A RESOLUTION REGARDING THE IMPROVEMENT BY G }DING AND AILING
OP 7 /AR=.'.EN AV 'NUE IN THE TOWN OF TUKWILA:
',a7R ,AS, In 1919, the firm of Smith and Fielding, Contractors,
entered into a written form of agreement or contract, where-
in and whereby the said Smith and Fielding were, among
other improvements, to improve 'Warren Avenue in the Town of
Tukwila by certain grading and filling; and,
WIEREAS, The said firm of Smith and Fielding neglected, failed
and refused to finish and complete the work expressed and
stipulated in their said contract with the Town of Tukwila,
and particularly failed, neglected and refused to complete
the improvement by grading and filling as aforesaid of the
said Warren Avenue; and,
WHEREAS, By reason of such neglect, refusal and failure on the
part of the said Smith and Fielding to so complete said
improvement by said grading and filling, the said 'Warren
Avenue has been left in an unfinished and highly unsatis-
factory condition, to the great detriment and disadvantage
of the said Town of Tukwila and some of its residents living
contiguous thereto; and,
`rIC?EAS, Schoo]. District No. 144, by its proper Officers, has
greatly improved its property in Tukwila, to -wit: Its
School grounds, by building thereon a creditable School
Building, and by grading the grounds and bringing the said
grounds up to a sightly and commendable condition. To ac,
comlish this work the said District No. 144 has graded a
portion of said Warren Avenue, but Still leaving said Warren
Avenue in an unfinished and unsatisfactory condition for
travel or the construction of Sidewalks thereon; a nd,
',I1EREAS, Warren Avenue constitutes the best and only logical
approach to the above mentioned School 'douse and grounds
and will be traversed every day while school is in session
by pupils and other patrons of the School, andf or that rea-
son, And and for the further reason that
it is to the best interests of the Public, it is deemed by
the Town Council of Tukwila to be a practical improvement,
and for the greatest good to the greatest number that Warren
Avenue be immediately brought to a suitable grade and put in
such condition as will permit of Sidewalks being constructed
thereon; and,
WHEREAS, The Grading machinery and tools used by the Contractor
for said District No. 144 are still upon the site of this
Improvement, and are accessible to the use of the Town of
Tukwila in its prosecution of this improvement, and the
Town Council, feeling justified in proceeding with the
grading and filling of said Warren avenue, as aforesaid,
without the usual formalities of advertising and calling
for bids, as it is apparent, under the conditions enumerated
above, that at no time in the future can this work be car-
ried on as cheaply or advantageously as at present, while
the machinery and tools, as a foresaid, are on the ground
and ready,
NOW THEREFORE, B2 IT RESOLVED BY THE TO -71N COUNCIL Or TUK':WILA, In
regular session assembled, That the Street Superintendent
be, and he is, hereby instructed and a uthorized to proceed
immediately and finish the grading and filling of the said
'Darren Avenue in accordance with the Specifications sub-
mitted at this time by the Town Surveyor; and that a sum of
honey, not to exceed :Four Hundred Dollars ($400.00), be

appropriated out of the General Fund of the Treasury of
Tukwila to defray the expenses of said Improvement as above
set forth.
,'rnanimoulsly adopted by the Town Council of Tukwila,
and signed by me in authentication of its adoption, this the
29th day of June, A. D. 1922.
