RESOLUTION NO. 165
A RESOLUTION of the City Council of the
City of Tukwila, Washington, declaring its
intention to carry out the system or plan
of additions to and betterments and exten-
sions of the waterworks utility of the City
of Tukwila, Washington, including the system
of sewerage as a art thereof, as adopted by
Ordinance No.n passed June 3, 1963,
and to create a o cal improvement district
to assess a part of the cost and expense
of carrying out said system or plan against
the property within the local improvement
district proposed to be created specially
benefited thereby; and notifying all persons
who may desire to object to the establishment
of said proposed local improvement district
to appear and present their objections at
a meeting of the City Council to be held on

WHEREAS, the City of Tukwila, Washington, by Ordinance
No. g passed by the City Council and 'approved by the Mayor
on the 3rd day of June, 1963, adopted a system or plan for making
additions to and betterments and extensions of the waterworks
utility of the City, including the system of sewerage as a part
thereof, consisting of the construction and installation of certain
sewer collection lines, trunk sewer :Lines, and general facilities,
estimated the total cost of said plan to be $819,000.00, and
provided that payment therefor would be made (a) by assessments
to be levied in the amount of not to exceed $412,000.00 against
property specially benefited by the proposed improvement and
included in a local improvement district to be formed, and (b)
from the proceeds received from the issuance and sale of "Water
and Sewer Revenue Bonds, 1963" in the amount of not to exceed
$407,000.00 par value, and
WHEREAS, it is now deemed to be in the best interest
of the City that said system or plan for making additions to and
betterments and extensions of the existing waterworks utility of
the City, including the system of sewerage as a part thereof, be
carried out and that a local improvement district be created to
assess a part of the cost and expense thereof, in accordance with
the provisions of Ordinance No. _33) NOW, THEREFORE
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, as follows:
Section 1. That 'i the intention of the City Council
of the City of Tukwila, Washington, to order the carrying out
of the system or plan for making additions to and betterments
and extensions of the existing waterworks utility of the City,
as more particularly set forth in Exhibit "A" attached hereto and
by this reference made a part hereof and incorporated herein as
if set forth in full and described as "Collection System," "Trunk
Sewers Within L.I.D. No. 5 Serving as Both Trunk Sewers and Col-
lection Lines Located Within L.I.D. No. 5," and "General Facilities,"
which Exhibit "A" describes the nature and territorial extent of
the improvement and the roads along which the trunk lines and
collection laterals are to be constructed.
Section 2. That not to exceed $412,000.00 of the cost
and expense of carrying out construction and installation of the
"Collection System," described in Exhibit "A" attached hereto, side
sewers where installed, and the equivalent reasonable cost of
local 8 -inch sewer lines, if the same were constructed at the
locations of the trunk sewers described in Exhibit "A" attached
hereto as "Trunk Sewers Within L.I.D. No. 5 Serving as Both Trunk
Sewers and Collection Lines Located Within L.I.D. No. 5" (in
accordance with the provisions of RCW 35.43.0 shall be paid
by assessments to be levied in the amount of not to exceed $412,000.00
against the property specially benefited by such improve-
ment to be included in the local improvement district to be

established embracing, as near as may be, all property specially
benefited by such :improvement and more particularly described in
Exhibit attached hereto and by this reference made a part hereof
and incorporated herein. That the excess cost, over and above the
equivalent reasonable cost of 8 -inch local sewers to be assessed, as
described in Ordinance No. 35/, of the trunk sewers described in
Exhibit "A" attached hereto as "Trunk Sewers Within L.I.D. No. 5
Serving as Both Trunk Sewers and Collection Lines Located Within
L.I.D. No. 5" and the cost of the "General Facilities" as described
in Exhibit "A" hereto attached shall be paid.from the proceeds re-
ceived from the issuance and sale of "Water and Sewer Revenue Bonds,
1963" in the amount; of not to exceed $407,000.00; provided, however,
that in the event Val Vue Sewer District, King County, Washington,
shall construct the "Val Vue Trunk Sewers," as defined in Ordinance
No.< the amount of such authorized "Water and Sewer Revenue Bonds,
1963" shall be reduced by $140,000.00 to not to exceed $267,000.00.
$ection 3. That all persons who may desire to object
to the improvement herein mentioned are hereby notified to appear
and present such ob-jections at a meeting of the City Council to
be held in the Tukwila Community Hall at 8:00 p.m. (PDST) on
&O W, 67/N6 /hv 1963, which time and place are hereby
fixed for hearing all matters relating to said proposed improve-
ment and all objections thereto, and for determining the method of
payment for said improvement.
Section 4. That the City Clerk is hereby directed to
cause this resolution to be published in the legal newspaper of
the City for two publications, the first publication to be not less
than fifteen (15) days prior to the date of said hearing and the
City Clerk and the City Engineers are hereby directed to prepare
and give notice of such hearing in the manner required by law.
Section 5. That Harstad Associates, Engineers for the
City of Tukwila, are hereby directed to submit to the Council
at or prior to the date set for hearing on this resolution, a
statement of the estimated cost and expense of the proposed im-
provement and certify it to the City Council together with all
papers and information in its possession touching the proposed
improvement, a description of the boundaries of the district, a
statement of what portion of the cost and expense of the improvements
should be borne by the property within the proposed district,
a statement in detail of the local improvement assessments out-
standing and unpaid against the property in the proposed district,
and a statement of the aggregate, actual valuation of the real
estate, including twenty -five (25%) per cent of the actual valuation
of the improvements in the proposed district according to the
valuation last placed upon it for the purposes of general taxation.
Section 6. Resolution No. 163, adopted February 25,
1963, is hereby repealed.
The foregoing resolution was ADOPTED by the City Council
of Tukwila, Washington, and APPROVED by the Mayor, at a regular
meeting thereof this 3rd day of June, 1963.
