RESOLUTION NO. 864 A RESOLUTION OF THE CITY OF TUKWILA
RELATING TO WATER AND SEWER MAINS IN SOUTHCENTER PARKWAY,
APPROVING ACCEPTANCE THEREOF, AND
AUTHORIZING THE MAYOR TO ACCEPT THE BILL OF SALE
WHEREAS, the City of Tukwila Department of Public Works
required the developers of Center Place, Hayden Island, Inc.,
to provide extensions meeting public standards to the water and
sanitary sewer mains in the Southcenter Parkway right -of -way;
WHEREAS, Hayden Island, Inc. has complied with the City's
requirements and now requests the.acceptance of its dedication
of 715 lineal of 10 inch ductile iron pipe water main and
ma t .A r
150 lineal feet of 8 inch ductile iron pipe sewer main, both
built City standards and built within the existing utility
easements and public right of way;
WHEREAS, Hayden Island, Inc. has provided the City with a
maintenance bond, for the period October 1 1982 to October 1,
1983, guaranteeing the public sewer main and water main systems
at Center Place to be without defects in material or
workmanship.during such period; and
WHEREAS, the Department of Public Works has inspected and
tested the water and sanitary sewer mains in question and found
them to meet or exceed all requirements of the City;
NOW, THEREFORE, the City Council of the City of Tukwila,
Washington, do resolve as follows:
The Mayor is authorized to execute the attached
Bill of Sale with Hayden Island, Inc., accepting
dedication of the water and sanitary sewer mains
PASSED by the Ci y Council of the City of Tukwila,
this day of 1983.
The Grantors, Hayden Island, Inc., for and in consideration
of the sum of One Dollar ($1.00) and other valuable consideration,
receipt of which is hereby acknowledged, do bargain, sell and con-
vey to the City of Tukwila, a municipal coproration of the State of
Washington, for public utility proposes the following described

r% improvements constructed by the Grantor and situated in the City of
r4 Tukwila, County of King, State of Washington, to witt:
r
1. A 715 foot; ten inch (10 ductile iron water line,
C7 constructed within a public utility easement and in

conformance with current City of Tukwila public utility
requirements. Construction details and exact locations
are as noted on the attached As -Built Drawings prepared
by Robert I. Anderson Associates. Dated 1 -22 -82 and
marked Exhibit "A The total construction cost for
the above water line is approximately $18,892.00.
2. A 150 foot, eight inch (8 ductile iron sanitary sewer
line and manhole constructed within a public utility
easement and in conformance current City of Tukwila
public utility requirements. Construction details and
exact locations are as noted in the attached Exhibit "A
The total construction cost for the above sanitary sewer
line is approximately $7,140.00
It is hereby agreed that all special connection charges for the
private utility connections shown on Exhibit "A" are waived in exchange
for the construction and conveyance of the above waterline.
This Bill of Sale is executed and delivered for the purpose of
conveying the above described utilities unto the City of Tukw.i. r

WHEREAS, the said Principal has heretofore entered into a contract with said Obligee dated

Tukwila, WA and;
WHEREAS, the said Principal is required to guarantee the public sewer and water systems
installed under said contract, against defects in materials or workmanship, which may develop during the period
NOW, THEREFORE, THE CONDITION OF THIS OBLIGATION IS SUCH, that if said Principal shall faithfully
carry out and perform the said guarantee, and shall, on due notice, repair and make good at its own expense any
and all defects in materials or workmanship in the said work which may develop during the period
October 1, 1982 to October I, 1983
or shall pay over, make good and reimburse to the said Obligee all loss and damage which said Obligee may sustain
by reason of failure or default of said Principal so to do, then this obligation shall be null and void; otherwise shall
remain in full force and effect.
