RESOLUTION NO 269
THE CITY COUNCIL OF THE CITY OF TUKWILA RESOLVE AS
1. Mr. Don G. Hemmerling is the record owner of real
property located at 14209 58th South in the City of Tukwila.
2. On the report of Mr. Frank Zepp, City Supervisor,
it is found and declared that Mr. Hemmerling has deposited or
peimitted the deposit or accumulation of litter, refuse, and
rubbish; has permitted weeds, tall grass, or other growth to
accumulate; and has maintained or permitted to remain an un-
sightly and dangerous building or partially destroyed structure;
all the foregoing acts or conditions being done or permitted on
the property owned by Mr. Hemmerling at 14209 58th Avenue
South, and after repeated requests to correct these conditions,
he has failed to do so.
3. The acts and conditions described in paragraph 2
are found and declared to be public nuisances constituting a
fire hazard or a menace to public health, safety or welfare in
violation of Tukwila Municipal Code 8.28.270.
4. Mr. Hemmerling is directed to abate the nuisance
by correcting all conditions declared to be a nuisance by this
Resolution, and to do so at his own expense no later than one
hundred forty -four (144) hours after passage of this Resolution.
5. In the event the conditions constituting a nuisance
on Mr. Hemmerling's property are not abated within one hundred
forty -four (144) hours of the passage of this Resolution, the
City Supervisor
shall abate the same and shall render a bill covering the cost
to the City of such abatement including the Supervisor's expense,
and mail the bill to the property owner. Upon failure of the
property owner, Mr. Hemmerling, to pay such costs, the City
Supervisor shall file a lien therefore against the property.
6. This Resolution shall not prejudice the City's
right to prosecute in regard to the violations which are the
subject of this Resolution.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON AND APPROVED BY THE MAYOR AT A REGULAR MEETING THERE-
OF this 7th day of September, 1971.:
