A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, FIXING THE TIME FOR A PUBLIC
HEARING FOR VACATION UPON A PETITION FOR
VACATION OF CERTAIN RIGHT -OF -WAY WITHIN THE CITY
OF TUKWILA GENERALLY DESCRIBED AS 43RD PLACE
SOUTH.
WHEREAS, Dujardin Development Company filed a petition with the City Clerk for vacation
of certain right -of -way generally described as 43rd Place South within the proposed Fosterview Estates;
and
WHEREAS, the City Clerk has determined that said petition was signed by the owners of more
than two thirds of the property abutting the right -of -way sought to be vacated; and
WHEREAS, in accordance with RCW 35.79.010, the City Council will hold a public hearing
for the purpose of considering said petition for right -of -way vacation;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO HEREBY RESOLVE AS FOLLOWS:
&lion I A public hearing upon the petition of Dujardin Development Company for vacation
of certain public right -of -way, generally described as that portion of 43rd Place South lying between
42nd Avenue and 43rd Avenue and more specifically described as the east 20 feet of Tract 67, Riverside
Interurban Tracts, according to the plat thereof recorded in Volume 10 of Plats, Page 74, records of
King County, Washington, except the north 350 feet thereof; shall be held before the Tukwila City
Council in the City Council Chambers at Tukwila City Hall, 6200 Southcenter Blvd., Tukwila,
Washington, at 7:00 p.m. or as soon thereafter as the matter may be heard on January 10, 1994, which
is not less than twenty (20) nor more than sixty (60) days from the date of passage of this resolution, at
which time all persons interested in said right -of -way vacation are invited to appear and be heard.
Sectio 2. The City Clerk is directed to post written notice of pendency of the public hearing in
three public places in the City of Tukwila and in one additional conspicuous place on the right -of -way
sought to be vacated at least twenty (20) days prior to the date set for hearing.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, at a
regular meeting thereof this Z-9 day of 1993.
