HomeMy WebLinkAboutRes 1299 - Modify the Bid Award for East Marginal Way South 6a: O. 1 o C Washington Resolution No. 1299 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, MODIFYING THE BID AWARD FOR THE EAST MARGINAL WAY SOUTH AT ASSOCIATED GROCERS RIVERBANK SLOUGH REPAIR PROJECT AS FOLLOWS: 1) ACCEPT THE JUNE 23, 1994 WITHDRAWAL OF C.D. CONSTRUCTION MANAGEMENT, INC. AND RESCIND COUNCIL'S JUNE 20, 1994 BID AWARD; 2) RELEASE BID BOND TO C.D. CONSTRUCTION WITHOUT PENALTY; 3) AWARD CONTRACT TO NEXT LOWEST BIDDER. WHEREAS, the City did solicit competitive bids for the East Marginal Way South at Associated Grocers Slough Repair Project; and WHEREAS, such bids were opened by the City Clerk and read aloud at 10:00 a.m. on June 20,1994; and WHEREAS, each bid was reviewed for conformance to the formal bid specifications issued at the time bids were solicited; and WHEREAS, C.D. Construction Management, Inc. was awarded the East Marginal Way South at Associated Grocers Slough Repair Project at the June 20, 1994 Council Meeting; and WHEREAS, on June 22, 1994, C.D. Construction's subcontractor informed C.D. Construction that after further review of the job conditions, including the overhead wire and pilings in the river, added complications to the scope of work previously unanticipated, they would be unable to perform the work as originally bid; and WHEREAS, on June 23,1994, C.D. Construction Management, Inc. informed the City they were forced to withdraw the bid; and WHEREAS, on June 27, 1994, C.D. Construction Management, Inc. requested that the contract be rescinded and that their bid bond not be forfeited; and WHEREAS, C.D. Construction Management, Inc. submitted their bid in good faith, without prior knowledge of their subcontractor's bid errors, and notified the City of the bid error in a reasonable period of time; and WHEREAS, if the City awards this contract to the next lower bidder in early July 1994, the successful contractor may take advantage of the July low tide events so this project can be constructed in a timely manner; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1: Accept the June 23, 1994 withdrawal of C.D. Construction Management, Inc. and rescind Council's June 20, 1994 bid award; Section 2: Release bid bond to C.D. Construction Management, Inc. without penalty; and Section 3: Award the East Marginal Way South at Associated Grocers Slough Repair Project to the next lowest bidder, the Wayne McCann Trucking Excavating Company; and authorize Administration to sign contract /notice to proceed immediately to allow contractor to work at earliest low tide conditions.
