HomeMy WebLinkAboutRes 0822 - Incorporation Proposal for City of HighlineCITY OF TUKWILA WHEREAS, by Resolution 500, dated October 20, 1975, the City of Tukwila established its Planning Area with boundaries extending beyond the city limits as shown on Exhibit A attached, and WHEREAS, by Ordinance 1039, dated September 19, 1977, the City of Tukwila adopted a Comprehensive Land Use Policy Plan that established land use for this Planning Area, and WHEREAS, these land uses inside and outside the City boundaries were established after extensive communication with the residents, and WHEREAS, the City of Tukwila, by Resolution 627, dated April 17, 1978, has designated to the King County Council that the Tukwila Planning Area represents the City's Sphere of Influence in accordance with King County Motion 3090, adopted June 27, 1977, and WHEREAS, the Planning Area and Sphere of Influence represent a community with strong historic, geographic and social ties, and WHEREAS, unincorporated portions of the Planning Area of the City have been and are currently being considered for annexation to the City of Tukwila, and WHEREAS, the proposed incorporation of the City of Highline, because of its broad legal description, encompasses and overlaps portions of the Planning Area and Sphere of Influence of the City of Tukwila. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO RESOLVE AS FOLLOWS: 1. The City of Tukwila opposes the incorporation of Highline as originally proposed because of conflicts wiith the City's defined Plan- ning Area and Sphere of Influence. 2. The City of Tukwila does not oppose the incorporation of Highline so long as the boundaries of the incorporation are revised to ex- clude our Planning Area and Sphere of Influence. 3. The City elected and appointed officials are authorized and directed to communicate these positions to the Boundary Review Board and other appropriate officials. Vah Dusen, Councilman FOLLOWS: WASHINGTON RESOLUTION NO. 627 CITY OF TUKWI COUNCIL ACTION MEETING AGENDA ACTION TYPE RESOLUTION OF THE CITY OF TUKWILA RELATING TO PLANNING, ENDORSING THE CONCEPT OF JOINT SPHERES OF INFLUENCE, AND URGING ITS ESTABLISHMENT BETWEEN KING COUNTY AND MUNICI- PALITIES LOCATED WITHIN KING COUNTY. WHEREAS, Land use and related development decisions of King County may have a significant impact upon the City of Tukwila and provision for a municipal services and facilities in and adjacent to the City of Tukwila, and; WHEREAS, Some land use and related development decisions of the City of Tukwila may influence development in King County and affect the area -wide planning objectives of King County, and; WHEREAS, Elements of adopted plans, policies or development standards of King County and the City of Tukwila are not in total accord, and; WHEREAS, There presently is no formal means to resolve conflicts in plans, policies and development standards, or development actions based on such plans, policies and standards, and; WHEREAS, Through a joint spheres of Influence program a means may be provided to coordinate and resolve conflicts in the development and planning ob- jectives and plans of the several governmental units affected and King County, which, through motion 3090, adopted June 27, 1977, has declared its intention of imple- menting such a program within King County. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA DOES RESOLVE AS Section 1. Conceptual endorsement of program. The City of Tukwila hereby endorses.the concept of the Joint Spheres of Influence Program and declares its interest and intention to develop and participate in such a program with King County. Section 2. King County urged to procede. King County is urged to undertake the necessary and appropriate action to consider and develop a Joint Spheres of Influence Program as soon as possible for unincorporated King County and participating governmental units therein affected by land use and interrelated development decision within King County, Washington. Section 3. The City Clerk is directed to forward a certified copy of this Resolution to the King County Council, Kina County, Washington. WHEREAS, it is the present practice of municipalities to examine the natural and physical features of that area outside of corporate limits which could have a potential impact on the city, and Preliminary �J September 18, 1975 WHEREAS, planning. for an extended area outside of the corporate limits can simplify future annexations to the city, and WHEREAS, a significant amount of investigation has occurred on what the logical planning area of Tukwila should be as depicted in the document Data Inventory: Tukwila Planning Area 1975, and WHEREAS, there is presently no area officially adopted by the City Council of the City of Tukwila defining the boundaries of the Tukwila Planning Area. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, RESOLVE AS FOLLOWS: Section 1. That the planning area shown on the attached Map A be designated the Tukwila Planning Area which is further generally described as follows: Generally that area between Highway 99 to the west and the Burlington Norther Railroad Tracks to the east, and between South 112th Street (Seattle Transmission Line right -of -way) to the north and South 200th Street to the south. Section 2. As the city grows and expands and its interests broaden, the planning area as herein defined should be reviewed to accurately reflect its sphere of interest. Section 3. That this planning area, as defined, is primarily for information only and will not have any impact upon the area outside of the city limits until such time as the area becomes a part of the city. COUNCIL ACTION MEETING TYPE RM DATE I AGEENDM A I ACTION IT 3 `f 1 /7M 9/6 R �y 9/6 1 b 81v1 9//9 P WHEREAS, R.C.W. 35A.63.061 requires a code city to adopt a comprehensive plan containing at least a land use element and a traffic circulation element and R.C.W. 35A.63.062 provides for the inclusion of other elements deemed of substantial importance; and WHEREAS, the Tukwila City Council has declared that the present comprehensive plan no longer reflects the desires of the community and that a new comprehensive plan be prepared; and WHEREAS, the City Council was involved directly in the establishment of the process by which the new comprehensive land use plan would be prepared and further adopted guiding goals for the citizens, Planning Commission and staff to use in its prepara- tion, as stated in City of Tukwila Resolution 504; and WHEREAS, citizen committees were solicited and used on each of the plan elements and maps; and WHEREAS, the Planning Commission has deliberated on the new comprehensive land use plan extensively and, following public hearings thereon as required by law, did recommend the plan to the City Council for approval; and WHEREAS, the City Council did consider the recommendations of the Planning Commission, citizens and staff and did conduct tours of the area, did conduct public hearings and did make modification to said plan, maps and text; and WHEREAS, an environmental impact statement was prepared on the proposed new comprehensive land use plan pursuant to the State Environmental Policy Act and said statement was made available to the Planning Commission and City Council during their decision delib- erations; and WHEREAS, an environmental questionnaire has been completed on the changes proposed by the City Council and a declaration of non significance made by the Responsible Official for the City of Tukwila; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA DO ORDAIN AS FOLLOWS: SECTION 1. Adoption by Reference. The "Proposed City of Tukwila Comprehensive Land Use Plan" document including all text and maps, as amended, is hereby adopted as though fully set forth herein as the Comprehensive Land Use Plan for the City of Tukwila as required by R.C.W. 35A.63. Said Plan contains an Introduction, a General Goals section, Natural Environment Element (including an environmental base map), Open Space Element, Residence Element, Commerce /Industry Element, Transportation /Utilities Element, Comprehensive Land Use Map, Circu- lation Map and an Historic Sites Map. SECTION 2. Environmental Considerations. The Environmental Impact Statement and Environmental Questionnaire prepared for this Plan were used in the decision deliberations and shall be used by the City administration as a.guiding aid in making interpretations where the Plan itself is found to be vague or ambiguous. SECTION 3. Administration. This document shall be administered by the City's Office of Planning and Community Develop- ment. Any to the document shall be processed through the Planning Commission, with a recommendation forwarded to the City Council following public hearings thereon. Applications for changes to the Plan may be initiated by any affected member of the public or the City administration. SECTION 4. Severability Clause. If any element, section, sub section, sentence, clause, phrase, part or portion of this ordinance, including those portions herein adopted by reference, is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. SECTION 5. Repealer. City of Tukwila Ordinances 347, 484 and 768 are hereby repealed.
