HomeMy WebLinkAbout1960-09-28 Special Minutes - Public Hearing September 28, 1960. Mayor Charles 0. Baker called the Council meeting to order at 8 p.m. Councilmen present were Stan Minkler, A. G. Radford and E. W. Ives. Mr. Gerald Cysewski, town Engineer and Mr. John Hodges, town attorney, were also present at the Council table. This meeting was a public hearing on the vacation and relocation of certain streets, continued from August 30th and September 14th to give those interested time to co- ordinate their plans. The Clerk read the petition for the vacation and relocation of certain streets. Mayor Baker read a letter he had received from Mr. Paul McKay, District Engineer State Highway Dept., in which he stated that his Engineers and the Engineers of the Developers had worked out an agree- able arrangement, establishing earth removal grades and Freeway grades, and that said agreement held many advantageous features Mayor Baker asked Mr. Rodgers of the Bureau of Public Roads if the solution to this problem met with the approval of his Department. Mr. Rodgers agreed basically with all statements contained in Mr. McKay's letter and said this aemonstrated that different governmental agencies can work together to their mutual advantage. Mayor baker read a letter from Mr. Don Garen's attorney, stating apprehension, should a portion of South 162nd Street be removed without proper soil borings and examinations by a soil analyst. This subject was discussed in detail and a report on possible slide conditions in this area was given by Mr. Burzenski, Project Engineer and Mr. Joseph La Mont, of Dames Moore. Mr. La Mont stated that tests are presently being made in the vicinity of South 162nd Street and Mr. Garen's property, although further study is necessary before a complete report can be made. Mr. Wells McCurdy of Puget Western stated that it was not in the best interest of the Developers nor of the Town of Tukwila for any earth removal on vacated streets be made until a thorough investigation of soil conditions had been completed. ile further stated his Company have placed with the Town of Tukwila a bond that would fully protect the town and property owners in the event damage may occur. September 28,1960 (continued) After a fifteen minute recess Mayor Baker called the meeting to order and the following motion was presented by Mr. Radford: "That the Council grant the petition of Southcenter and Puget Western to vacate and relocate the streets as described in their petition, subject to the following conditions: Compliance by Southcenter Corporation and Puget Western with the terms which were agreed to in their letter of August 25, 1960, addressed to the Town Council of Tukwila, further: That no earth be removed from South 162nd Street until such time as scientific analysis determines that slide conditions will not be further aggravated, further: That excavation by Southcenter and Puget Western shall be in compliance with and restricted to the specifications as putlined in the Washington State Highway Commission letter to the Town of Tukwila, dated September 27, 1960," seconded by Mr. Mi4kler and carried. Mayor Baker reported Mr. Doyle, who was out of town, had left his proxy and would go along with the Council, providing sufficient safeguards could be worked out. Mayor Baker thanked all who had made this agreement possible. He also thanked Mr. Garen, the people of Tukwila and the officials for the effort and in serest throughout the Public Hearings.
