HomeMy WebLinkAboutRes 1033 - Accept Turnover of Water Line from NC Machinery ILA 1906 CITY OF TUKWILA WASHINGTON RESOLUTION NO. 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASH., ACCEPTING THE TURNOVER OF A WATER LINE, CONSTRUCTED BY N.C. MACHINERY ON THE WEST VALLEY HIGHWAY. WHEREAS, as part of the development of certain property in the City of Tukwila located at 17035 West Valley Highway, N.C. Machinery Co. has constructed a water line, and WHEREAS, the City has received a request from Lee W. Cagle, Senior Vice President of N.C. Machinery Co. for acceptance of the water line, and N.C. Machinery Co. has furnished the City with a bill of sale, an as -built plan of the improvements and an easement for their maintenance, and WHEREAS, the City Public Works Department has reviewed the construc- tion and has determined that the same meets all applicable City standards and specifications, and the Department has, therefore, recommended to the City Council that the same be accepted by the City, and WHEREAS, the City Council has determined that the water line should be accepted by the City as public improvements, and the City should assume responsibility for the operation and maintenance of the same. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO HEREBY RESOLVE AS FOLLOWS: Section 1: Acceptance of Turnover, Ownership and Responsibility for Maintenance. The City Council of the City of Tukwila approves the turnover of' a water line constructed by N.C. Machinery Co. on and adjacent to certain pro- perty located at 17035 West Valley Highway, Tukwila, together with an easement for maintenance of this improvement furnished by N.C. Machinery Co. The City Council further approves and accepts the bill of sale and easement agreement furnished by N.C. Machinery Co. to the City. The City does hereby accept ownership of and full responsibility for maintenance of the said improvements. Resolution No. 1p3_' EASEMENT AGREEMENT l v 3 3 This easement agreement is made on this /O h day of 198j7, between Northern Commercial Co. (dba N C Machinery Co.) a Washington corporation hereafter called N C and the City of Tukwila, Washington, a municipal body. 1. Recitals A. The grantor owns certain real property located at 17025 and 17035 West Valley Highway, Tukwila, Washington. N C's ownership is pursuant to a Quit Claim Deed dated September 20, 1960 and recorded in Vol. 4497, page 552 of the King County Auditor. This property is described as follows: LEGAL DESCRIPTION That portion of Government Lot 6 and that portion of Government Lot 3, Section 25, Township 23 North, Range 4 East, W. M., King County, Washington, lying westerly of the westerly margin of Secondary State Highway No. 181 (West Valley Road) and southerly of the following described line: Beginning at the center of said Section 25; thence westerly along the east and west centerline of said section 897.56 feet to the center- line of the main track of the Chicago, Milwaukee, St. Paul and Pacific Railroad Company and the Oregon Washington Railroad and Naviga- tion Company right -of -way; thence along said centerline South 2 40' East 517.40 feet; thence North 46 27' -30" West 505 feet, more or less, to a point on the west side of Secondary State Highway No. 181 (West Valley Road) as now established which is the true point of beginning of the line herein described; thence continuing North 46 27' 30" West 615 feet, more or less, to the westerly line of said Government Lot 3 and the terminus of the line herein described. Situated in the City of Tukwila, County of King, State of Washington. B. The Grantor has constructed a curb and sidewalk along SR 181 also known as West Valley Road. The construction was pursuant to permit CCAS -85 -86 issued by the City of Tukwila May 6, 1986. C. The Grantor has installed a watermain extension also along SR 181 also known as West Valley Road. This construction was pursuant to permit WME -40 -86 issued by the City of Tukwila March 24, 1986. D. The Grantor desires to provide a 20 foot easement along its Eastern property line to the City of Tukwila for the purpose of access to and maintenance of, the sidewalk and the watermain extension. Now, therefore, the parties hereto agree as follows: 2. Conveyance In consideration of Ten Dollars ($10.00) in hand paid and other good and valuable consideration, N C hereby conveys to the City of Tukwila an easement over, under and across the property below described for the purpose of maintaining the newly installed sidewalk and watermain extension. The easement being particularly described as follows: The easterly 20' of that portion of Government Lot 6 and that portion of Government Lot 3, Section 25, Township 23 North, Range 4 East, W. Owner Warranty N C warrants ownership of the tract described and the unrestricted right to execute and deliver this instrument. 4. Hold Harmless The grantee covenants as follows: That it will cause all works and things hereby authorized to be done by it upon or affecting said premises to be done and performed in a good and workmanlike manner; that it will cause no unnec- essary damage or disturbance to said premises; that it will keep N C, its successors and assigns indemnified against all actions, .claims and demands that may lawfully be brought or made by reason of anything done by the City of Tukwila in the exercise of the rights and privileges herein granted. 5. Successors and Assigns This agreement shall be binding upon and inure to the benefit of the successors, assigns, personal representatives, executors and heirs of the Grantor and the Grantee.
