There is hereby granted by the Town of Tukwila to The Pacific Telephone Telegraph Compamy its successors and assigns, the right and privilege to do a general telephone and telegraph 'business within said Town of U%Ikwila-and to place, erect, l ay, maintain and operate in and-under the streets and alleys avenues, thoroughfares and public highways within the said town, poles, wires and other appliances, and conductors for the transmission of electricity for telephone and telegraph purposes. Such wires and other appliances and con- ductors may be strung uponn poles or other fixtures above ground, or at the option Of the grantee, its successors and assigns, may be laid underground in pipes or conduits or otherwise protected, and. such other apparatus may be used as may be necessary or proper to operate and maintain the -same., ar- Section 2. It,shall be lawful for said The Pacific Telephone Telegraph Company, its successors and assigns to make all needful excavations in any of such streets, alleys, avenues, thoroughfares and public highways in said :town for the purpose of placing, erecting, laying and poles, or other supports or conductors for said wires or repairing, renewing or replacing the same* .Said work shall be done in compliance with the-necessary rules, regulations, Ordinances or orders, which may during the continuance of Ohis franchise tie adopted from time to time by the Town of Tukttila.l Section 3. Whenever The_Paosfic Telephone and 'Telegraph Company, its successors and assigns, shall disturb any of the streets for the purpose 'aforesaid, it or they shall restore the same to good, order and condition as soon practicable without unnecessary delay,,and failing to do so the Town of Tukwila 'shall have the right to fix a reasonable time within which such repairs and resto- ration of streets shall be completed, and upon failure of such repairs being made by said Comer, its successors and assigns, the Town of Tukwila shall cause such repairs to be made at the expense of said The Pacific Telephone and Telegraph Company, its successors and assigns. Section 4. Bothing in this ordinance'shall be construed in arty way to prevent the proper authorities of the Town of Tukwila from sewering, grading, planking, rocking, paving, repairing,altering or improving any'of the streets, alleys, avenues, thoroughfares and public highways within the Town of Tukwila in or upon which the poles, wires or other •conduetore of said company shall be placed, but all such work or improvements shall be done if possible so as not to obstruct or prevent the free use of said poles, wires, conductors, conduits, pipes or other apparatus. section 5. In consideration of the rights, and privileges hereby granted the of Tukwila shall have, and the said The Pacific Telephone and Telegraph Company hereby grants to it the right and privilege to suspend and maintain on poles placed by said grantee, its successors and assigns, in the streets and other places aforesaid or if said wires are pUtced underground, to place and maintain .in the conduits of., said any and all, wires which said Town of Tukwila may require for fire alarm and police telegraph purposes, free of charge to said Town. .Section 6. The rights, privileges and t'ranchises herein granted shall continue and be in force for the period of twenty -five (25) years from ard. gifter the date of the passage of this ordinance. Section'.
