HomeMy WebLinkAboutRes 1200 - Residential Utility Connection Assistance ProgramCITY OF TUKWILA WASHINGTON RESOLUTION NO. 1200 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON ESTABLISHING A RESIDENTIAL UTILITY CONNECTION ASSISTANCE PROGRAM AND PROVIDING FOR GUIDELINES AND POLICIES FOR THE ADMINISTRATION OF SAME. WHEREAS, the City of Tukwila recognizes the collective benefits to Public health, safety, and welfare which arise from the provision of utility services for City residents; and WHEREAS, the Tukwila Municipal Code requires the timely connection to such utilities following construction as further recognition of the overall public benefits to be derived thereof; and WHEREAS, the City of Tukwila also recognizes that many residents have limited financial resources and that the requirements to connect to such utilities may cause undue personal hardship for such residents; and WHEREAS, the City of Tukwila receives annual funding through the King County Community Development Block Grant Consortium which may be utilized, in part, to help mitigate the hardships imposed on low income residents by such utility connections; and WHEREAS, the City Council desires to ensure equitable and consistent administration and allocation of such funds to achieve a better community and environment; now therefore; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO HEREBY RESOLVE AS FOLLOWS: Section 1. Purnose To establish a Utility Connection Program to assist low income property owners with the financing and installation of private utility connections which are required as a result of public infrastructure improvements. Section 2. Eligible Activities The following construction activities shall be eligible for funding assistance under the Utility Connection Program: a) Side sewer installation and septic system abandonment. b) Standard water service and meter installation. c) Overhead electrical conversion to underground. d) Required excavation and surface restoration associated with the construction of eligible activities. Section 3. Program Funding a) Source /Approval Funding for the Utility Connection Program shall be allocated annually by City Council on an individual project basis from the funds received through entitlement from the King County Community Development Block Grant Consortium; from any funds recovered through liens made to fund previous improvements under this program; and/or, any other revenue source designated by City Council. b) Project Applications Project funding requests shall be prepared and submitted to City Council for approval along with other Community Development Block Grant Fund proposals each fall. Funding requests shall be based on estimates developed by City Staff for the type of project and the expected level of program participation. Project funding shall be limited to the approved estimates; provided that City Council may amend the annual budget to increase project funding in those cases where program expenditures exceed estimates. c) Expenditure of Project Funds Funds from the Utility Connection Program shall be administered by City Staff and paid directly to the contractors performing the work following final inspections and approvals. Whenever possible, funding shall cover one hundred percent (100 of the property owners costs to construct all eligible activities. In the event that funding is inadequate to cover all eligible project costs, the available Block Grant Funds shall be allocated to all eligible property owners proportionally, as a percentage of total individual costs. In those instances where Block Grant funding is inadequate, City Council may approve supplemental funding to cover all or some of the funding deficiency. Supplemental funding shall be allocated under such terms and conditions as the City Council may require at the time that supplemental funding is granted. Section 4. Proara.m Eligibility Program eligibility shall be restricted to low income property owners within the City of Tukwila who reside in the properties for which the application is submitted. Income eligibility shall be determined and verified in accordance with the most current guidelines of the King County Community Development Block Grant Consortium for the year in which the project was approved. Section 5. Renavment of Funds All funds provided to property owners through construction of eligible activities for the Utility Connection Program shall be recorded as non- interest bearing liens against the subject properties. Such liens shall be payable in full upon transfer of property ownership. All funds collected through the liens process shall be returned to the source from which they were allocated. Any funds allocated through the Block Grant Program must be returned to the King County Community Development Block Grant Consortium to be re- allocated for use by the City of Tukwila. Documentation of all liens, deeds of trust, or other instruments necessary to carry out this program shall be approved by the City Attorney and filed with the City Clerk's Office. Section 6. Program Administration The Mayor shall be responsible for developing and administering the Utility Connection Program and shall have the authority to develop any regulations and procedures necessary to carry out the administration of this program.
