HomeMy WebLinkAboutRes 1048 - Lid #30 (Local Improvement District) - Segregate Assessments 1906' CITY OF TUKWILA WASHINGTON RESOLUTION NO. 1048 0042.090.008 JEH /gg 07/16/87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ORDERING THE SEGREGATION OF ASSESSMENTS BETWEEN PARCELS 9 AND 11 OF LID 30. WHEREAS, Ordinance No. 1248 of the City of Tukwila, passed by the City Council on March 23, 1982, approved a final assessment roll for the City's Local Improvements District No. 30, and WHEREAS, said ordinance set the final assessment amount for Parcel 9 at $27,973.37 and for Parcel 11 at $16,368.88, and WHEREAS, Graydon Smith and Marlys M. Smith, the Owners of Parcels 9 and 11 of LID 30, obtained Boundary Line Adjustment No. 86- 21 -BLA from the City in May, 1986 which changed the boundary line between Parcels 9 and 11, and WHEREAS, Graydon Smith and Marlys M. Smith are in the process of selling Parcel 11 and have applied to the City for segregation and reallocation of assessments between Parcels 9 and 11 which is based upon the adjusted boundary line, and WHEREAS, RCW 35.44.410, authorizes the City Council to make such segregation provided that certain charges are paid and that by such segregation the security of the lien for the assessments will not be jeopardized, now, therefore, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY RESOLVE AS FOLLOWS: Section 1. Assessment of Parcel 9. The assessment of $27,973.37 levied against Parcel 9 in LID 30 by Ordinance No. 1248 of the City, which parcel is legally described as originally assessed on Exhibit A attached hereto and incorporated herein by this reference as if set forth in full, is hereby segregated and reallocated to the parcel which is legally described on Exhibit B and incorporated herein by this reference as if set forth in full. The parcel described on Exhibit B shall hereafter be known as Parcel 9 of LID No. 30. The assessor's Tax Lot No. for said parcel is 115720- 0380 -05. Section 2. Assessment on Parcel 11. The assessment of $16,368.88 levied against Parcel 11 in LID 30 by Ordinance No. 1248 of the City, which parcel is legally described as originally assessed on Exhibit C attached hereto and incorporated herein by this reference as if set forth in full, is hereby segregated and reallocated to the parcel which is legally described on Exhibit D and incorporated herein by this reference as if set forth in full. The parcel described on Exhibit D shall hereafter be known as Parcel 11 of LID No. 30. The assessor's Tax Lot No. for set parcel is 115720 0387 -08. Section 3. Findinqs by City Council. The City Council finds that the segregation and reallocation authorized by -1- JEH00190R Sections 1 and 2 does not result in the total of the segregated parts of the assessments being less than the assessments before segregation. The City Council also finds that the security of the lien for the LID 30 assessments will not be jeopardized by the segregation and reallocation. Section 4. Duties of Finance Director. The Finance Director is hereby authorized and directed to make any necessary changes to the assessment roll approved by Ordinance No. 1248 to accomplish the above described segregation and reallocation of assessments and to use the segregated and reallocated assessments in computing all future installment payments and interest relating to the assessments in the above described parcels. The Finance Director is also authorized and directed to forward a certified copy of this resolution to the County Assessor and Treasurer so that the segregation and reallocation of assessments can be noted in the County records for collection purposes.
