A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, AUTHORIZING THE MAYOR
TO INTERVENE ALONG WITH OTHER CITIES IN THE
TEMPORARY INJUNCTION LAWSUIT REGARDING I -722,
AND RATIFYING THE ACTIONS TAKEN PRIOR TO THE
ADOPTION OF THIS RESOLUTION.
WHEREAS, I -722, passed by the voters on November 7, 2000, has a temporary
injunction issued against its implementation on behalf of several governmental entities;
and
WHEREAS, there are significant budgetary, financial planning, and City service
provision issues related to the implementation; and
WHEREAS, the City Council desires to participate directly with other cities to
ensure I -722's constitutionality as it impacts the City of Tukwila;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY RESOLVES AS FOLLOWS:
Section 1. Authorize Mayor to take any action necessary for City to become part
of I -722 lawsuit. The Mayor is hereby authorized to direct the City Attorney to prepare
the legal pleadings necessary, and to take the lead actions necessary to make the City a
party plaintiff in the Thurston County Superior Court action now pending concerning
legal and constitutional challenges to Initiative 722.
Section 2. Prior Acts Ratified. Any acts previously taken by the Mayor or City
staff consistent with the City Council's resolution and direction herein are hereby
ratified and approved.
