RESOLUTION NO. 1173 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUKWILA, WASHINGTON, FIXING THE TIME FOR A
PUBLIC HEARING UPON A PETITION FOR VACATION
OF CERTAIN PUBLIC RIGHT -OF -WAY WITHIN THE
CITY OF TUKWILA GENERALLY DESCRIBED AS
PORTIONS OF 42ND AVE. SO., SO. 114TH ST., AND SO.
115TH ST.
WHEREAS, Hellstrom and Dillon Properties, D.A. Johnston and A.G. Harmon, Jack
Shevham, Albert L. Gaviglio, and Mrs. Helen Dingle have filed a petition with the City Clerk for
vacation of certain right -of -way generally described as portions of 42nd Ave. So., So. 114th St.,
and So. 115th St., and
WHEREAS, the City Clerk has determined that said petition was signed by the owners
of more than two thirds of the property abutting the right -of -way sought to be vacated, and
WHEREAS, in accordance with RCW 35.79.010, the City Council will hold a public
hearing for the purpose of considering said petition for right -of -way vacation.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO HEREBY RESOLVE AS FOLLOWS:
Section 1. A public hearing upon the petition of Hellstrom and Dillon Properties, D.A.
Johnston and A.G. Harmon, Jack Shevham, Albert L. Gaviglio, and Mrs. Helen Dingle for
vacation of certain public right -of -way generally described as that portion of 42nd Ave. So. lying
between the boundary of So. 115th St. and the Northern Pacific Railroad property, and that
portion of So. 114th St. lying between the boundaries of 42nd Ave. So. and the Northern Pacific
Railroad property, and that portion of So. 115th St. lying between the boundaries of 42nd Ave.
So. and the Northern Pacific Railroad property, as per plat of C.D. Hillman's Meadow Garden's
Addition Division No. 3 recorded in Volume 12 of plats, Page 86, Records of King County,
Washington, shall be held before the Tukwila City Council in the City Council Chambers at
Tukwila City Hall, 6200 Southcenter Blvd., Tukwila, Washington, at 7:00 p.m. or as soon
thereafter as the matter may be heard on March 4, 1991, which is not less than twenty (20) nor
more than sixty (60) days from the date of passage of this resolution, at which time all persons
interested in said right -of -way vacation are invited to appear and be heard.
Section 2. The City Clerk is directed to post written notice of pendency of the public
hearing in three public places in the City of Tukwila and in one additional conspicuous place on
the right -of -way sought to be vacated at least twenty (20) days prior to the date set for hearing.
