WASHINGTON
RESOLUTION NO. 223
A RESOLUTION of the Council, City of Tukwila,
King County,.Washington, declaring its policy
on the acquisition of land or interests there-
in for water construction being financed in
part by moneys granted by the Department of
Housing and Urban Development of the United
States of .America.
WHEREAS, the City Council deem it advisable to apply for
grant moneys under the Water and Sewer Facilities Grant Program of
the Department of Housing and Urban Development of the United States
of America; and
WHEREAS, as a condition of any such grant, an applicant
must make a policy statement relating to the acquisition of real pro-
perty in connection with the development of any such project so fin-
anced; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL, CITY OF TUKWILA, KING COUNTY,
WASHINGTON, as follows:
In connection with any construction project financed in part
with grant moneys from the Department of Housing and Urban Development
of the United States of America, it is the policy of the Council with
respect to the acquisition of real property or interests therein re-
lating thereto, as follows:
1. It will make every reasonable effort to
acquire the real property by negotiated
purchase before instituting eminent do-
main proceedings.
2. It will not require any owner to surren-
der possession of real property until the
applicant pays, or causes to be paid, to
the owner (a) the agreed purchase price
arrived at by negotiation, or (b) in any
case where only the amount of the payment
to the Owner is in dispute, not less than
75 percent of the appraised fair value as
approved by the applicant and concurred in
by the Department of Housing and Urban
Development.
3. It will not require any person lawfully
occupying property to surrender possession
without at least 90 days' written notice
from the applicant of the date on which
possession will be required.
ADOPTED by the City Council of the City of Tukwila, King
County, Washington, at a regular meeting thereof, this 3rd day of
March, 1969.
