent by
volume, of alcohol, and not more than 3.2 per cent of alcohol by weight,
SECTION 2. No beverage dispensary as hereinafter defined shall
be situated within a radius of within three hundred feet of any grade
school or high school grounds, or within a radius of within three hun-
dred feet of any church.
SECTION 3. It shall be unlawful to sell, b arter, exchange or
distribute any of the afore mentioned beverages containing more than
one -half of 1 per cent by volume of alcohol without having a license
so to do, as hereinafter provided.
SECTION 4. Restaurants and other places where meals are served
and sold: A beverage license may be issued to any restaurant and
other place where meals are served and sold, with a seating capacity
of at least ten (10) people, which has been in operation for a period
of at least one (1) year prior to the application for the license.
The license fee shall be Fifty Dollars ($50.00) per year, payable in
advance. All beverages sold in such places shall be consumed on the
premises.
SECTION 5. Beverage Stores: A "beverage" or "beer" store shall
mean a place where only bottled beverages are sold. The license fee
shall be Twenty -five Dollars per year. Bottled beverages shall be
kept in sealed cartons or cases, and such bottled beverages may be sold
in cases or cartons containing one or more bottles. No draught bev-
erages shall be sold from such places and no beverages shall be opened
or consumed upon the premises. No license shall be issued except for
places where foodstuffs are sold.
SECTION 6. No person shall sell any beverage or liquor containing
more than 3.2 per cent of alcohol by weight except upon prescription
in accordance with the laws of the United States and of the State of
Wadhington.
SECTION 7. It shall be unlawful for any person to drink any bev-
erage in any public place not licensed under the provisions of this
ordinance.
SECTION 8. Any person who shall be guilty of violating any of
the provisions of this ordinance shall be guilty of a misdemeanor
and shall, upon conviction thereof, be fined in a sum not leas than
Twenty -five Dollars and not more than Two Hundred Dollars, or shall
be imprisoned for a period of not less than five days nor more than
sixty days, or by both such fine and imprisonment.
SECTION 9. This ordinance shall be in full force and effect ten
days from and after its passage, approval and legal publication, as
provided by law.
