RESOLUTION NO 714
CITY OF TUKWILA
A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE
AN AGREEMENT WITH KING COUNTY REGARDING LAW
AND JUSTICE PLANNING AND THE DISTRIBUTION OF
CERTAIN LAW ENFORCEMENT ASSISTANCE FUNDS.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO RESOLVE AS FOLLOWS:
That the Mayor be authorized to execute, on behalf of the
City of Tukwila, an agreement with King County regarding
law and justice planning and the distribution of certain
law enforcement assistance funds, a copy of which said
agreement is attached hereto and incorporated herein by
reference provided that the agreement is revised according
to the following provisions:
(1) Paragraph A, Section IV, Page 6 becomes Paragraph
6 of Section II B.
(2) Paragraphs 1 and 2 in Section IV are Inter changed.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
at a regular meeting thereof this 9 day of Jle.4 1980.

AGREEMENT FOR LAW AND JUSTICE PLANNING AND THE DISTRIBUTION
OF CERTAIN LAW ENFORCEMENT ASSISTANCE FUNDS
THIS AGREEMENT, made this day of
1980, by and between the governing body of King County, the desig-
nated Indian tribe, and the incorporated municipal jurisdictions
within King County with the exception of Seattle.
WITNESSETH:
WHEREAS, the Federal Government through adoption and
administration of the Justice System Improvement Act of
1979, hereafter referred to as "the Act," will make funds avail-
able to the State of Washington for expenditure during calendar
year 1980 and ensuing years; and
WHEREAS, the Act authorizes the allocation of funds to
States and units of local government to carry out programs to
improve the functioning of the criminal and juvenile justice
system pursuant to Part D of the Act; and
WHEREAS, the Act authorizes the allocation of block
granc funds to eligible jurisdictions including any combination
of units of local governments which has a population of two
hundred and fifty thousand or more persons; and
WHEREAS, the parties to this agreement wish to apply
for a block grant as a combination of units of local governments;
WHEREAS, the population of this combination of units
of local governments exceeds two hundred and fifty thousand; and
WHEREAS, the Act requires the State to make available
to eligible jurisdictions an amount of at least 7.5 per centum
o f the eligible jurisdictions block grant allocation for the
purposes of administering grants received under the Act and for
operating local planning offices; and
WHEREAS, the Act provides that the Chief Executives of
eligible jurisdictions shall designate an office for the purpose
of preparing and developing the grant application, assuring
1 compliance with Federal requirements, State law and providing fund
2 accounting, auditing and evaluation of grant funded programs; and
3 WHEREAS, the Act requires that each eligible jurisdiction
4 shall designate a local criminal justice advisory board which shat:
5 be broadly representative of the criminal and juvenile justice
6 system and shall include representatives of neighborhood and
7 community based organizations;
8 NOW, THEREFORE, IT IS AGREED THAT
9 I. The distribution of formula grant funds which are
10 available under Part D of the Act to the eligible jurisdiction
11 formed by the parties to this agr?,ement shall be governed by the
12 following provisions:
13 A. On behalf of the parties to this agreement, King
14 County shall submit an annual application to the State for a
1 5 block'grant for LEAA funds available under Part D of the Act.
16 B. The block grant funds received by King County shall
17 be distributed to participating jurisdictions on the basis of
18 percentages reflecting the relative expenditures made by each
19 such jurisdiction for criminal justice programs during the fiscal
20 year immediately preceding the preparation of the regional law
21 and justice plan, hereinafter referred to as the "annual plan,"
22 in comparison to the total amount expended on criminal justice
Z3 programs during the same time period by all participating juris-
24 dictions. PROVIDED, that funds distributed pursuant to this
25 formula to jurisdictions other than King County will be held in
26 a pool for distribution to such participating jurisdictions at
27 the discretion of the King County Law and Justice Planning Com-
28 mittee, hereinafter referred to as "the Committee," whose powers
29 and duties are described in Section II of this agreement.

30 Participating jurisdictions shall be considered to be those juris-
3 dictions which have signed this agreement.
32 C. The distribution of funds provided for by this
33 section is contingent upon approval of projects by the Committee,

1 as provided in Section II.B., and by the Governor's Council on
2 Criminal Justice. Approval of projects must be secured in both
3 the annual plan and in formal grant applications.
4 II. There shall be established a King County Law and
5 Justice Planning Committee.
6 A. Composition. The Committee shall be composed of
7 the following persons or their designee: the Presiding Judge
8 of the Superior Court or the Superior Court Administrator; the
9 Chairperson of the District Court Magistrates Association or the
10 District Court Administrator; the King County Prosecuting Attorney;
11 the Director of the King County Office of Public Defense; the
12 Sheriff Director of the King County Department of Public Safety;
13 a representative designated by the King County Council; the
14 Director of the King County Department of Rehabilitative Services;
15 the Director of the King County Department of Youth Services; the
16 chief administrative officer of each city in King County with a
17 population of at least 10,000 persons, or other representative
18 from such city as may be designated by its legislative authority,
19 PROVIDED that the city of Seattle shall not be entitled to such
20 representative; two representatives collectively selected by all
21 cities and towns in King County with populations of less than
22 10,000 persons; two citizen representatives nominated by the
23 participating jurisdictions and appointed by the King County
24 Executive, such citizen representatives to be members of com-
25 munity or neighborhood groups. Members of the Committee selected
26 by cities and towns shall serve at the pleasure of their respec-
2 tive appointing authorities; PROVIDED that the terms of such
28 Committee members shall not exceed two years in length unless
29 specifically authorized by the proper appointing authority or
30 authorities. The Chairperson of the Committee shall be chosen
31 from among the members of the'Committee by a majority vote
32 of the members for a term of one year, PROVIDED that a repre-
33 sentative of a suburban city shall be designated as Chair-

person at least once in every two years.
B. Powers and Duties. The Committee shall be empowered to:
1. Review crime and offender data and special analysis prepared
by the staff described in Section III of this agreement and recommend to
participating jurisdictions target crimes and criminal justice system
problem areas for emphasis.
2. Review proposed crime reduction and system improvement
strategies prepared by staff and recommend to participating jurisdictions
policies and program areas for emphasis.
3. Review and approve or disapprove specific project proposals
submitted by agencies of participating jurisdictions for purposes of in-
clusion in or exclusion from the annual regional law and justice plan.
4. Prepare funding guidelines for project proposals submitted
by agencies of participating jurisdictions. These guidelines shall define
target crimes to be addressed, target populations to be assisted, and
policies for funding.
5. Review staff suggestions for projects to be evaluated and
recommend projects for evaluation.
6. The Committee, pursuant to guidelines established by the
Governor's Council and taking into consideration such guidelines as may
be suggested by the Committee, shall set priorities for the use of funds
allocated to it on the basis of the annual allocation formula adopted
pursuant to Section I of this agreement. Such priorities shall be subject
to alteration by the Governor's Council. Priorities shall be set by
approving by motion or resolution a project or set of projects whose total
grant costs do not exceed the amount allocated by the adopted formula.
III. The King County Law and Justice Planning Office staff,
hereinafter referred to as "the staff," shall fulfill the following duties:
A. Responsibilities to Committee. The staff shall:
1. Solicit and present to the Committee all applicable federal
and state policy guidelines, special conditions, and format requirements
related to the preparation of local law and justice plans.
2. Prepare and present written materials required by the State
Division of Criminal Justice as components of the annual King County law
and justice plan to be prepared pursuant to this agreement, including but
not limited to collection and analysis

of data, identification of problems and development of alternative
strategies; except that the initial project descriptions and
3 budgets proposed for inclusion in the annual plan shall be pre
4 pared by agents of the parties to this agreement.
5 3. Prepare and present recommended target crimes to
6 be addressed, target populations to be assisted and policies for
7 funding.
4. Prepare and present to the Committee project
evaluation reports for selected projects, contingent on LEAA
funding for evaluation staff to be located in the King County Law
and Justice Planning Office.
B. Responsibilities to Jurisdictions Which are
13 Parties to this Agreement. The staff shall:
14 1. Prepare and present written materials required by
15 the State Division of Criminal Justice as components of the annual
16 King County law and justice plan to be prepared pursuant to this
17 agreement, including but not limited to collection and analysis
18 of data, identification of problems and development of alternative
19 strategies; except that the initial project descriptions and
20 budgets proposed for inclusion in the annual plan shall be pre-
21 pared by agents of the parties to this agreement.
22 2. Solicit and present all applicable federal and
23 state policy guidelines, special conditions, and format require
24 ments related to the preparation of local law and justice plans.
25 3. Prepare and present project evaluation reports for
26 selected projects, contingent upon LEAA funding for evaluation
27 staff to be located in the King County Law and Justice Planning
28 Office.
29 4. Present the locally adopted annual plan in general,
30 and the included projects in particular, before the Governor's
31 Council on Criminal Justice, and the State Division of Criminal
32 Justice.
33 5. For agencies of participating jurisdictions other

than King County, advise and assist in the preparation of contracts for
projects included in the annual law and justice plan, as approved by the
Governor's Council on Criminal Justice, and process and submit such contracts
to the King County Executive for signature.
6. Prepare and present the annual block grant applications
to the State Division of Criminal Justice and the Governor's Committee
on Criminal Justice. Such application shall include such information
on component projects as may be required by State and Federal guidelines.
7. Submit progress reports and fiscal reports for the block
grant to the State Division of Criminal Justice as required by the block
grant contract.
IV. The jurisdictions participating in this agreement shall
have the following responsibilities and powers:
1. The agents of all parties to this agreement responsible
for preparing the initial project proposals shall submit copies of the
project proposals to the staff for review and editing prior to the
presentation of the proposals to the Committee.
2. The legislative authority of each participating juris-
diction shall approve or disapprove project(s) submitted by its agents
and approved by the Committee for inclusion in the annual plan. Approval
shall be given by motion or resolution.
3. The applicants for LEAA grant assistance shall submit
copies of formal grant contracts to the staff for review and comment
prior to submittal to the King County Executive for signature.
4. The project directors of LEAA grant- funded projects shall
submit all LEAA grant progress reports and fiscal reports required as
conditions of grant contracts to the staff.
V. General Terms.
A. Any party to this agreement shall be permitted to with-
draw from this agreement upon three months' notice to each of the other
parties.
B. The duration of this agreement shall be for so long as
funds under the Act are available to the eligible jurisdiction created
by this agreement.
C. It is understood that by signing this agreement the
signing jurisdictions are bound to and become parties to identical
agreements signed by King County with other jurisdictions.
D. It is recognized that amendment of the provisions of
this agreement may become necessary, and such amendment shall take place
when both parties have executed a written addendum to this agreement.
