RESOLUTION NO. 1142
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUKWILA, WASHINGTON, FIXING THE TIME FOR A
PUBLIC HEARING UPON A PETITION FOR VACATION
OF CERTAIN PUBLIC RIGHT -OF -WAY WITHIN THE CITY
OF TUKWILA GENERALLY DESCRIBED AS A PORTION
OF 37TH AVE. SO. NORTH OF SOUTH 126TH STREET.
WHEREAS, the Sabey Corp. and Security Pacific Bank have filed a petition with the
City Clerk for vacation of certain right -of -way generally described as all that existing 40 foot
right -of -way for 37th Ave. South lying between blocks 7 and 8 of the Plat of Riverton, a
replat as filed in Volume 13 of plats, page 36, records of said County, and lying north of the
northerly margin of South 126th Street, and
WHEREAS, the City Clerk has determined that said petition was signed by the
owners of more than two- thirds of the property abutting the right -of -way sought to be
vacated, and
WHEREAS, in accordance with RCW 35.79.010, the City Council will hold a public
hearing for the purpose of considering said petition for right -of -way vacation.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO HEREBY RESOLVE AS FOLLOWS:
Section 1. A public hearing upon the petition of Sabey Corp. and Security Pacific
Bank for vacation of certain public right -of -way generally described as all that existing 40
foot right -of -way for 37th Ave. So. lying between blocks 7 and 8 of the Plat of Riverton, a
replat as filed in Volume 13 of plats, page 36, records of said County and lying north of the
northerly margin of South 126th Street, together with that portion of said 37th Ave. So. lying
within a 45 foot radius cul -de -sac generally located in the area of lots 8 and 9, said block 7
and lots 26 and 27, said block 8. The north margin of the above described cul -de -sac being
the northerly limits of this vacation, shall be held before the Tukwila City Council in the City
Council Chambers at Tukwila City Hall, 6200 Southcenter Blvd., Tukwila, Washington, at
7:00 p.m. or as soon thereafter as the matter may be heard on May 29, 1990, which is not
less than twenty (20) nor more than sixty (60) days from the date of passage of this
resolution, at which time all persons interested in said right -of -way vacation are invited to
appear and be heard.
Section 2. The City Clerk is directed to post written notice of pendency of the public
hearing in three public places in the City of Tukwila and in one additional conspicuous place
on the right -of -way sought to be vacated at least twenty (20) days prior to the date set for
hearing.
