A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUKWILA, WASHINGTON, REJECTING ALL BIDS
SUBMITTED FOR THE PACIFIC HIGHWAY BRIDGE
REPLACEMENT PROJECT.
WHEREAS, sealed bids were solicited for the Pacific Highway Bridge
Replacement project; and
WHEREAS, bids were opened and read aloud by the City Clerk on December 3,
1997; and
WHEREAS, 16% Disadvantaged Business Enterprise work (DBE) was the
required goal set by WSDOT as a federal grant condition to bid and award the project;
and
WHEREAS, the 16% DBE requirement was included as a mandatory requirement
in the formal bid documents; and
WHEREAS, MKB Constructors bid 15.96% as DBE work which does not meet the
federal requirement; and
WHEREAS, Washington State Department of Transportation TRANSAID Division
Staff who administer the federal grant funds for the project cannot approve the award
of the construction grant unless the DBE requirement is met; and
WHEREAS, a budget was set aside for the replacement of the bridge; and
WHEREAS, all responsive bids were over the budgeted amount for the bridge
replacement;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO HEREBY RESOLVE AS FOLLOWS:
Section 1
The MKB Constructors bid for the Pacific Highway Bridge Replacement project is
hereby rejected as non responsive for failure to meet the required specifications for
DBE work.
Section 2
All other bids are hereby rejected due to budget limitations.
