RESOLUTION NO. 805 A RESOLUTION OF THE CITY OF TUKWILA, WASHING-
TON AUTHORIZING THE ADMINISTRATION TO ACCEPT
GRANTS OF EASEMENT FOR CONSTRUCTION AND
MAINTENANCE OF UTILITY LINES WITHIN SHORT
SUBDIVISION 81- 17 -SS.
WHEREAS, The property generally described as Tract 3,
Sunrise View Addition, according to the unrecorded plat thereof, was
approved for a short subdivision into four lots on 21 May 1981 by the
City's Short Subdivision Committee and;
WHEREAS, The Committee!condi:tioned approval of said short
subdivision 81 -17 -SS on the recording of utility construction and
maintenance easements between adjoining lots and;
WHEREAS, The City of Tukwila seeks to be assured that
each lot in Short Subdivision 81 -17 -SS will at all times and despite
their lack of common ownership, be adequately served by utility
facilities.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON DO RESOLVE AS FOLLOWS:
That the administration is hereby authorized to accept
for recordation the easement documents, Exhibits A,B,C., and
D attached to this resolution, and that the City Attorney
is directed to approve same as to form.

TON, at a regular meeting thereof this day of 1981.
For a valuable consideration, receipt of which is hereby acknowledged,
the Grantors, Gerald F. and Linnet E. Robison; (husband and wife), hereby
grant and convey to the Grantee, William and Winnie Boyd, an easement to con-
struct, improve, repair, maintain and replace a sanitary side sewer line not
to exceed six (6) inches in diameter across the east 130 feet of the south
10 feet of Lot 2 of Short Plat Number 81 -17 -SS in the City of Tukwila,
recorded in King County, State of Washington, under Department of Records
and Elections File Number 820120035 together with an easement
across the east 130 feet of the north 10 feet of the south 20 feet of said
lot 2 to improve, repair, maintain and replace a sanitary side sewer line, not
to exceed four (4) inches in diameter, to be connected to the six inch
diameter sanitary side sewer line described above. Which easement shall be
encumbrant upon Lot 1 of said Short Plat.
The Grantors and Grantees, and the future heirs, successors and assigns of
their respective interests, of Lots 1,2,3 and 4 of said Short Plat shall
mutually and reciprocally share in the use and Benefit of the aforesaid
easement, and sanitary side sewer line located therein, and shall mutually
and reciprocally share in the cost of, and responsibility for, maintaining,
repairing,_ improving and replacing said sanitary side sewer line.
The Grantors and Grantees, and the future heirs, successors and assigns of
their respective interests, of lot 2 of said Short Plat, shall construct no
improvements or make any use of the land occupied by said easement that will
interfere with any rights granted herein.
In exercising the rights herein granted, the Grantors and Grantees, and the
future heirs, successors, and assigns of their respective interests, of Lot
1 of said Short Plat, may pass and repass over said easement and may cut and
remove trees or other obstructions which interfere with the aforementioned
side sewer line.
The covenants herein contained shall run with the land and are binding upon
all subsequent owners thereof.
