HomeMy WebLinkAboutRes 1004 - Accept Turnover of Developed Portion of 57th Avenue South from Western Pacific Properties RESOLUTION NO. 1004 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ACCEPTING THE TURNOVER OF THE DEVELOPED PORTION OF 57TH AVENUE SOUTH WEST OF INTERURBAN AVENUE SOUTH, INCLUDING ROADWAY, STORM SEWER AND ASSOCIATED PUBLIC IMPROVEMENTS, CONSTRUCTED BY WESTERN PACIFIC PROPERTIES, INC. WHEREAS, as part of the development of certain property in the City of Tukwila, Western Pacific Properties, Inc. has constructed approximately 270 lineal feet of roadway commonly known as 57th Avenue South running south and southwesterly from the intersection of Interurban Avenue South, and WHEREAS, the City has received a request from Western Pacific Properties, Inc. for acceptance of the roadway, storm sewer and associated public improvements as public facilities and Western Pacific Properties, Inc. has furnished the City with a bill of sale and an as -built plan of the improvements proposed to be dedicated to the City, and WHEREAS, the City Public Works Department has reviewed the construction of the improvements and has determined that the same meets all applicable City standards and specifications and the Department has therefore recommended to the City Council that the same be accepted by the City, and WHEREAS, the City Council has determined that the improvements should be accepted by the City as public facilities and that the City should assume responsibility for the operation and maintenance of the same, now, therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY RESOLVE AS FOLLOWS: Section 1. Acceptance of Construction, Ownership and Responsibility for Maintenance. The City Council of the City of Tukwila approves and accepts the turnover of approximately 270 lineal feet of roadway, storm sewer and associated public improvements constructed by Western Pacific Properties, Inc. commonly known as 57th Avenue South running southerly and southwesterly from the intersection of Interurban Avenue South. The City Council further approves and accepts the bill of sale furnished by Western Pacific Properties to the City. The City does hereby accept ownership and full responsibility for maintenance of the said roadway, storm sewer and related improvements. Acceptance and approval by the City is hereby conditioned upon Western Pacific Properties, Inc. furnishing to the City, within fifteen (15) days from the date of passage of this Resolution, a bond or other suitable security in a form approved by the City Attorney and in an amount approved by the Public Works Director, to insure that such improvements will remain free from any and all defects in workmanship and materials for a period of one (1) year from the date this Resolution is passed.
