A RESOLUTION OF THE CITY OF TUKWILA, WASHINGTON,
AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT FOR
SERVICES WITH THE SOUTH EAST COMMUNITY ALCOHOL
CENTER.
WHEREAS, the Tukwila Municipal Court has utilized the services
of the South East Community Alcohol Center since 1975, and
WHEREAS, it has been determined by the administration of SECAS
that further services to the Municipal Court cannot be provided without a
formal contract for services and reimbursement agreement, and
WHEREAS, the City desires to maintain the level of services
provided by SECAS from 1975 through 1979.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
DO RESOLVE AS FOLLOWS:
The Mayor is hereby authorized to execute an agreement
for services with the South East Community Alcohol Center.
Said agreement is attached hereto and incorporated as
though fully set forth herein.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
at a regular meeting thereof this /9 day of 1980.

CONTRACT FOR SERVICES
THIS AGREEMENT, made and entered into this /'day of `,GGC
1980, by and between the CITY OF TUKWILA, Washington, a municipa corporation,
hereinafter referred to as CITY and SOUTHEAST COMMUNITY ALCOHOL CENTER, here-
inafter referred to as AGENCY:
WITNESSETH
WHEREAS, CITY conducts municipal court sessions on a regular basis
on Tuesday evening and all day Friday of each week, for both arraignment
and trial purposes and has solicited and received support services of a
counselor assigned by AGENCY to provide on- the -spot interviews, evaluation,
referral, and /or agency treatment of appropriate defendants; and
WHEREAS, AGENCY has provided the requested services amounting
to approximately 44 hours per month, without charge; and
WHEREAS, AGENCY is now in a financial condition which requires
reimbursement for one /third of its counselor's time to provide such services.
NOW, THEREFORE, for and in consideration of the mutual promises
and benefits of and to the parties, IT IS MUTUALLY COVENANTED AND AGREED
AS FOLLOWS:
1. TERM
The term of this agreement shall be fo a period of one
year commencing on the d of a?ll 19�, and

2. RESPONSIBILITIES OF AGENCY
(A) AGENCY will make available to CITY on all regularly scheduled
court dates, the services of one of its counselors
(preferably Jim Davis) to continue to provide the services
already established and accepted by both AGENCY and CITY.
(B) Mr. Davis (or other assigned counselor) will continue to
provide on -the -spot interviews, diagnosis, recommendation,
and referral. Additionally, the counselor will provide a
system of monitoring for the community service hours assigned
by the court; preparation and submittal of requested pre
sentence reports; providing of compliance and /or non -com-
pliance notices to the court; and generally act as an arm
of the court in carrying out its directives.
,(C) AGENCY will provide all of the above services in a con-
fidential and professional manner. Information pertaining
to said defendants shall not be released without the ex-
press written consent of said defendants. The AGENCY is
a state approved agency and as such must conform to the
state and federal guidelines pertaining to confidentiality.
(D) AGENCY will provide said services without regard to race,
color, religion, sex; age, or national origin of any said
defendants.
(E) AGENCY shall not assign or delegate any rights or duties
stipulated in this agreement without express written
approval of CITY.
3. RESPONSIBILITIES OF CITY
(A) The CITY will inform the AGENCY when any regularly
scheduled court date is cancelled or continued; or,
conversely when any additional court date is required.
(B) CITY will provide said counselor with appropriate
interview space within the City Hall to conduct
private, confidential interviews with said court
referred individuals.
4. COMPENSATION
CITY will pay AGENCY for such services the sum of $12.97
per hour of court service by counseling personnel, which
compensation'amounts to one /third of AGENCY expense for
the provision of said counselor's services. Said compen-
sation shall be paid quarterly based on hours of service
rendered on or before the first day of April, 1980, and
thereafter on or before the fifteenth day following the
end of each quarter during the term of this agreement.
Compensation to the AGENCY from the CITY shall not exceed
$4,800 during the term of this agreement.
5. TERMINATION
In the event that either party is dissatisfied with the
performance of the other side in the implementation of
this agreement, the dissatisfied party shall give notice,
in writing, to the other party of the deficiency or defi-
ciencies noted. Thereafter, the other party shall have
30 days in which to correct such deficiency or deficiencies
and during such correction period, the dissatisfied party
will fully cooperate in such correction. In the event such
deficiency or deficiencies are not corrected within the 30
day period specified, said termination shall be effective
30 days from the date of notice of termination, to permit
appropriate disposition of pending cases or files of AGENCY.
.A11 notices herein to be given shall be in writing and
sent by certified mail, return receipt requested and shall
be effective on the date of delivery.
IN WITNESS WHEREOF, the parties hereto have set their hands and
seals the day and year hereinabove first written.
