RESOLUTION NO 274
A RESOLUTION authorizing the Mayor and Clerk
to execute a Water Agreement with the Independent
CV Water Company.
N WHEREAS, the City of Tukwila has negotiated a Water Agree-
ment with the Independent Water Company,

NOW, THEREFORE, BE IT RESOLVED that the Mayor and the Clerk
are authorized to execute the Water Agreement, a copy of which is
attached hereto and incorporated herein by reference.

WATER AGREEMENT
THIS IS AN AGREEMENT between Independent Water Company
(hereinafter referred to as Independent) and the City of Tukwila
(hereinafter referred to as Tukwila).
RECITALS:

gyp- 1. Independent is upgrading its water system pursuant

to plans and specifications of Ruskin Fisher, which have been
CD approved by the City of Tukwila, the City of Seattle Water Depart-
ment, and the Washington Rating Bureau.
2. Independent desires to purchase water from Tukwila and
Tukwila desires to sell them water.
3. Independent desires to sell its system to Tukwila at a
later date on terms and conditions to be negotiated between the
parties.
NOW, THEREFORE, for good and valuable consideration, the
parties agree as follows:
1. Tukwila agrees to sell and deliver water to Independent
through one of the City's meters from the City of Seattle Bow Lake
Line. The charge for this service to Independent shall be the
cost at any time to the City per 100 cubic feet of water plus
one cent (1¢) per 100 cubic feet of water plus Thirty Five Dollars
($35.00) which is one -half of the meter charge.
2. The water usage will be based on a total of the indi-
vidual meter readings and any overage which occurs will be paid

for by Independent or as mutually agreed upon by both parties.
The parties agree to enter into negotiations for a sale
of the system when the upgrading is completed.
