BACKGROUND KPG's consultant Contract No. 11 -151, along with Supplement No. 1, provided design engineering services for the 2012 Annual Small Drainage Program. Council awarded the construction contract to Green River Construction on July 2, 2012. KPG's Supplemental Agreement No. 2 provided construction management (CM) support during the construction phase, but did not include field construction inspection, geotechnical review, testing, field observation, and reporting. DISCUSSION To properly manage this construction project, the City will need additional CM support during the construction phase. With Supplement No. 3, KPG staff will provide additional site inspections; reviews for material submittals, change order requests; and as -built drawing preparation. Also, KPG will provide a subcontractor for geotechnical site observation and testing in support of the outfall repairs located at the Fort Dent Park levee. Tukwila CM staff will provide the majority of the CM work and limited field inspections. BUDGET SUMMARY Supplement No. 3 with KPG was carefully reviewed and is reasonably priced for the consultant work. RECOMMENDATION Council is being asked to approve Supplemental No. 3 to Contract No. 11 -151 with KPG, Inc. in the amount of $45,500.85 for additional construction management services for the 2012 Annual Small Drainage Program and consider this item on the Consent Agenda at the October 1, 2012 Regular Meeting. All provisions in the basic agreement remain in effect, except as expressly modified as follows: Article 2, Scope of Services, shall be supplemented with the following: The Consultant agrees to provide construction support services as requested by the City in accordance with the scope of work included as Exhibit A. Article 4, Payment, shall be modified as follows: Payment for work provided by Consultant shall be made as provided on Exhibit B, attached hereto, provided that the total amount of payment to the Consultant for this work not exceed $45,500.85 without express written modification. of the Agreement signed by the City. Principal 15 Exhibit A City of Tukwila 2012 Small Drainage Program Supplement No. 3 Construction Observation Scope of work August 29, 2012 The Consultant shall provide part time construction observation services including preparation of daily reports, quantity tracking and general coordination of Contractor activities in accordance with the project Plans and Specifications. This supplement also provides for specialty geotechnical inspection and testing for levee reconstruction associated with the improvements near Fort Dent Park. The scope of services and associated cost of services (Exhibit B) are based upon the assumptions outlined below. A. Field Observation: The Consultant shall provide the services of one part -time project engineer, part -time inspector, and other tasks necessary to monitor the progress of the work. Inspection staff shall oversee all work to be performed indentified in the Contract Documents and will observe the technical progress of the construction, including day -to -day contact with the Contractor and the City. The budget assumes field observation services will require approximately 75% observation for 90 calendar days. By providing inspection oversight, the Consultant shall assume no responsibility for construction means, methods, or job site safety. The presence of the Consultant's personnel at the construction site is for the purpose of providing to the City a greater degree of confidence that the completed work will generally conform to the Contract Documents and that the integrity of the design concept as reflected in the Contract Documents has been implemented and preserved by the construction Contractor(s). The Consultant's personnel shall act in accordance with Section 1 -05.1 and 1 -05.2 of the current WSDOT Standard Specifications. The Consultant will endeavor to protect all parties against defects and deficiencies in the work of the Contractor(s), but cannot guarantee the Contractors' performance and shall not be responsible for construction means, methods, techniques, sequence of procedures, or for safety precautions and programs in connection with the work performed by the construction Contractor(s) and any subcontractors. Field observation staff will perform the following duties on a part time basis as a matter of their daily activities: Prepare daily construction reports for those days on -site, detailing the Contractors operations performed; measure the quantities of materials installed; log equipment and staff used; and other associated information. Respond to questions which may arise as to the quality and acceptability of material furnished, work performed, and rate of progress of work performed by the Contractor, including response to related questions from adjacent property owners and the general public. Provide periodic photographs during the course of construction. Photographs will be in digital format and cataloged by date. 1 B, Provide geotechnical site observation and testing in support of levee repair on the Fort Dent Park site. PRESENTATIONS No presentations. II. BUSINESS AGENDA A. Resolution Reiectinu Bids: George Longs Shops Water /Oil Separator Staff is seeking Council approval of a resolution that rejects all bids that vvere submitted for the Water /Oil Separator Project at the George Long Shops. The Citv Nyill soon be looking at a comprehensive Facilities Plan that Nyill call for the replacement of the existing George Long Shops (that sertirices facilities and fleet). In consideration of the Facilities Plan, Public Works staff believes it is in the best financial interest of the City to delay the Water /Oil Separator Project and make only minimal improvements to the Shops, as required to meet compliance of the City's NPDES Permit. Staff will return to Committee late this year or early next year with a temporai fix to this concern v, -hich is anticipated to cost approximately and is expected to last for 5 -10 years. Project monies Nyill come from the 303 Fund. Committee Chair Robertson requested that the informational memo provided to Council include additional details as discussed above since the item will be going to the Consent Agenda. B. 2012 Annual Small Drainage ProQram: Supplemental Agreement No. 3 Staff is seeking Council approval for Supplemental Agreement No. 3 with KPG, Inc. in the amount of $45,500.85 for additional construction management sertirices needed during the construction phase of the Annual Small Drainage Program. Staff reported that the last amendment had a limited amount of construction management Nyork, and this nevv amendment includes field inspections of all sites, geo- technical engineering and testing in support of outfall repairs at Fort Dent Park. The project still remains within budget. UNANIMOUS APPROVAL. FORWARD TO OCTOBER 1 CONSENT AGENDA. C. Review of the Draft 2012 Surface Water Comprehensive Plan The draft 2012 Surface Water Comprehensive Plan (SWCP) is nosy complete and ready for revievv by the Utilities Committee. The purpose of the Surface Water Comprehensive Plan is to revievv surface Nyater and habitat needs, and develop a list of projects for incorporation into the City's Capital Improvement Program. Once complete, this SWCP will replace the 2003) Plan, and include regulations as required under the NPDES Permit, GIS inventor completed CIP Projects, Tukwila South annexation area, and other nevvly identified needs.
