HomeMy WebLinkAboutRes 1157 - Green River Flood Control Zone District (GRFCZD) ILA 6. 908 CITY OF TUKWILA WASHINGTON RESOLUTION NO. 1157 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWH A, WASHINGTON, REQUESTING THE KING COUNTY COUNCIL TO ACTIVATE THE GREEN RIVER FLOOD CONTROL ZONE DISTRICT GRFCZD) FOR THE PURPOSE OF FUNDING FLOOD CONTROL ACTIVITIES WITHIN THE AUTHORITY OF THE DISTRICT AS ESTABLISHED PURSUANT TO THE REVISED CODE OF WASHINGTON, TITLE 86, SECTION 15. WHEREAS, the City of Tukwila has approved formation of the GRFCZD as set forth in King County Resolution No. 31058, dated December 7, 1965 and WHEREAS, the King County Council has subsequently authorized the formation of the GRFCZD by approval of King County Resolution No. 31192, dated January 10, 1988, and WHEREAS, King County has constructed the P -1 and P -17 pump stations on the Green River in accordance with the District's Comprehensive Plan, and WHEREAS, King County continues to operate and maintain the P -1 and P -17 pump plants, and WHEREAS, a number of river protection revetments and flood control levees have been constructed within the District in accordance with the District's Comprehensive Plan, and WHEREAS, a continuing need exists for maintenance of these revetments and levees, together with existing river banks and the Green River channel itself, and WHEREAS, the City of Tukwila is signatory to the June 15, 1985, Green River Management Agreement (GRMA), and WHEREAS, a Green River Levee Improvement Plan recommending a phased program of improvements to the Green River flood control levees has been formulated and approved pursuant to the terms and provisions of the GRMA, and WHEREAS, said levee improvements will require maintenance in perpetuity to assure their structural integrity and function, and WHEREAS, it is deemed in the best interest of the City of Tukwila to request activation of the District for these purposes. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO HEREBY RESOLVE AS FOLLOWS: The City of Tukwila requests the King County Council to activate the GRFCZD and authorize a special tax to be levied annually on all properties within the GRFCZD, with annual revenues thus realized to be expended solely within the boundaries of the District. The share that is generated in the county -wide river improvement levee by the properties within the Green River Valley Flood Control Zone District will be generally set aside for capital improvements in that area as follows: (a) continuing maintenance of the Green River channel, riverbanks, revetments, and levees; (b) continuing maintenance and operation of the P -1 and P -17 pump plants, and of any flood control outlet improvements subsequently constructed to serve the Mill Creek drainage(s) and; (c) operational and administrative costs of the annual Green River Basin Program related to the Flood Warning Program, the Pump Operations Procedures Plan, and the Basin Technical and Executive Committees; and (d) any other related works and operations as expressly authorized in annual District budgets which have been approved by the Green River Basin Executive Committee. C7 2 A RESOLUTION expanding the purpose of the District; adopting 3 a 1991 program and budget for District activities; authorizing an ad valorem property tax levy; authorizing the disbursement 4 of funds as indicated in the budget, including the payment of interest for necessary borrowing; and designating t King 5 County Department of Public Works, Surface Water Management Division as the responsible agency. 6 7 PREAMBLE 8 1. The Green River Flood Control Zone District (hereinafter referred to 9 as the District) was created by Resolution 31192 of the King County Board of 10 Commissioners in January 1966 pursuant to the provisions of Chapter 86.15 RCW 11 for the purpose of providing for the flood control needs and requirements 12 within the District. 13 2. The District boundary established by Resolution 31058 of the Board 14 of Commissioners generally follows the drainage boundary for the lower 15 Green River watershed between Auburn and Tukwila encompassing approximately 16 44,000 acres. 3. The District includes portions of unincorporated King County 17 18 the Cities of Auburn, Des Moines, Federal Way, Kent, Renton, SeaTac, and Tukwila. At the time the District was formed in 1966, there were only four 19 cities within its boundaries and they formally indicated their approval of 20 its formation pursuant to the requirements of RCW 86.15.040. 21 4. In accordance with the provisions of RCW 86.15.050, the King 22 County Council sits as the Board of Supervisors of the District. 23 5. By interlocal agreement, King County and the Cities of Auburn, 24 Kent, Renton, and Tukwila have jointly participated in the Green River 25 Basin Program (GRBP) since its inception in 1978 and have all adopted the 26 1985 Green River Management Agreement which jointly funds comprehensive 27 plans and studies to deal with drainage and flood control problems in the 28 lower Green River Valley. 29 30 31 32 1 7 2 6. The Green River Basin Technical Committee (BTC) and Basin 3 Executive Committee (BEC), created under the GRBP to provide technical and 4 policy advice, have recommended that the District fund river and pump 5 station operation and maintenance costs and work associated with the GRBP 6 in a letter to the Board of Supervisors dated November 14, 1990. This 7 action has been endorsed by Resolutions of the Cities of Kent (August 21, 8 1990), Renton (October 8, 1990), Tukwila (October 15, 1990), and a letter 9 from the Mayor of the City of Auburn (October 22, 1990). Information and 10 briefings on the District and its purpose have been provided to the other 11 cities within the District; namely, Des Moines, Federal Way, and SeaTac 12 during the months of September and October 1990. 13 7. The proposal for the District to fund the annual operation and maintenance of the Green River levee and pump station systems was discussed 14 15 at a public meeting in Kent during October 1990. FINDINGS: 16 1. The Board of Supervisors finds that maintaining the Green River 17 levee and pump station system is necessary and is most effectively and 18 beneficially conducted through the powers and financial capabilities vested 19 in the District. 20 2. The Board finds that the service area for the District remains as 21 the lower Green River drainage basin as described in King County 22 Resolution 31058, Exhibit A, which is attached hereto and incorporated by 23 reference herein. 24 3. The Board finds that the function and purpose of the District as 25 described in King County Resolution 31192 need to be expanded to clarify 26 the District's authority and responsibility for the program established in 27 Section 4 of this Resolution. 28 4. The Board finds that it is important to continue the practice of 29 coordinating flood control activities in the drainage basin including the 30 development of the annual work programs and budgets for the District with 31 the Green River Technical and Executive committees. 32 -2- -7 BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE GREEN RIVER FLOOD 1 CONTROL ZONE DISTRICT: 2 Section 1. Definitions. 3 A. Division. The King County Surface Water Management Division as 4 defined in King County Code 2.16.040. 5 B. Green River Levee System. Facilities designed to contain and 6 control river flows within the boundaries of the District lying within 7 easements or tracts granted and conveyed to King County, including but not 8 limited to levees, revetments, and riverbanks. 9 C. Green River Pump Stations. Facilities otherwise known as the P -1 10 and P -17 pump plants, designed to either store runoff for a period of time 11 or discharge it into the Green River when river channel capacity can 12 accommodate those discharges lying within easements or tracts granted and 13 conveyed to King County. 14 D. Green River Basin Program (GRBP). A program enacted in 1978 by 15 interlocal agreement between King County and the Cities of Auburn, Kent, 16 Renton, and Tukwila for the purpose of jointly planning and coordinating 17 activities over flood control and drainage management of the Green River. 18 E. Maintenance and Operation. The act or process of operating, 19 cleaning, repairing, or re- establishing a levee system or pump station 20 facility to meet an operational performance standard, including but not 21 limited to inspections, brushing, debris and silt removal, rock 22 replacement, revegetation, access road restoration, replacement of pump 23 facilities, general grounds /facilities maintenance and emergency 24 maintenance. 25 F. Improvement. The act of design and construction of a new or 26 expanded project or works providing flood control, including major 27 reconstruction of an existing levee or pump plant facility. 28 G. Green River Flood Control Zone District. A Flood Control Zone 29 District created by King County Resolution No. 31192 whose boundaries are 30 described in King County Resolution No. 31058, Exhibit A. 31 32 -3- 1 Section 2. Authority. 2 The program and responsibilities herein created shall be administered 3 by the King County Department of Public Works, Surface Water Management 4 Division (the Division) acting as the County Engineer as specified in 5 RCW 86.15.060. 6 Section 3. Purpose. 7 The purpose of the District shall be expanded to exercise those 8 general flood control powers authorized by RCW 86.15.080 to protect life 9 and property within the District from floodwater damage and to authorize a 10 method of generating revenues sufficient to carry out annual programs 11 prescribed in adopted budgets. 12 Section 4. 1991 Program. 13 A. The 1991 program for the District is established by the Board to include th•e maintenance and administration as follows: 14 1. Maintenance and Operation. The District shall be responsible 15 for maintenance and operation of the Green River levee system and the Green 16 17 River pump stations as defined in Section 1. The cost assigned to this 18 category shall include the full expense for providing the service and coordination of these activities with the GRBP cities. A current inventory 19 20 of levee and pump station facilities authorized for maintenance shall be maintained on file with the Department of Public Works. New levee and pump 21 station facilities constructed by King County or incorporated cities and 22 towns within the District can be added to the facility inventory for 23 maintenance and operation provided that they are approved by the Division. 24 2. Overhead and Administration. The District administration 25 responsibilities shall include the following: 26 a. coordinate activities related to the Green River Basin 27 Program and administrative support of the BTC and BEC. 28 b. prepare a comprehensive plan for flood control for the 29 District. 30 31 32 4 1 c. seek renewal of the existing Green River Basin Program 2 agreement between King County and cities in the District to continue 3 cooperative flood control efforts in the basin. 4 d. seek the advice and support of the cities in the District 5 on proposed annual work programs and budgets. 6 e. prepare annual budgets, work programs and coordinate 7 support of the cities in the District on proposed annual work programs and 8 budgets. 9 The cost assigned to this category shall include the full cost for 10 providing administrative services. 11 B. The cost and expense of other programs and activities not 12 expressly identified herein may be funded and implemented by the District, 13 provided they are consistent with the provisions of RCW 86.15, Section 3 of this Resolution, and are approved by the Board. 14 Section 5. 1991 Budget. ►5 A. The Board finds that the budget summarized below has been prepared 16 consistent with the requirements of RCW 86.15.140 and is sufficient to 17 carry out 1991 Program activities defined in Section 4 of this Resolution. 18 Overhead and Administration $107,894 19 Maintenance and Operation 232,183 ?0 Construction and Improvements 0 ?1 Bond Retirement and Interest 0 ?2 Reserve 109,923 ?3 $450,000 ?4 ?5 B. The Board hereby authorizes a property tax levy on all parcels ?6 within the District subject to the levy, to generate revenue sufficient for !7 the 1991 program. !8 Section 6. Green River Flood Control Zone District Fund. !9 All taxes shall be deposited in the Green River Flood Control Zone s0 District Fund in the King County Office of Financial Management to be used 11 only for the cost and expense of carrying out the responsibilities of the 12 5 C�2 1 District as defined in Section 3. Authorization is hereby granted to 2 disburse up to the total budget amount indicated in Section 6.A., including 3 the payment of interest for any necessary borrowing to operate the District 4 until tax revenues are available. Monies in said fund not needed for 5 immediate expenditure shall be invested for the benefit of the Green River 6 Flood Control Zone District Fund, pursuant to the first paragraph of 7 RCW 36.29.020. For investment purposes, the Director of the King County 8 Department of Public Works is hereby designated the fund manager. 9 Section 8. Billing Procedure. 10 A. All property subject to taxes of the District shall be billed on the annual King County property tax statement for the parcel and shall be 11 12 mailed to the name and address shown on the real property tax roll at the 13 time annual property tax bills are prepared. 14 B. The total amount of the tax shall be due and payable to the i Finance Manager of the King County Office of Financial Management on or 15 before the 30th day of April, and shall be delinquent after than date; 16 however, if one -half of such tax is paid on or before the said 30th day of 17 April, the remainder shall be due and payable on or before the 31st day of 18 October and shall be delinquent after that date. 19 20 21 22 23 24 25 26 27 28 29 30 31 32 -6- 1 Section 9. Severability.
