RESOLUTION NO. 273
A resolution authorizing execution of
easements.
WHEREAS, the Andover Lift Station is being reconstructed
WHEREAS, the easement presently existing between South
Center Corporation and the City of Tukwila is or will be no longer
necessary, and
WHEREAS, a new easement from South Center Corporation
Connecticut General is required for the new construction,
NOW, THEREFORE, BE IT RESOLVED
That the Mayor and Clerk are authorized to relinquish
the present easement and to execute the new easement on behalf of
the City of Tukwila.
PASSED by the City Council this 20th day of December,

RELINQUISHMENT OF EASEMENT
Pursuant to Resolution No. 273, The City of Tukwila
hereby relinquishes and abandons any and all rights that it has
in Easement No. 3, a copy of which is attached hereto and incor-
porated herein by reference.

The Grantor, SOUTiCENTER CO DOR.ATIoN, a Washington corporation
hereinafter called "Southcentcr," does hereby grant to the Town
of TUKWIIA, Washington, a municipal corporation, its successors
and assigns, an easement for underground water, sewer, drainage,
electric power, gas, telephone, and railroad spur crossings over,
through, across, upon and in the following described real property
located in King County, Washington, all upon the terms and con-
ditions hereinafter set forth:
Easement No. 1:
The west 10 feet of the east 40 feet of the northwest
quarter of the northeast quarter of Section 26, Township
23 North, Range 4 East, W.M.
A strip 10 feet wide west of, parallel with, and
:immediately adjacent to the following described real
property:
Beginning at the northwest corner of the north-
east quarter of the northeast quarter of Section
26, Township 23 North, Range 4 East, W.M. thence
north 0 12'09" west along the west line of
said subdivision produced across W. H. Gilliam D.L.C.
No. 40, 755.69 feet, said line being the east line
of Sout ,.center, Inc., property; thence South 88
40'00" west, 82.53 feet; thence south 1 20'00" east,
80.0 feet to a point of curve whose tangent bears
north 88 40'00" east; thence along a curve to the
right having a radius of 50.0 feet, a distance of
79.53 feet to point of tangent; thence south 0 12'09"
east parallel to said east property line, 623.81 feet,
to north line of said section 26, said north line also
being the south line of said W. H. Gilliam D.L.C.;
thence south 89 40'24" east, 30.0 feet returning
to the point of beginning, EXCEPT the south 30 feet
thereof which is the City of Seattle pipe line right-
of-way.

With respect to the above mentioned easements the parties
agree as follows:
(1) Southcenter reserves to itself all uses of the real
property described in said easements

for installing, maintaining, inspecting, and repairing, lines
the services mentioned, including, but not limited to, the
reservation of full rights to use the surface of the ground
above such easements for parking, landscaping and railroad spur
crossings and all of the real property described in such ease-
ments for the installation of such other utilities as Southcenter
may desire to.insi:all.
(2) Tukwila, its successors and assigns, agree to replace
and to return to former condition as rapidly as practicable any
landscaping, shrubbery, turf, or cement, asphaltic or other
surfacing disturbed as a result of the easements herein granted.
(3) The parties agree that Easement No. 3 above described
is to be used for the installation of a sewage lift station.
Such sewage lift station and all other facilities, except rail-
road spur crossing facilities, installed through any of the
above mentioned easements shall be completely underground in
accordance with grades and ground levels from time to time
established by Southcenter. Expenses incurred by reason of
Southcente 's raising or lowering such grades or ground levels
with respect to such facilities as Tukwila may ....stall here-
under shall be borne by Tukwila., its successors or assigns.
(4) Acceptance of delivery or recording of the above
mentioned easement, or use of any type by the Town of Tukwila,
its the is successors or assigns, of the aioreiientioned easement shall
to constitute an agreement by the Town of Tukwila to be bound by

the terms hereof. This agreement shall be binding upon the
