Resolution No. 1283
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, STATING THE CITY'S INTENT
TO REGULATE RATES AS PROVIDED UNDER THE CABLE
TELEVISION CONSUMER PROTECTION ACT OF 1992
(47USC -543).
WHEREAS, the United States Congress adopted an Act which provides local control
over some portions of the rates established by cable operators operating under franchise
arrangement within the jurisdictional boundaries of local government; and
WHEREAS, the Federal Communications Commission has promulgated rules and
regulations to carry out the provisions of the Act adopted by Congress; and
WHEREAS, the City of Tukwila allows the non exclusive grant of franchise privileges to
cable operators requesting to provide cable service within the City and has been granted the
authority by the Federal Communications Commission to regulate some portions of the rates
charged by the operators of such cable services; and
WHEREAS, the citizens of the City of Tukwila will benefit from the responsiveness of
their local officials and their ability to provide input into the local rate regulation process for
cable services;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY RESOLVES AS FOLLOWS:
Section 1. The City of Tukwila intends to develop, adopt, and administer Rate
Regulation Rules as authorized by the Federal Communications Commission (FCC) in the
Rules and Regulations promulgated to carry out the Cable Television Consumer Protection
Act of 1992 or as may be amended hereafter.
Section 2. The City of Tukwila has the personnel and technical ability to administer the
Rules and Regulations as set forth by the FCC and the Mayor shall be the responsible official
for purposes of fulfilling the City's obligations under this Resolution.
Section 3. The City of Tukwila ensures that all procedures and rate regulation
proceedings conducted in carrying out the Rules and Regulations of the FCC and the City in
the administration of this Resolution will provide reasonable opportunity for the
consideration of the views of interested parties.
