PROVIDING FOR THE PAYMENT OF MEDICAL SERVICE BENE-
FITS FOR LEOFF I FIREFIGHTERS FROM THE FIREMEN'S
PENSION FUND ESTABLISHED UNDER CHAPTER 41.16 RCW.
WHEREAS, a Firemen's Pension Fund was established by the
City of Tukwila pursuant to the provisions of Chapter 41.16 RCW
prior to March 1, 1970, and
WHEREAS, a substantial sum of money has accumulated in
the said fund, and
WHEREAS, only five. firefiahters, one who..is now retired, are
eligible to receive any benefits from the said fund, and
WHEREAS, RCW 41.26.150 requires the City to pay a certain
portion of the cost of medical services rendered to LEOFF I fire-
fighters and authorizes the City to pay the same from the Fire-
men's Pension Fund where 'such fund-has been established prior to
March 1, 1970, with the proviso that if the pension fund is
depleted, the City will be required to pay any benefits payable
from the fund, and
WHEREAS, the City Council has determined that there are
sufficient monies in the Firemen's Pension Fund to pay the
employer's portion of the medical service benefits for LEOFF I
firefighters without jeopardizing the ability of the fund to pay
benefits to the five eligible firefighter and that it is desirable
to pay the employer's portion of the medical service benefits
from the Firemen's Pension Fund rather than from other City
funds, now, therefore,
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. Whenever the City, as an employer, is
required by RCW 41.26.150 to make any payment for medical
services rendered to any active or retired LEOFF I firefighter,
such payment, upon approval of a voucher therefore, may be made
from the Firemen's Pension Fund established in the City pursuant
to Chapter 41.16 RCW, or from such other fund in the City budget
as may be appropriate.
