WHEREAS, Puget Western, Inc., Southcenter Corpora-
tion and the City of Seattle propose to enter into an agree-
ment for the relocation of a 60 -inch water pipeline presently
owned and maintained across certain properties of Puget Western,
Inc., and Southcenter Corporation located in Tukwila, Washing-
ton, and
WHEREAS, the proposed relocation will result in the
necessity for said relocated pipeline to run under certain
portions of 67th Avenue South and South 158th Street, both of
which streets are located in Tukwila, Washington, and are
presently dedicated to and for the public use, and
WHEREAS, as a condition of agreement on the part of
the City of Seattle to the proposed relocation agreement the
City requires certain assurances that the relocated portions
of said pipeline under the above described streets shall be
of a permanent and irrevocable nature, and
WHEREAS, it is anticipated that the Town of Tukwila
will hereafter be requested to grant the City of Seattle, by
ordinance, a franchise and permit for such relocated portions
of the pipeline, NOW, THEREFORE,
BE IT RESOLVED By the Town Council of the Town of
Tukwila that at such time as the Town is requested to grant
such franchise and permit it shall do so on the basis that
the rights thereby granted to the City of Seattle shall be
irrevocable so long as the above described relocated pipeline
shall occupy the above- described portions of 67th Avenue
South and South 158th Street.
PASSED by the Town Council and approved this 19th day of
June, 1961, and signed in authentication of its passage on this
19th day of June, 1961.
