MINUTES REGULAR MEETING CALL TO ORDER/PLEDGE OF ALLEGIANCE /ROLL CALL Mayor Haggerton called the Regular Meeting of the Tukwila City Council to order at 7:03 p.m. and led the audience in the Pledge of Allegiance. ROLL CALL Christy O'Flaherty, City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie, Dennis Robertson, Verna Seal, Allan Ekberg, Kathy Hougardy, De'Sean Quinn and Kate Kruller. CITY OFFICIALS Jim Haggerton, Mayor; David Cline, City Administrator; Shelley Kerslake, City Attorney; Derek Speck, Economic Development Administrator; Jack Pace, Community Development Director; Minnie Dhaliwal, Planning Supervisor; Bob Giberson, Public Works Director; Nick Olivas, Fire Chief; Mike Villa, Police Chief; Christy O'Flaherty, City Clerk. SPECIAL PRESENTATIONS Swearing in of Joseph Tran, Lateral Police Officer. Mike Villa, Police Chief. Chief Villa introduced Officer Joseph Tran to the City Council. He came to live in the Seattle area when he was 15 and has worked in law enforcement for the City of Albuquerque. Officer Tran has received multiple commendations during his time as a police officer and is a great addition to the Tukwila Police Department. Mayor Haggerton administered the Oath of Office to Officer Tran, Badge #204 Officer Tran thanked the Council, Mayor and Chief Villa for the opportunity to be part of the Tukwila family. He looks forward to serving the community and helping make the Tukwila Police Department a world class organization. The Mayor and Councilmembers congratulated Officer Tran. APPOINTMENTS a. Confirm the appointment of Cassandra Hunter to Position #2 on the Planning Commission, with a term to expire March 31, 2014. Jack Pace, Community Development Director, introduced Cassandra Hunter to the City Council. Ms. Hunter is new to the City and has a diverse background. She has been in the Peace Corps and has involvement with many community groups and also speaks Arabic. MOVED BY HOUGARDY, SECONDED BY SEAL TO CONFIRM THE APPOINTMENT OF CASSANDRA HUNTER TO POSITION #2 ON THE PLANNING COMMISSION, WITH A TERM TO EXPIRE MARCH 31, 2014. MOTION CARRIED 7 -0. Tukwila City Council Regular Meeting Minutes August 20, 2012 Page 2 of 5 b. Confirm the appointment of Sharon Mann to Position #7 on the Planning Commission, with a term to expire March 31, 2015. Mr. Pace stated Ms. Mann could not be in attendance this evening, and that she has been involved with the Tukwila community since 1988. She is currently a member of the Tukwila International Boulevard Action Committee (TIBAC) and the Strategic Planning Committee. MOVED BY SEAL, SECONDED BY QUINN TO CONFIRM THE APPOINTMENT OF SHARON MANN TO POSITION #7 ON THE PLANNING COMMISSION, WITH A TERM TO EXPIRE MARCH 31, 2015. MOTION CARRIED 7 -0. CITIZEN COMMENTS David Shumate, 11534 East Marginal Way South, relayed his concerns about the rerouting of Burlington Northern Santa Fe (BNSF) Railroad truck traffic along South 115 Streets. He feels this will have a negative impact on the community and affect the new Duwamish Hill Preserve. He suggested a truck entrance from Airport Way, the Boeing Access Road or 48 Avenue South. This would keep BNSF traffic out of Tukwila neighborhoods. Sean Albert, 4023 South 114 Street, believes it is a bad idea to move BNSF trucks from 1 street to another. There has been concern about people staying in the City of Tukwila, and truck traffic is not conducive to that goal. He would like to see an independent group review the issue and consider options. Georgina Nelson Thomas, 3836 South 116 Street, lives on the Duwamish River and feels that truck traffic would impact the whole community on both sides of the river and on Poverty Hill. There have been occasions in the past when the needs of the Duwamish community have not been taken into consideration, and she would like to see this issue resolved to a positive outcome for everyone. Brooke Alford, 4724 South 122 Street, is Chair of the Tukwila Planning Commission. She is not in support of a proposed alternative truck route to South 115 and South 116 street. This amounts to moving traffic from 1 residential street to another and is not supportive of neighborhoods. In her viewpoint, any type of research would have shown this to be an inadequate and unacceptable alternative. She would like to see the City consider a consultant who could review options and develop a strategic approach. Mayor Haggerton relayed that the concern on this issue may be unwarranted. By way of background, in the year 2000 a study was done regarding BNSF truck routes and 11 options were reviewed. This was one of the options considered. The City, with the help of Senator Cantwell's office, will be discussing various options with BNSF. He thanked the citizens for attending the meeting to convey their concerns. CONSENT AGENDA a. Approval of Minutes: 8/6/12 (Regular Mtg.) b. Approval of Vouchers #361212- 361311 and #120700, 120801 120802 in the amount of $1,709,993.09 c. Accept as complete the 6300 Building Fire Alarm System Upgrade (contract #12 -025) with Alarm Center, dba Custom Security; authorize release of retainage, subject to the standard claim and lien release procedures (final cost of project, including retainage: $45,821.37). [Reviewed and forwarded to Consent by Utilities Committee on 8114112.] d. Accept the Public Works Trust Fund Loan for the Commercial Business District Sanitary Sewer Rehabilitation Project in the amount of $750,000.00, and authorize the Mayor to sign the contract. An ordinance to accurately define the portion of Tukwila International Boulevard between South 139th Street and South 152nd Street where the speed limit is to be reduced from 40 miles per hour to 35 miles per hour. MOVED BY EKBERG, SECONDED BY DUFFIE THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED 7 -0. Christy O'Flaherty, City Clerk, read the proposed ordinance by title only. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING ORDINANCE NOS. 1875 §1 AND 1866 §1, AS CODIFIED AT TUKWILA MUNICIPAL CODE SECTION 9.16.070, TO ACCURATELY DEFINE THE PORTION OF TUKWILA INTERNATIONAL BOULEVARD BETWEEN SO. 139 STREET AND SO. 152 No STREET WHERE THE SPEED LIMIT IS TO BE REDUCED FROM 40 MPH TO 35 MPH; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY QUINN, SECONDED BY HOUGARDY THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ. MOTION CARRIED 7 -0, TO ADOPT ORDINANCE NUMBER 2380. b. Authorize the Mayor to sign an agreement with Macaulay Associates, Ltd. for the Tukwila Urban Center Access (Klickitat) LID #33 Final Special Benefit/Proportionate Assessment Study in the amount of $142,800.00. MOVED BY EKBERG, SECONDED BY DUFFIE TO AUTHORIZE THE MAYOR TO SIGN AN AGREEMENT WITH MACAULAY ASSOCIATES, LTD. FOR THE TUKWILA URBAN CENTER ACCESS (KLICKITAT) LID #33 FINAL SPECIAL BENEFIT /PROPORTIONATE ASSESSMENT STUDY IN THE AMOUNT OF $142,800.00. MOTION CARRIED 7 -0. c. A resolution accepting the 60% annexation petition for a certain unincorporated territory known as Tukwila's portion of the North Highline Potential Annexation Area; expressing the intent to annex; and providing for submission of a Notice of Intent to the Washington State Boundary Review Board for King County. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ACCEPTING THE 60% ANNEXATION PETITION FOR A CERTAIN UNINCORPORATED TERRITORY KNOWN AS TUKWILA'S PORTION OF THE NORTH HIGHLINE POTENTIAL ANNEXATION AREA; EXPRESSING THE INTENT TO ANNEX; AND PROVIDING FOR SUBMISSION OF A NOTICE OF INTENT TO THE WASHINGTON STATE BOUNDARY REVIEW BOARD FOR KING COUNTY. MOVED BY DUFFIE, SECONDED BY SEAL THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ. MOTION CARRIED 7 -0, TO ADOPT RESOLUTION NUMBER 1772. 1 k, f4 I-flP.L Discussion and consensus regarding Council representation on the Tukwila Tree and Environment Advisory Committee. A representative from the City Council needs to be named to serve on the Tukwila Tree and Environment Advisory Committee. The Committee will meet on the 4th Wednesday of each month from 5:30 to 7:30 p.m. and is expected to meet for a length of 6 -8 months. Tukwila City Council Regular Meeting Minutes August 20, 2012 Page 4 of 5 Councilmember Hougardy, Chair of the Community Affairs and Parks (CAP) Committee, explained that when this item came before CAP, she suggested that the Council representative be a member of the CAP Committee. The 3 Councilmembers who have expressed interest are not currently members of CAP, and Councilmember Hougardy is open to whatever the full Council decides. After discussion and consideration, Council consensus existed for Councilmember Quinn to be the representative on the Tukwila Tree and Environment Advisory Committee. REPORTS a. Mayor Mayor Haggerton reported that the project to remove the Hesco barriers along the Tukwila levee is underway. The work began along West Valley Highway. b. City Council Councilmember Duffie attended the United Grocers 90 anniversary celebration. Council President Seal had an opportunity to sit in on the Community Affairs and Parks Committee for Councilmember Ekberg and on the Utilities Committee for Councilmember Robertson. As Council President, it is refreshing to have an opportunity to fill in on a Council Committee. Councilmember Ekberg enjoyed the Community Yard Sale events this past weekend. Councilmember Kruller attended the United Grocers 90 anniversary celebration and provided a commemorative book to the Mayor. She indicated that she will be talking with Human Services staff regarding a senior citizen who needs assistance with tree removal. She acknowledged and commended the people at Friendz Cafe who took it upon themselves to cut down waist -high grass in the area of the Tent City development. c. Staff There was no report. d. City Attorney There was no report. e. Intergovernmental The Council Analyst is not required to attend Regular Meetings. MISCELLANEOUS Councilmember Robertson referenced the City Administrator Report and the deployment of iPads to the Councilmembers. He indicated that records retention issues will need to be considered during this process. He acknowledged the positive information in the report regarding the Police and Fire Explorers. He also found the information regarding the "Restore the Duwamish Shoreline Challenge" and the involvement of local businesses to be a great model and commended staff for their work on this project.
