A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, WAIVING A MINOR IRREGULARITY IN BIDS AND
AWARDING THE BID FOR PURCHASE OF A BACKHOE LOADER TO
SMITH TRACTOR EQUIPMENT CO., INC., IN THE AMOUNT OF
$51,059.78 BEFORE TAX.
WHEREAS, the City of Tukwila advertised and received bids for a backhoe loader on June 23, 1998;
and
WHEREAS, upon opening bids on June 24, 1998 it was found that only one bidder out of four could
meet the specification requirement for a piston -type hydraulic pump; and
WHEREAS, in the subsequent assessment and evaluation of the bids by the City following the bid
opening, it was determined that a gear- driven hydraulic pump would not affect the functional performance
of a backhoe loader; and
WHEREAS, it is the intent of the City Council to promote and enhance the full and open
competition for the procurement of equipment and supplies; and
WHEREAS, the limitation of responsive bidders to only those who have piston -type hydraulic
systems would effectively preclude competition in the bid for backhoe loaders for the City; and
WHEREAS, the City Council is authorized to waive minor irregularities in bid proposals which are
insubstantial in nature and which do not present an advantage to any bidder; and
WHEREAS, the provision of an alternative hydraulic system does not affect the functional
performance of the equipment and can be considered a minor irregularity and insubstantial variance for
purposes of identifying responsive bidders;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. The provision of an alternative hydraulic system rather than a piston type as required in
the bid specifications on line 7.a is determined to be a minor and insubstantial variance from the bid
specifications and the irregularity is hereby waived.
Section 2. The bid for backhoe loaders as opened and read aloud on June 24, 1998 is hereby
awarded to Smith Tractor Equipment Co., Inc., in the amount of $51,059.78 before tax.
