HomeMy WebLinkAboutRes 0954 - Accept Turnover of Storm Sewer Manhole from Normed-Shaw Partnership RESOLUTION NO. 954 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ACCEPTING THE TURNOVER OF A STORM SEWER MANHOLE CONSTRUCTED BY NORMED -SHAW PARTNERSHIP ON CERTAIN PROPERTY ADJACENT TO SOUTH 131ST PLACE. WHEREAS, as part of the development of certain property in the City of Tukwila, commonly known as NorMed Industrial Park Phase I, NorMed -Shaw Partnership' has constructed a storm sewer manhole located on a 10 -foot by 12 -foot strip of property located adjacent to South 131st Place, and WHEREAS, the City has received a request from NorMed Shaw Partnership for acceptance of the storm sewer manhole as a public storm sewer extension and NorMed -Shaw Partnership has furnished the City with a bill of sale, an as -built plan of the manhole and an easement for its construction and maintenance, and WHEREAS, the City Public Works Department has reviewed the storm sewer manhole construction and has determined that the same meets all applicable City standards and specifications and the Department has therefore recommended to the City Council that the same be accepted by the City, and WHEREAS, the City Council has determined that the storm sewer manhole should be accepted by the City as a public storm sewer extension and that the City should assume responsibility for the operation and maintenance of the same, now, therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. Acceptance of Construction, Ownership and Responsibility for Maintenance. Subject to the conditions here- inafter stated, the City Council of the City of Tukwila approves and accepts the turnover of a storm sewer manhole constructed by NorMed -Shaw Partnership in certain property located adjacent to South 131st Place more particularly described in the easement attached hereto as Exhibit "A" and incorporated herein by this reference as if set forth in full. The City Council further approves and accepts the bill of sale dated April 10, 1985, furnished by NorMed -Shaw Partnership to the City. The City does hereby accept ownership of and full responsibility for mainte- nance of the said storm sewer manhole. Acceptance and approval by the City is hereby conditioned upon NorMed -Shaw Partnership furnishing to the City, within fifteen (15) days from the date of passage of this Resolution, a bond or other suitable security in a form approved by the City Attorney and in an amount approved by the Public Works Superintendent, to ensure that such storm sewer manhole will remain free from any and all defects in workmanship and materials for a period of one (1) year from the date this Resolution is passed. This easement is conditional upon Grantees agreement to restore at its expense those areas excavated for installation of utilities and to conduct Grantees activities in a way that will not unreasonably interfere with Grantor's use of the property.
