HomeMy WebLinkAboutRes 0163 - Public Hearing on Waterworks Utility for LID #5 (Local Improvement District)CITY OF WASHINGTON RESOLUTION NO 163 A RESOLUTION of the City of Tukwila, Washington, declaring the intention of the City Council to order, in accordance with Ordinance No. 377 and that portion of additions and betterments entitled the collection system contained therein, the con- struction of a collection system for the City's sanitary sewer system by construction of trunk lines and laterals and by doing all work in con- nection therewith and incidental thereto, and fixing a time and date for hearing on this resolution, and to establish a local improvement district. WHEREAS, by Ordinance No. 377 passed by the City Council, City of Tukwila, Washington, and approved by the Mayor on the 25th day of February, 1963, the City specified and adopted a plan and system ordinance of additions and betterments to and extensions of the waterworks utility of the City of Tukwila, NOW, THEREFORE, BE IT RESOLVED Section 1. That it is the intention of the City Council of the City of Tukwila, Washington, to establish a local improvement district to pay for the construction of a sanitary sewer collection system, in accordance with Ordinance No. 377, consisting of trunk lines and laterals, and that the property within such L.I.D. shall pay the entire cost and expense of the improvement to be made. The City of Tukwila may modify the details of the foregoing system or plan, provided such modifications are deemed necessary or advisable in the judgment of the City Council and will not substan- tially modify the functioning of the system. Section 2. That it is contemplated and it is hereby the intention of the City Council of the City of Tukwila to organize into a local improvement district to be known as "Local Improvement District No. 5" the property located within the boundaries described in Exhibit No. 1, City of Tukwila, L.T.D. No. 5, Boundary Description which is attached hereto and which, by this reference, is made a part hereof and incorporated herein. Section 3. The nature and territorial extent of such im- provement and the routes along which the trunk lines and laterals are to be constructed is described in Exhibit No. 2, City of Tukwila, L.I.D. No. 5, Description of Improvements, which is attached hereto and which, by this reference, is made a part hereof and incorporated herein. Section 4. That the estimated cost of said improvement is $550,000.00. Section 5. That the 2O day of March, 1963, at the hour of 8 :00 o'clock P.M., in the jUt44.);e_ /-9 iMg_c be and the same is hereby fixed as the time and place for the hearing of this Resolution at which time any person having any objections to the estab- lishment of said proposed L.I.D. may appear and have his objections heard. Section 6. That the City Clerk is hereby directed to cause this resolution to be published in the legal newspaper of the City for two publications, the first publication to be not less than fifteen (15) days prior to the date of said hearing and the City Clerk and the City Engineers are hereby directed to prepare and give notice on such hearing in the manner required by law. Section 7. That Harstad Associates, Engineers for the City of Tukwila, are hereby directed to submit to the Council at or prior to the date set for hearing on this resolution, a statement of the estimated cost and expense of the proposed improvement and certify it to the City Council together with all papers and information in its possession touching the proposed improvement, a description of the boundaries of the district, a statement of what portion of the cost and expense of the improvements should be borne by the property within the proposed district, a statement in detail of the local improvement assessments outstanding and unpaid against the property in the proposed district, and a statement of the aggregate, actual valuation of the real estate, including twenty -five (25 per cent of the actual valuation of the improvements in the proposed district according to the valuation last placed upon it for the purposes of general taxation.
