CALL TO ORDER Mayor Haggerton called the Special Tukwila City Council Meeting to order at 8:09 p.m. directly following the Committee of the Whole meeting. ROLL CALL Melissa Hart, Deputy City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie, Dennis Robertson, Verna Seal, Allan Ekberg, Kathy Hougardy, De'Sean Quinn and Kate Kruller. CITY OFFICIALS Jim Haggerton, Mayor; David Cline, City Administrator; Mike Villa, Police Chief; Jack Pace, Community Development Director; Peggy McCarthy, Finance Director; Derek Speck, Economic Development Administrator; Kimberly Matej, Council Analyst; Melissa Hart, Deputy City Clerk. UNFINISHED BUSINESS a. Tukwila Potential Annexation Area (PAA) North Highline. Jack Pace, Community Development Director, explained on June 5, 2012 the property owners, representing 62% of the assessed value of the North Highline area which is part of Tukwila's Potential Annexation Area (PAA), submitted their petition to commence annexation proceedings. The petition was submitted to King County and has been certified by the King County Assessor. The petition was signed by the following businesses: 1) Delta Marine 2) Driftwood Development LLC 3) Harsch Investment 4) Global Business Management 5) Mellon Trust of WA- Desimone 6) South Director LLC Pursuant to RCW 35A.14.130, when a 60% petition is filed, the legislative body of the city may entertain the same, fix a date for a public hearing and cause notice of the hearing to be published in one or more issues of a newspaper of general circulation in the city. The notice shall also be posted in three public places within the territory proposed for annexation and shall specify the time and place of hearing and invite interested parties to appear and voice approval or disapproval of the annexation. In conjunction with the proposed public hearing, staff is proposing to host a public informational meeting next week to answer questions of interested parties prior to the public hearing. Mr. Pace explained the public hearing is one of many steps in the annexation process. MOVED BY ROBERTSON, SECONDED BY KRULLER, THAT A PUBLIC HEARING BE SET FOR JUNE 25, 2012 ON THIS MATTER. Councilmember Robertson requested staff provide parcel information for the proposed annexation area, and information on how the City will provide Fire and Police services to the proposed annexation area for the next meeting. Mr. Pace explained the proposed annexation area is unique in that, depending on the time of year, there could be 40 residents in the area that live on boats. Staff has information that they will present to the Council relating to the low number of calls for service for the proposed annexation area. Tukwila City Council Special Meeting Minutes June 11, 2012 Page 2 of 2 Councilmember Quinn commented the City has heard from members of the proposed annexation area in support of annexation into Tukwila, and the City is responding to that request. He looks forward to the additional information to be presented in the June 25, 2012 agenda packet. Mayor Haggerton stated the requested information will be provided to the Council. Councilmember Kruller asked about the annexation process. Mr. Pace explained this is Tukwila's 15 annexation petition, and each annexation is unique based on the number of property owners. The proposed annexation area has approximately 24 property owners who own or operate a business in the area. The issues are different than those in a residential annexation. A major concern for the business owners is they would be subject to a Business and Occupation (B &O) tax if they were annexed into the City of Seattle. Tukwila does not have a B &O tax. Additionally, some property owners have expressed concern about the permit process in Seattle. The potential annexation area shoreline was included in the City's recent Shoreline Master Program update, so property owners already know about the City's shoreline regulations. Mayor Haggerton commented that Joe and Rick Desimone have approached the City to annex this area into Tukwila. From the request by the area property owners, it appears the group is in favor of annexing into Tukwila. Mr. Pace clarified that staff is still conducting outreach to the remaining property owners to add them to the petition.
