A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, ACCEPTING THE TURNOVER OF SIDEWALKS, CURBS,
GUTTERS, ASSOCIATED DRAINAGE AND UTILITY RELOCATIONS
ADJACENT TO TUKWILA PARKWAY, ANDOVER PARK EAST AND EVANS
BLACK DRIVE CONSTRUCTED BY OFFICE AND WAREHOUSE PROPERT-
IES, INC.
WHEREAS, as part of the development of certain property in
the City of Tukwila, Office and Warehouse Properties, Inc. has
constructed sidewalks, curbs, gutters, associated drainage and
utility relocations adjacent to Tukwila Parkway, Andover Park East
and Evans Black Drive, and
WHEREAS, the City has received a request from Office and
Warehouse Properties, Inc. for acceptance of the improvements as
public facilities and Office and Warehouse Properties, Inc. has
furnished the City with a bill of sale and an as -built plan of the
improvements, and
WHEREAS, the City Public Works Department has reviewed the
construction and has determined that the same meets all applicable
City standards and specifications and the Department has therefore
recommended to the City Council that the same be accepted by the
City, and
WHEREAS, the City Council has determined that the
improvements should be accepted by the City as public facilities
and that the City should assume responsibility for the operation
of the same, now, therefore,
THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY
RESOLVE AS FOLLOWS:
Section 1. Acceptance of Construction, Ownership and
Responsibility for Maintenance. The City Council of the City of
Tukwila hereby approves and accepts the turnover of approximately
1150 lineal feet of six foot wide concrete sidewalk, 1160 lineal
feet of concrete curb and gutter, five driveway aprons and
associated drainage and utility relocations adjacent to Tukwila
Parkway, Andover Park East and Evans Black Drive in the City of
Tukwila, as constructed by Office and Warehouse Properties, Inc.
and as listed on the bill of sale on file with the City's Public
Works Department. The City Council further approves and accepts
the bill of sale furnished to the City by Office and Warehouse
Properties, Inc. The City does hereby accept ownership and full
responsibility for maintenance of the said improvements.
Acceptance and approval by the City is hereby conditioned upon
Office and Warehouse Properties, Inc. furnishing to the City,
within fifteen (15) days from the date of passage of this
Resolution, a bond or other suitable security in a form approved
by the City attorney and an amount approved by the Public Works
Director, to insure that such improvements will remain free from
any and all defects in workmanship and materials for a period of
one (1) year from the date this Resolution is passed.

SIDEWALK AND UTILITY EASEMENT` I
CITY OF TUKWILA
THE GRANTOR DAVID A. SABEY
for valuable consideration, hereby grants and conveys to the CITY
OF TUKWILA, a municipal corporation of the State of Washington,
the perpetual right, privilege, authority and easement to use and
occupy the following described real property, situated in King
County, State of Washington, including any after acquired title
or interest per the attached asbuilt plan "Exhibit A
That portion of Tract 3, of the` Plat of ANDOVER INDUSTRIAL PARK
NO. 1, according to the plat recorded in Volume 66 of Plats,
Page 36, in King County, Washington;
EXCEPT any portion thereof, conveyed to the City of Tukwila by
Statutory Warranty Deed recorded under Auditor's File No.
7202140588; lying Northerly and Easterly of the following

the West line thereof South 0 °12 East 10.04 feet to the True
10 Point of Beginning; thence North 84 °44 East 525.50 feet;

Grantor reserves the right to use the easement for any purpose
not inconsistent with the rights herein granted, provided: That
Grantor shall not construct or maintain any building or other
structure on the easement which would interfere with the exerr.i_se
of the rights herein granted including ingress and egress to and
from the easement area.
