WHEREAS, the owners of property in the area within the
boundaries of the former City of Tukwila proposed LID No. 28 have
agreed on the construction of improvements which will be constructed
by means of a new Local Improvement District No. 30; and
WHEREAS, proposed local improvement district No. 28 is no
longer of any force and effect by virtue of the entry of an order of
dismissal in the lawsuit entitled Esping, et al. v. Pesicka, et al.
in the King County Superior Court, Cause No. 810315; and
WHEREAS, on July 7, 1980 Ordinance No. 1169 was passed
creating Local Improvement District No. 30. The period of time
during which protests could be filed has elapsed without sufficient
number having been filed; and
WHEREAS, it is no longer necessary to have a moratorium
on the construction of improvements in the area east of Macadam Road
which uses South 152nd Street for access.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO RESOLVE AS FOLLOWS:
Since there is no longer a need for a legislative
moratorium on the issuance of any building permits
or site preparation permits in the area serviced by
South 152nd Street lying east of Macadam Road, Res-
olution No. 695 is hereby repealed.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
at a regular meeting thereof this /g 0 day of 1980.
