included in the Revised Six -Year Transportation Program, and
services for the project development phase of the street improvements, and
WHEREAS, Harstad Associates, Inc. have agreed to complete the
Project Development Phase for a sum not to exceed $26,000.

A RESOLUTION OF THE CITY OF TUKWILA, AUTHORIZING
THE MAYOR TO EXECUTE A CONTRACT WITH HARSTAD ASSOC.,
INC. FOR ENGINEERING SERVICES.
WHEREAS, the City Council wishes to proceed with engineering
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
The Tukwila City Council hereby authorizes the Mayor to
execute a contract for Engineering Services with Harstad
Associates, Inc. in an amount not to exceed $26,000.
A copy of said contract is attached hereto and incorporated
herein by reference.

This contract is made and entered into this 44/'day of 17
1980, by and between THE CITY OF TUKWILA, WASHINGTON, a municipal`
hereinafter referred to as the "City and HARSTAD ASSOCIATES, [NC., consulting
engineers, a corporation located in the City of Seattle, Washington, hereinafter
referred to as the "Engineer
WHEREAS, the City desires engineering services for the project development
phase for street improvements of the following described streets:
A. 59th Avenue South from South 147th Street to and along 59th Avenue
South to South 142nd Street and 142nd Street from 59th Ave. South
to 57th Avenue South.
B. South 144th Street from 59th Avenue South to 58th Avenue South.
WHEREAS, the City desires to retain the Engineer for services as described
on the attached Exhibit A, Scope of Work, and
NOW, THEREFORE, in consideration of the mutual promises and covenants
herein contained to be kept, performed and fulfilled by the respective parties
hereto and other good considerations, it is mutually agreed as follows:
A. The City hereby employs the Engineer to perform all work necessary to
accomplish the above.
B. The Engineer hereby accepts such employment and agrees to perform all
of the engineering services necessary to complete the items in accordance
with the attached Scope of Work as authorized by the City.

C. Harstad Associates, Inc., will initiate these services upon receipt of
a fully- executed copy of this Agreement.
D. Payment for all of the above services to the Engineer will be on a
lump sum basis except for those items listed as Time and Expense and
other reimbursible expenses incurred by the Engineer in the pursuance
of the work. Payments will be made monthly on the Engineer's invoice
for percentage of work completed in accordance with the following
schedule.
Project Development Phase $24,721
Payment for time and expense basis will be on an hourly basis in an
amount equal to the Engineer's salary cost times two plus direct ex-
penses incurred in the work. Engineer's salary cost is defined as
the amount of wages or salaries of the Engineer's employees working
on the project plus 35 per cent of such wages or salaries, such as,
but not limited to, workmen's compensation insurance, social security
taxes, State and Federal unemployment insurance, medical, hospital,
insurance, salary continuation insurance and pro rata allowance for
vacation, sick leave and holiday pay.
The Engineer's direct expenses are defined as the necessary costs
incurred in or directly for the project other than the salary cost
(as defined above). Such direct expenses shall be computed on the
basis of actual purchase price for items obtained from commercial
sources and on the basis of usual commercial sources and on the
basis of usual commercial charges for items provided by the Engineer.
Direct expenses shall include, but not be limited to, necessary
transportation costs, including mileage at the rate of 20 per mile
when the Engineer's own automobiles are used, laboratory tests and
analyses, computer services, magnetic card typewriter service,
telephone, printing, binding and multilith charges. When technical

or professional services have been provided by outside sources, as
requested or approved by the City, an additional 10 per cent of the
cost of these services shall be added to cover the Engineer's admini-
strative and continuing project responsibilities.
E. The right is reserved by the City to terminate or suspend this agree-
ment at any time, with or without cause, by giving 15 days' notice to
the Engineer in writing. In that event, all finished or unfinished
documents, data studies, surveys, drawings, maps, models, photographs
and reports or other materials prepared by the Engineer pursuant to
this agreement shall be submitted to the City and the Engineer shall
be entitled to receive just and equitable compensation for all work
completed or in progress on the project prior to the date of suspension
or termination on a time and expense basis.
F. The services under this contract and all duties incidental and necessary
thereto shall be conducted and performed diligently and competently and
in accordance with professional standards of conduct and performance.
G. In all hiring or employment made possible or resulting from this agree-
ment, there shall be no unlawful discrimination against employee or appli-
cant for employment because of sex, age, race, color, creed, national
origin, marital status or the presence of any sensory, mental or physical
handicap, unless based upon a bona fide occupational qualification and
this requirement shall apply to, but not be limited to, the following:
Employment advertising, layoff or termination
Rates of pay or other forms of compensation and selection for
training, including apprenticeship
No person shall be denied or subjected to discrimination in receipt of
the benefit of any services or activities made possible by, or resulting

from, this agreement on the grounds of sex, race, color, creed, national
origin, age, except minimum age and retirement provisions, marital status
or the presence of any sensory, mental or physical handicap.
The Engineer will comply with all City, County, State and Federal
anti discrimination laws, rules, regulations and other requirements
thereof.
Any violation of this provision shall Be considered a violation of a
material provision of this agreement and shall be grounds for cancella-
tion, termination or suspension in all or in part of the agreement by
the City and may result in ineligibility for further agreements with
the City.
H. The City makes no commitment and assumes no obligation for the support
of Engineer's activities, except as set forth in this agreement.
1. Payment by the City or performance by the Engineer shall not be con-
strued as a waiver of any party's rights or remedies against the other.
Failure to require full and timely performance of any provision at any
time shall not waive or reduce the right to insist upon complete and
timely performance of such provisions thereafter.
J. This agreement, together with attachments or addendums, represents the
entire integrated agreement between the parties hereto and supersedes
any negotiations, representations or agreements, either written or
oral, not incorporated herein. This agreement may be amended only
by written instrument signed by both parties hereto.

EXHIBIT A
SCOPE OF WORK
A. Project Development Phase
1. Meet with City to obtain all engineering design requirements,
such as: illumination levels, design speed, wheel chair ramp
requirements, driveway grade requirements, elevation data,
hydraulic design parameters, rockery standards, retaining wall
standards and piping standards. Take pictures of project.
2. Recommend soils consultant to City for borings and soils analysis.
3. Prepare schedule for completion of project engineering.
4. Perform field surveys to obtain information for preparation of
construction drawings. This survey will include:
a. Topography at 1" 20' including: surface improvements,
rockeries, retaining walls, driveways, sidewalks, pavement
locations, curb locations, drainage inlets, catch basins,
valve boxes, trees, shrubs, fences, utility pole locations,
utility vault locations, gas valve locations, fire hydrant
locations, guard rail locations, signing, lighting and steps.
b. Locate existing monumentation, including angles, bearings
and distances and physical location.
c. Locate right -of -way centerline.
d. Location of existing easements.
e. Set horizontal and vertical controls.
f. Mark stationing of centerline of the right-of-way every
50 feet.
g. Do cross sections every 50 feet with right -of -way center-
line elevations and elevations at 20 feet left and right,
including breaks. Prepare drawings at a scale of 1" 10',
both horizontally and vertically.
h. Locate sub surface improvements, including gas lines, storm
lines, sanitary sewer lines, telephone lines, power and water
mains, where possible.

5. Drafting of base sheets showing right of-way lines, lot lines,
existing utilities, driveways, profiles and other improvements.
6. Prepare sketches of two street configuration alternatives and
their rough cost estimates for a meeting with residents. These
alternatives will be ways of improving the street and still keep-
ing the local access character of the street north of 144th Street
and east of 58th Avenue.
7. Submit preliminary sketches to City for approval.
8. Make changes or revisions resulting from City review.
9. Attend meeting with City and residents to discuss roadway alter-
natives and select an alternative.
10. Prepare written summary of meeting with residents.
