on the "Flat" in the Town of Tukwila, and the retention in the hands
of the Town Treasuer of a certain sum of money forthat purpose,
WHEREAS A certain Contract was entered into on the 2 3 day of
A. D. 1919, between the Town of Tukwila, by its proper Officers and t e firm
of Fielding and Smith, copartners, ofthe Town of Renton, for the improvement
by grading of certain streets in the Town of Tukwila by cutting and filling,
and the installation of certain ditches or drains, etc,, and,
'NHEREAS, the said firm of Fielding and Smith as aforesaid entered upon the
work of oarrying out their part of said contract with the Town of Tukwila
and performed certain work in accordance therewith, but have failed, neglected
and refused to complete the work specified in said contract, in accordance
therewith, and have particularly failed, neglected and refused to complete
the work specified in said contract with relation to the "Flat" District in
said Town of Tukwila; and,
WHEREAS, The said contract specifically mentions certain work to be performed
on the "Flat" in said Town as aforesaid to cost not to exceed 0,050,00, which
sum was regularly agreed upon at a meeting of the Town Council held on
3?, 1919, by a unanimous vote of the members of tie Council
pz esent; and which sum of money, with the exception of ✓"7/, which has
already been expended in pursuance of the terms of the contract with Fielding
and Smith as aforesaid, and in accordance with an Ordinance of the Town of
Tukwila, remains .intact in the hands of the Town Treasurer of said Town, to
be expended for the. specific 1'iurpose of improving various Streets in the "Flat"
District in accordance with the contract above referred to,
NOW THEREFORE, BE IT RESOLVED By the Town Council of the Town of Tukwila
that the above named sure of money now in the hands of the Town Treasurer of
said Town be kept on deposit with some reliable Banking Institution of the City
of Seattle, at as high rate of interest as can be obtained,for the completion
of the improvements to the "Flat" District of the Town of Tukwila as above set
forth; That the ditch or drain specified in said contract be immediately
completed; and that at as early a date as is practicable bids be advertised for
by the Town Council for the balance of the work specified in said contract.
Adopted by the Town Council and signed by me in authentication of its
passage and adoption this 15th day of October, A. D. 1919,
