RESOLUTION NO. 204
WHEREAS, the City Council of the City of Tukwila has been presented
with a petition signed by over three hundred property owners requesting that all
amendments to the zoning ordinance, Tukwila Ordinance No. 251, be held in abeyance
for one year, and,
WHEREAS, the City Council of the City of Tukwila is deeply impressed
with the contents of this petition, but because the laws of the State of Washington
do not provide for a freeze on rezoning and, thus, such action can only be undertaken
in an emergency situation, and
WHEREAS, there is not ample evidence before the City Council to justify
the City Council declaring an emergency at this time, and
WHEREAS, under Washington State law and the City of Tukwila Ordinance
No. 251, all matters relating to zoning are to be heard first by the City Planning
Commission, now, therefore,
THE CITY COUNCIL OF THE CITY OF TUKWIIA RESOLVES as follows:
1. That the petition requesting a freeze on all rezoning activity is hereby
referred to the City Planning Commission for a public hearing on whether an emergency
exists which would justify such a suspension of rezoning activity.
2. The Planning Commission is hereby directed to report its recommendation
on the subject petition within ninety days.
3. The City Planning Commission is further directed that until it has
ascertained whether an emergency situation exists and reports its recommendation
to the City Council, it is to decline to hold hearings on any other matters.
