HomeMy WebLinkAboutRes 0984 - Accept Turnover of Storm Sewer Manhole and Appurtenances from Solly Development TUK WILA WASHINGTON RESOLUTION NO. 984 A RESOLUTION OF THE THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ACCEPTING THE TURNOVER OF A STORM SEWER MANHOLE AND APPURTENANCES CONSTRUCTED BY SOLLY DEVELOPMENT COMPANY ON THE EAST SIDE OF 52ND AVENUE SOUTH WHEREAS, as part of the development of certain property in the City of Tukwila, commonly known as the Parkside Building, Solly Development Company has constructed a storm sewer manhole located on certain property adjacent to 52nd Avenue South, and WHEREAS, the City has received a request from Solly Development Company for acceptance of the storm sewer manhole as a public storm drainage facility and Solly Development Company has furnished the City with a bill of sale, an as -built plan of the storm sewer manhole and an easement for its construction, reconstruction and maintenance, and WHEREAS, the City Public Works Department has reviewed the storm sewer manhole construction and has determined that the same meets all applicable City standards and specifications and the Department has therefore recommended to the City Council that the same be accepted by the City, and WHEREAS, the City Council has determined that the storm sewer manhole should be accepted by the City as a public storm drainage facility and that the City should assume responsibility for the operation and maintenance of the same, now, therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON HEREBY RESOLVE AS FOLLOWS Section 1 Acceptance of Constuction, Ownership and Responsibility for Maintenance The City Council of the City of Tukwila approves and accepts the turnover of a storm sewer manhole constructed by Solly Development Company in certain property located adjacent to 52nd Avenue South and more particularly described in the easement attached hereto as Exhibit A and incorporated herein by this reference as if set forth in full. The City Council further approves and accepts the bill of sale dated September 12, 1985 furnished by Solly Development Company to the City. The City does hereby accept ownership of and full responsibility for maintenance of the said storm sewer manhole. For and in consideration of one dollar ($1.00) and other valuable considera- tions, the receipt of which is hereby acknowledged, grants and conveys to GRANTEES, CITY OF TUKWILA, King County, Washington, a Municipal Corporation, an easement and right -of -way, situated in King County, Washington, to wit: LEGAL DESCRIPTION FOR 52nd Avenue South- EASEMENT FOR STORM MANHOLE. A PORTION OF THE SOUTH 51 FEET OF TRACT ONE OF THE BROOKVALE GARDEN TRACTS LYING EASTERLY OF 52nd AVENUE SOUTH TOGETHER WITH THE NORTH 140 FEET OF TRACT 2 A OF THE BROOKVALE GARDEN TRACTS LYING EASTERLY 52nd AVENUE SOUTH AS PER PLOT RECORDED IN VOLUME 10 OF PLOTS, ON PAGE 47, RECORDS OF KING COUNTY, SITUATE IN THE CITY OF TUKWILA, COUNTY OF KING, STATE OF WASHINGTON, DESCRIBED AS FOLLOWS: COMMENCING AT THE NORTHWEST CORNER OF ABOVE REFERENCED PLOT THENCE SOUTH Or 31'00" WEST 107 FEET; THENCE EAST 12'; THENCE SOUTH 15'; THENCE WEST 12'; THENCE NORTH 01 EAST 15'. SUBJECT TO EASEMENTS OF RECORD For the purpose of constructing, reconstruction, replacing, repairing, maintaining and operating a storm man -hole structure and all necessary connections and appurtenances thereto, together with the right of ingress thereto and egress therefrom for the purpose of enjoying the easement, and also granting to Grantees and to those acting under or for Grantees the use of such additional area to be held to a min- imum necessary for that purpose, and immediately after the completion of the construction and installation, or any subsequent entry upon the easement, Grantees shall restore the premises as near as may be to its condition immediately before such construction of entry.
